SECTION III - Q.3: Answer any two of the following questions (12 Marks - 6 marks each)

Q15 Mr. A was settled in Mumbai with his wife and two children. Mr. A insured his life and nominated his policy in the favour of his father. Mr. A was suffering from Heart problems which was not disclosed to the Insurer. Due to sudden Cardiac Arrest, Mr. A passed away. After the death of Mr. A, his widow and children, claimed their shares of the sum assured from the Insurer as legal heirs of the assured. (i) What is nomination? (ii) With respect to relevant provisions of Insurance laws, discuss the rights of the nominee as to the claim after the death of the assured? (iii) Discuss the liability of the insurer in the above case and ascertain who will get the sum assured in the aforementioned case?

Q16 A marine insurance was taken to prevent the loss suffered from the peril of the sea. In course of the voyage, the ventilators of the ship were closed to prevent the entry of the sea water and rain coming in during heavy weather and this closing of ventilators damaged the rice due to excessive heat. Discuss the liability and legal issues in the case.

Q17 Mrs. Sheela insured her life with HIC Insurance Co. and in letters of contract it was provided that the policy was to become unenforceable if the assured would cause her own death before the policy has been in existence for one year. The assured after one year assigned the policy in favour of her daughter and 8 months thereafter she committed suicide out of disgust. Mrs. Sheela was in her complete senses and sound state of mind while committing suicide. The daughter filed a suit as assignee to claim the amount of the policy. Decide whether the Insurer Company is liable to pay the amount in case of suicide by the assured?

Q18 Mr. Vinod was an owner of a private car which was insured under a comprehensive policy. He was using his car for Tours & Travels without traveling license. His car met with an accident on Bangalore highway and driver along with other two passengers died on the spot. (i) Is Mr. Vinod entitled to get the compensation of damaged car? Why? (ii) Whether a legal heir of the deceased persons will get the compensation by the Insurance Company? Why?
