SECTION III - Q.3: Answer Any Two of the following (12 Marks - 6 marks each)

1. Q13 By means of an amendment to the Constitution, the parliament converted the position of the Indian President from elective to a hereditary position. (i) Examine the validity of such amendment. (ii) Briefly describe the Doctrine of Basic Structure.
2. Q14 Mr. B was the Chief Minister (CM) of a State (BCD) in India. Some of his party members defected due to which there was a question mark on his majority support in the House. The CM proposed a 'floor test' to test his strength in Assembly Session. But the Governor of the State (BCD) ignored the suggestion of the CM and Article 356 of the Constitution of India was proclaimed in the State (BCD) by the Governor. The CM challenged the constitutional validity of this provision in the Supreme Court of India. SC held the proclamation to be unconstitutional. (i) What is Article 356 of the Constitution of India? When it can be proclaimed? (ii) Name the famous landmark case law on the above-mentioned facts.
3. Q15 Mr. Aman, a resident of India, wants to contest an election for the post of the President of India. He is 32 years of age. (i) Is Mr. Aman eligible to contest the election for the post of President of India? What are the qualifications required to be eligible for election as the President? (ii) Describe in brief the position of the President of India.
4. Q16 Some of the Members of Parliament received bribes to vote against the motion of no-confidence against the Prime Minister, Mr. Y. Few of them voted against the no confidence motion, while others chose not to vote. Corruption charges were brought against them for accepting the bribe and they were disqualified from continuing as a Member of Parliament. Based on these facts, answer the following questions. (i) Do the Member of Parliament have immunity against criminal proceedings? (ii) Can they be disqualified as a member of parliament? Discuss in light of judgements of the Supreme Court.
