SECTION III - Q.3: Solve any two of the following problems (12 Marks - 6 marks each)

  1. Q16 Answer the following problems with reasons: (i) Savita, a pregnant woman working in a factory for the past one year, loses her child due to an accident at home. What is the Maternity Benefit that Savita is entitled to under the Maternity Benefit Act? (ii) Archana had made three complaints to the police that her husband and mother-in-law were demanding money from her father. Archana died due to severe burns within a year of her marriage. State the offence committed and what kind of action can be taken against Archana's mother-in-law.
  2. Q17 A boy, Sumit, below 16 years of age was kidnapped from his lawful guardianship. (i) Which section of the IPC can be applied here? (ii) If the boy is taken away from India, then what is the kidnapping called, and under what section? (iii) According to section 366, if a woman is kidnapped, then what is it called? (iv) What is the punishment for abduction?
  3. Q18 On a sudden raid by the police at a Brothel, they found many young ladies along with a minor girl aged ten years. (i) Are all the ladies to be punished? If yes, under which Act? (ii) Whether the minor girl aged ten years shall also be liable to punishment? If not, then what is the alternative? (iii) Whether the senior lady living on the earnings from the Brothel is also liable to be punished? Yes or no, state reasons for the same.

  1. Q19 Discuss the Right to Payment of Maternity Benefit under the Maternity Benefit Act, 1961.
  2. Q20 Discuss the need of Prohibition of Immoral Traffic in Women and also discuss the main provisions of Immoral Traffic in Women.
  3. Q21 How does the Constitution of India safeguard the interest and right of women? Discuss the provisions with case law under the following headlines: (1) Under the preamble. (2) Right to equality. (3) Special provisions. (4) Under directive principles.
  4. Q22 Discuss in detail the divorce of women under Muslim Law.
  5. Q23 Discuss in detail the provisions of Maintenance of wife and children under the Adoption and Maintenance Act, 1956.
  6. Q24 Discuss the protection given to children under 'The Child Labour (Prohibition and Regulation) Act, 1986' with respect to: (1) Total prohibition of employment. (2) Authority who can amend the schedule. (3) Regulation of conditions of work. (4) Liability of the employer.
