SECTION III - Q.3: Answer any 2 (two) of the following situational problems, along with relevant case laws (12 Marks - 6 marks each)

1. Q15 Amar, Akbar and Anthony have executed an instrument of partition of a jointly held property, whereby the said property is partitioned in such a manner that Amar shall get 50% of the said property, Akbar shall get 25% of the said property and Anthony shall get the remaining 25% of the property. (i) Is such an instrument of partition to be registered? (ii) Who is liable for payment of the stamp duty on the said instrument of partition, and to what extent?
2. Q16 Taufeeq enters into an Agreement for Sale with Sohel for sale of a flat in Mankhurd, and vide the said Agreement for Sale, Taufeeq conveys the flat to Sohel. The stamp duty on the said Agreement for Sale has been calculated and paid as that on a conveyance. The Agreement for Sale, however, contains language to state that later on the parties shall execute a Sale Deed. (i) Is such an Agreement for Sale required to be registered? (ii) If the Sale Deed is actually executed at a later date, would stamp duty have to be paid on the said Sale Deed? If yes, how would such stamp duty be calculated?
3. Q17 A declaration for acquisition of land, along with a summary of the Rehabilitation and Resettlement Scheme, has been published in the Official Gazette on 2nd July, 2021. The said declaration has been published in 2 (two) newspapers and in the Municipal Corporation on 4th July, 2021. Further, the said declaration has been uploaded on the website of the Government and pasted at convenient places in the locality on 7th July, 2021. (i) Within how much time from the date of the preliminary notification shall the declaration have to be made? In the event of delay, what would be the consequences? (ii) Who is responsible for publication of the summary of the Rehabilitation and Resettlement Scheme? (iii) What are the contents to be included in such a declaration?
4. Q18 Salman is desirous of demolishing his old bungalow and constructing a new building in place of his old bungalow, in Lonavala. (i) Would Salman require any permission for demolition of the old bungalow? (ii) Briefly explain the procedure for obtaining the permission for constructing the new building. (iii) How long would the permission for constructing the new building remain valid?
