SECTION III - Q.3: Answer any 2 (two) of the following situational problems, along with relevant case laws (12 Marks - 6 marks each)

  1. Q15 Ayush and Piyush have executed an exchange deed, whereby Ayush is selling his flat on the fourth floor to Piyush in exchange for a flat situated on the seventh floor, belonging to Piyush. (i) Who is liable for payment of the stamp duty on the said exchange deed, and to what extent? (ii) Is such an exchange deed to be registered?
  2. Q16 A declaration for acquisition of land was published in all the other prescribed modes, including by publication in 2 (two) newspapers, as well as in the Official Gazette and in the Municipal Corporation, and was also uploaded on the website of the Government, on 24th January, 2018. (i) Who is responsible for making the award? (ii) Within how much time from the date of publication of the declaration shall the award for acquisition of the land have to be made? In the event of delay, what would be the consequences? (iii) What are the contents of an award?
  3. Q17 Bhola entered into negotiations for purchase of a godown in Kandivali on 15th January, 2017. Pursuant thereto, on 1st February, 2017, whilst the negotiations were going on, Bhola purchased stamp paper worth Rs. 5,00,000/- (Rupees Five lakhs only) for execution of the proposed Sale Deed. The negotiations continued and had not concluded even up to 25th July, 2017. (i) In the present case, would Bhola be able to use the stamp paper issued on 15th January, 2017 to execute the Sale Deed? Explain with reasons. (ii) If the negotiations had concluded on 25th July, 2017, would Bhola be able to use the stamp paper issued on 15th January, 2017 to execute the Sale Deed? (iii) If not, what are the options available to Bhola under the Maharashtra Stamp Act, 1958?
  4. Q18 During the Ganpati festival, Kundu obtained permission and set up a food stall on Chowpatty beach. The permission was valid up to Anant Chaturdashi, i.e. the last day of Ganpati visarjan. Kundu, however, did not remove the stall even after the Ganpati visarjan. The existence of the said stall was causing a lot of harassment to the persons who came to Chowpatty beach for their regular morning walks, and they decided to file a complaint. (i) Please advise them on who is the appropriate authority entitled to remove such an encroachment. (ii) Explain in detail the option available to Kundu, in case he decides to retain the stall on Chowpatty beach.

SECTION IV - Q.4: Write explanatory answers to any 2 (two) of the following (24 Marks - 12 marks each)

  1. Q19 Explain the procedure for acquiring land under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
  2. Q20 Explain in detail the provisions pertaining to "Fixation of Standard Rent and Permitted Increases" under the Maharashtra Rent Control Act, 1999.
  3. Q21 Critically analyze the activities permitted in each of the Coastal Regulation Zones.
  4. Q22 Discuss in detail the documents which are compulsory to be registered and the documents which are optional to be registered.
