SECTION III - Q.3: Situational problems, any two (12 Marks - 6 marks each)

  1. Q15 A person accused of inflicting grievous injury on a complainant states that he did it in "self-defence". (i) On whom does the burden to prove the right to exercise self-defence lie? (ii) Whether the self-defence was proportionate to the threat?
  2. Q16 "A" makes a confession to a police officer. The murder weapon is recovered by the police. "A" is charged with Murder. (i) Whether a conviction on the basis of the confession only is justified? (ii) Does the murder weapon have any relevance?
  3. Q17 A makes a dying declaration. The medical condition of A was so grave that his testimony could not be relied upon. A subsequently dies. The accused is charged on the basis of the dying declaration. (i) Whether the declaration is admissible? (ii) Whether other circumstantial evidence is relevant?
  4. Q18 The house of A was gutted by fire, fully destroying A's sale deeds for his fields in his village. Knowing this, B threatens to dispossess A from the field. (i) Can A prove his sale deeds? (ii) What would be the mode of their proof?
