SECTION III - Q.3: Answer any two of the following (12 Marks - 6 marks each)

Q15 Mr. A and Mrs. X, husband and wife and residing at Kochi take a joint life policy and pay for the policy premium jointly. After taking the Policy, Mrs. X commits suicide and Mr. A claims for the sum assured from the Insurer. The Insurer however contests Mr. A's claim saying that the husband has no Insurable Interest in the wife's life. (i) What is Insurable Interest? Is it an essential ingredient in an Insurance. Explain giving suitable reasons. (ii) Does the husband have any Insurable Interest in the wife's life? Explain elaborately giving suitable details.

Q16 Mr. Vinod was an owner of the private car & his car was insured under the comprehensive policy. He was using his car for Tours & Travels without traveling license. His car was met with an accident on Bangalore highway and driver along with other two passengers died on the spot. (i) Is Mr. Vinod entitled to get the compensation of damaged car? Why? (ii) Whether a legal heir of the deceased persons will get the compensation by the Insurance Company? Why?

Q17 Mr. Vijay made a proposal for the insurance of his house against fire. The method of disclosure was passive disclosure and therefore the insured was required to fill the form accordingly. One of the questions in the proposal form was "whether the house had been previously offered for insurance to any other insurance company, and if so with what results". Vijay left this question without any answer. The policy was insured and the insurance company, subsequently found that on two previous occasion's proposals for insuring the house had been rejected. The Insurance Company denied the claim. Decide the liability for the Insurance Company with the help of the relevant case laws.

Q18 Mr. Sandeep was driving a scooter and unfortunately dashes into a person crossing road, both fell down and get severe injuries. Unfortunately, the person crossing road dies at the Hospital. Sandeep, has a driving license, the scooter has a third party insurance and also the driver was not going in any wrong direction. It was an unintentional collision. (i) What is the procedure followed to solve the case legally? (ii) Specify the ways to recover insurance amount from insurance company. If they will go to court what could be punishment and penalty to the driver?
