SECTION III - Q.3: Answer any two Situation Based questions (12 Marks - 6 marks each)

1. Q13 A holds a lease from B, terminable on 6 months' notice. C, an unauthorized person, gives notice of termination to A. (i) Can this notice by C be ratified by B? (ii) What are the essentials of a valid ratification?
2. Q14 X, a Bank, had given an overdraft facility to a partnership firm and its partners, against the firm's Fixed deposits. The partners and the firm made a default in repayment of that loan in spite of notices given by the bank. (i) Can the Bank exercise lien over the fixed deposits of partnership firm? (ii) Presuming that the firm has two separate accounts in the same Bank, one is current account. Can the Bank utilize the balance in the current account for satisfaction of the overdraft facility? Give reasons.
3. Q15 A finds a lost high pedigree dog on the road and spends money to look after that dog. Later when the owner approaches A and takes away that dog, he refuses to reimburse the expenses incurred by A on that dog. (i) What are the rights of A, the finder? (ii) Which legal principle applies here? Give your reasons.

1. Q16 Explain the various modes of 'Termination of Agency'.
2. Q17 Who is an 'Unpaid Seller'? Discuss the rights and duties of an 'Unpaid seller'.
3. Q18 What are the rights and liabilities of a minor when admitted to the benefits of a Partnership firm?
4. Q19 Define a pledge. State the rule and exception if any, to the rule "no one can make a valid pledge who is not the owner of goods".
