SECTION III - Q.3: Answer the following by giving reasons, any two (12 Marks - 6 marks each)

1. Q17 "X" is nine weeks pregnant and is under Ayurvedic treatment. It is detected that the fetus has chromosomal abnormality. The Ayurvedic doctor performs the abortion in a registered medical clinic. (i) Mention two prenatal diagnostic techniques. (ii) When does law permit the use of prenatal diagnostic techniques? (iii) Comment on the legality of an Ayurvedic doctor performing abortion.
2. Q18 'X' was admitted to hospital for treatment for food poisoning. A nurse kept a massage oil on his medicine rack. 'X's mother administered the massage oil in place of medicine due to which 'X' suffered an allergic skin reaction, for which he had to undergo expensive and prolonged treatment. (i) What is medical negligence? (ii) Against whom can 'X' claim damages and in which redressal forum? (iii) What is the defense available to the defendant?
3. Q19 "B" was standing on the road side when he was hit by a speeding car. He suffered a head injury and was rushed to hospital. After investigation it was found that the driver was drunk.
