SECTION I - Q.1: Answer each of the following questions in 2 (two) or 3 (three) sentences (20 Marks - 2 marks each)

2. Q2 Explain the meaning of "Planning Authority" under the Maharashtra Regional and Town Planning Act, 1966.

5. Q5 Who is a "landless person" under the Maharashtra Agricultural Lands (Ceiling on Holdings) Act, 1961?

SECTION II - Q.2: Write short notes on any 4 (four) of the following (20 Marks - 5 marks each)

1. Q11 Award under the Land Acquisition Act.
2. Q12 Nistar Patrak.
3. Q13 Sections 50 and 51 under the Maharashtra Land Revenue Code.
4. Q14 Wajib-ul-arz.
5. Q15 Admissibility of instruments which are not properly stamped under the Bombay Stamp Act.
6. Q16 Describe the documents compulsory to be registered under the Registration Act, 1908.

SECTION III - Q.3: Solve any 2 (two) of the following, with reasons (12 Marks - 6 marks each)

1. Q17 Ram, Rahim and Albert have executed an instrument of partition of a jointly held property, whereby the said property is partitioned in such a manner that Ram shall get 30% of the said property, Rahim shall get 35% of the said property and Albert shall get the remaining 35% of the property. (i) Is such an instrument of partition to be registered? (ii) Who is liable for payment of the stamp duty on the said instrument of partition?
2. Q18 Ali received a sum of Rs. 15,000/- (Rupees fifteen thousand only) as payment for the pipes supplied by Ali to Swami. Swami requests Ali to acknowledge the receipt of the said amount. Ali confirms that he has received the said amount by writing the same on a plain piece of paper and signing below. Swami refuses to accept the said paper on the ground that the same is not valid, and calls upon Ali to execute the receipt on stamp paper. (i) Is Swami entitled to ask for the receipt on stamp paper? (ii) Is Ali required to pay any stamp duty? If yes, what kind of stamp is to be used?
3. Q19 Amar, a non-agriculturist, wants to purchase an agricultural plot of land situated at Panchgani from Antony, for setting up a tourist resort. (i) Is Amar permitted to purchase the said land for setting up the tourist resort? Why? (ii) Advise Amar on the procedure to be followed for setting up the tourist resort.

SECTION IV - Q.4: Answer the following, any four (48 Marks - 12 marks each)

1. Q20 Describe the parameters to be considered while determining compensation for acquisition of land under the Land Acquisition Act.
2. Q21 Explain in detail the legal provisions pertaining to "Unauthorized development" under the Maharashtra Regional and Town Planning Act, 1966.
3. Q22 Describe the different activities permitted and restricted in the various Coastal Regulation Zones.
4. Q23 Explain in detail the provisions pertaining to structural repairs under the Maharashtra Housing and Area Development Act, 1976.
5. Q24 Describe in detail the procedure of adjudication and the legal provisions pertaining to instruments not duly stamped under the Maharashtra Stamp Act, 1958.
6. Q25 Discuss the restrictions on sale of agricultural land described under the Bombay Tenancy and Agricultural Lands Act, 1948.
