SECTION III - Q.3: Answer the following by giving reasons, any two (12 Marks - 6 marks each)

  1. Q15 A patient admitted to a psychiatric hospital is unknowingly included in a new drug trial without being informed or giving consent. The patient subsequently suffers severe side effects and files a complaint against the hospital. (i) Does conducting a drug trial without the patient's informed consent violate the patient's right to health and personal liberty under the Constitution of India? Explain. (ii) What legal remedies are available to the patient against the hospital for unauthorized medical experimentation?
  2. Q16 A hospital conducts an ultrasound test and discloses the sex of the fetus to an expecting couple, violating the legal prohibition under the Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994. Later, authorities uncover several similar offenses committed by the same clinic. (i) What legal provisions are violated by the hospital under the PCPNDT Act, 1994? (ii) What penalties and legal consequences can be imposed on the clinic and the medical practitioners involved?
  3. Q17 A doctor at a private hospital refuses to treat a critically injured accident victim, stating that treatment cannot begin without police documentation and advance payment.
