Q13 GlobalPharma holds a patent for Nex-Gen, a kidney cancer drug priced at Rs. 2.8 Lakhs per month. Three years post-grant, IndiMed, a local generic firm, applies for a Compulsory License (CL). (i) Under Section 84 of the Indian Patents Act, which of the three specific grounds for a CL is most clearly triggered by the high price and low supply of Nex-Gen? (ii) Rights vs. Access: If the CL is granted, what mechanism ensures the original patent holder still receives a return on their innovation while the public gains access to cheaper generic versions?

(i) Advice the company X-Trends Corp: Will application by the company succeed for the registration of the mark 'ZURA-X' as a Trade Mark under the Trade Marks Act, 1999? (ii) If the company "ZURA-X" has filed for a trademark registration with the Trade Mark Registry, what action can Zura Lifestyle take under Trade Marks Act, 1999?

The company registered a patent for this invention in France five months ago. Now, SmartWeigh Technologies plans to file a patent application in India for the same invention. Both India and France are members of the Paris Convention for the Protection of Industrial Property (1883). The company seeks clarification on the following points: (i) Whether it can still apply for a patent in India for the same invention after filing in France five months ago. (ii) Whether it will receive the same protection and treatment as Indian applicants, without discrimination on the basis of nationality.
