SECTION III - Q.3: Solve any two of the following (12 Marks)

  1. Q15 ABC is famous celebrity with 100 million followers across social media. One day while scrolling through his feed he finds a small brand PQR using his Photos and Videos without consent to sell their products. (i) What remedy is available to ABC against the brand PQR? (ii) Discuss defenses are available to brand PQR.
  2. Q16 Dr. ABC was touring interiors of Maharashtra where he discovered a new herb with healing properties. He brought the herb back and applied for a patent. (i) Will Dr. ABC be granted a Patent? (ii) What are pre-requisites for grant of patent in India?
  3. Q17 DEF is a famous painter and has showcased her work in multiple exhibitions over the years. Recently a Publisher ABC approached her to use one of her works as a cover page of a book to which she agreed. Later on, once the book got published on the cover the painting seems to be distorted and altered. (i) What remedy does DEF have against the publishing house? (ii) Discuss moral rights available DEF to in context of above facts.
  4. Q18 A startup named Light Wave launches a line of smart home lighting products under the brand name "Luna Glow". Three months later, a larger company Bright Shine, introduces a competing product line called "Luna Glooo" with similar styling and color scheme in its logo. (i) Can Light Wave stop Bright Shine from using the logo "Luna Glooo"? (ii) Discuss the remedies available to Light Wave.

  4. Q22 Explain in brief the pre-grant and post-grant opposition of Patent as per the Patent Act, 1970.
