SECTION III - Q.3: Solve any two of the following problems (12 Marks - 6 marks each)

  1. Q17 Sheena, a girl aged 18, is abducted by a 26 year old man with the intention of getting married. (i) What is the nature of the offence committed, and state the punishment for the same. (ii) Under which Section of the IPC is the offence and the punishment prescribed? (iii) Define the crime applicable under the IPC in the above matter.
  2. Q18 A Hindu male adopts a child with the consent of his wife W. (i) Can such adoption deprive the adoptive father or mother of the power to dispose of his or her property by transfer inter vivos or by will? (ii) Can any property vested in the adopted child before the adoption continue to vest in such person? (iii) Can the adoption be cancelled? Why?
  3. Q19 A boy below 16 years of age was kidnapped from his lawful guardianship. (i) Which Section of the IPC can be applied here? (ii) If the boy is taken away from India, then what is the kidnapping called, and under what Section? (iii) According to Section 366, if a woman is kidnapped, then what is it called? (iv) What is the punishment for abduction?

  1. Q20 Discuss the Constitutional provisions for the benefit of women and explain how it safeguards the interests and rights of women.
  2. Q21 Discuss in detail the divorce of women under Muslim Law.
  3. Q22 Discuss the protection given to children under the Child Labour (Prohibition and Regulation) Act, 1986 with respect to: (i) total prohibition of employment; (ii) the authority who can amend the Schedule; (iii) regulation of conditions of work; (iv) liability of the employer.
  4. Q23 Write in detail the offences relating to marriage under the Indian Penal Code, 1860 with respect to women under the following heads: (i) Cohabitation by deceitful means, Section 493; (ii) Bigamy, Section 494; (iii) Adultery, Section 497.
  5. Q24 Discuss in detail the provisions of maintenance of wife and children under the Adoption and Maintenance Act, 1956.
  6. Q25 Discuss in detail the functions of the Family Court.
