SECTION III - Q.3: Answer any two of the following situation problems (12 Marks)

  1. Q15 Alpha Motors Ltd. develops a new two-wheeler engine technology that improves fuel efficiency using a unique combustion mechanism. The company obtains a patent for this invention. A competing company, Beta Vehicles Pvt. Ltd., launches a motorcycle claiming to use a "different" technology but achieving similar results. Alpha Motors alleges that Beta's product infringes its patent and seeks an injunction. Beta argues that its technology is independently developed and does not fall within the scope of Alpha's patent claims. (i) According to the Indian Patents Act, discuss whether Alpha Motors is entitled to an injunction. (ii) Discuss the defences available to Delta Motors in a patent infringement suit.
  2. Q16 Mr. B conceives an idea for a reality television show where law students compete through moot courts, client counselling rounds, and judgment writing. He submits a two-page concept note and format outline to the Copyright Office seeking registration. No scripts, dialogues, or episode wise structure are provided. Another producer later creates a similar show. (i) Mr. B claims copyright infringement based on his registration application, will he succeed? (ii) Examine whether copyright registration can subsist in such an idea or format.
  3. Q17 Aurelia Creations has sold premium handbags under the registered trademark "AURELIA" since 2018. In 2026, Nova Edge Pvt. Ltd. launches a line of formal leather wallets named "AURELIA-N." The company wishes to file for registration of the trademark "AURELIA-N." While the products are different, some customers complain to Aurelia Creations about the poor quality of "AURELIA-N" wallets, mistakenly believing both companies are related. (i) Advise Nova Edge Pvt. Ltd. Will its application for registration of the mark "AURELIA-N" succeed under the Trade Marks Act, 1999? (ii) If Nova Edge Pvt. Ltd. has applied for registration, what action can Aurelia Creations take under the Trade Marks Act, 1999?
  4. Q18 Dr. Anil, an environmental scientist, develops a portable water filtration straw called "Solar-Purify." It uses a specific, newly discovered chemical resin filter combined with a UV-light chamber powered by a small solar strip. (i) Can Dr. Anil apply for a patent for the "Solar-Purify" water filtration straw? (ii) Which feature of the "Solar-Purify" straw makes it eligible for patent protection?
