SECTION III - Q.3: Answer any 2 (two) of the following situational problems, along with relevant case laws (12 Marks - 6 marks each)

1. Q15 A declaration for acquisition of land has been uploaded on the website of the Government on 2nd April, 2019 and published in all the other prescribed modes, including by publication in 2 (two) newspapers, as well as in the Official Gazette and in the Municipal Corporation, on 7th April, 2019. (i) Within how much time from the date of publication of the declaration shall the award for acquisition of the land have to be made? In the event of delay, what would be the consequences? (ii) Who is responsible for passing the award? (iii) What are the contents of an award?
2. Q16 Veer and Taimur have executed an exchange deed, whereby Veer is selling his flat on the second floor in exchange for Taimur's flat situated on the seventh floor. (i) Does the exchange deed have to be registered? (ii) Who is liable for payment of the stamp duty on the said exchange deed, and to what extent?
3. Q17 Mukesh is the owner of a plot of land situated in Kandivali. Mukesh had obtained permission for constructing a building with a ground floor and two additional floors on the said plot of land. Mukesh, however, constructed a ground floor and three additional floors. After 18 months of completion of the construction, Mukesh received a written notice under the provisions of the Maharashtra Regional and Town Planning Act, 1966, for removal of the third floor. (i) What are the options available to Mukesh upon receipt of the said notice? (ii) Name the authority who is entitled to send such a notice.
4. Q18 Kavi purchased stamp paper worth Rs. 48,00,000/- (Rupees Forty eight lakhs only) on 20th May, 2024, for execution of the proposed Sale Deed pertaining to a shop in Andheri. The negotiations, however, were scheduled to conclude by 15th December, 2024. (i) Would the said stamp paper issued on 20th May, 2024 be valid for execution of the Sale Deed on 15th December, 2024? Explain with reasons. (ii) If not, what is the option available to Kavi under the Maharashtra Stamp Act, 1958?
