SECTION III - Q.3: Solve the following situational problems, along with the relevant laws, any two (12 Marks - 6 marks each)

1. Q15 Under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, with reference to acquisition of land, answer the following questions: (a) What are the provisions in case of food security? (b) What are the urgent situations in which land can be acquired without the regular procedure?
2. Q16 After Diwali, the food stalls which were temporarily set up on the beach for the festival have been still operating without legal permits or licenses on that land. The residents in the surrounding area are disturbed by this problem of encroachment. (a) Advise them about whom they should approach regarding the encroachments. (b) Can these encroachments be removed or regularised? If yes, how?
3. Q17 Mr. Suresh Sharma holds an agricultural holding of 250 acres which he used for agricultural activity. Now he wants to use 125 acres of this holding to start a cottage industry. (a) Can Suresh Sharma convert half of his land to another purpose? Advise him. (b) What are the payment procedures for conversion of land?
4. Q18 Mrs. Seema Gupta owns 100 acres of immovable property, shares in a publicly listed company and some jewellery. Mrs. Gupta wants to gift her daughter Priya 50 acres of immovable property and lease the remaining land. Advise her as per the provisions of the Registration Act. (a) Is it necessary to register the gift of land to Priya? If so, why? (b) What are the provisions regarding registration of a lease of immovable property?
