SECTION III - Q.3: Answer any two of the following (12 Marks)

  1. Q15 Country A and Country B signed a treaty in 1980 to establish their border along a river. Over time, the river changed its course due to natural erosion, causing the border to shift. Country A insists on the original border based on the 1980 treaty, while Country B argues for the current river course as the new border. (i) Name the Convention according to which the treaty has been entered into. (ii) How and where can a treaty be registered?
  2. Q16 Country X and Country Y are neighboring countries with a shared border. An Aircraft registered in Country Y enters the airspace of Country X without prior permission. Country Y detects the unauthorized overflight and demands an explanation from Country X. Country Y claims it was a navigation error and requests leniency, but Country X insists that international law has been violated. (i) What is sovereignty of Airspace? (ii) Mention the name of the Convention with respect to Air Space sovereignty. (iii) What is the meaning of the term 'Right of innocent passage'?

Q17 The Pequette Habana Fishing boat and another fishing boat Lola flying the Spanish flag and belonging to Spanish subjects were captured by a United States Warship in the Blockade of the North Coast of Cuba. They were brought before the Court of condemnation. (i) Whether under customary international law, fishing boats were exempted from capture? Give reasons. (ii) State the name of the Landmark case.
  4. Q18 Many states of the world are land-locked states. These states have no access to the sea for carrying out commercial activities. (i) Which UN convention grants rights to land-locked states? (ii) What are the rights of land-locked states?
