The answers in this volume state the law as it stands today, and in this subject that matters more than usual. Both Codes were passed in 2020 and came into force only on 21 November 2025, which is after the November 2024 paper was sat and nineteen days before the December 2025 paper. Between them they repealed twenty-two Acts, among them the Employee's Compensation Act 1923, the ESI Act 1948, the EPF Act 1952, the Maternity Benefit Act 1961, the Payment of Gratuity Act 1972 and the Factories Act 1948, so notes printed before 2026 teach repealed statutes. The Central Rules under both Codes came into force on 8 May 2026. Two things are still not notified: the rate of an aggregator's contribution for gig and platform workers under section 114(4), and the date from which it is payable under section 114(5). Where an answer turns on a provision that has since changed, it gives both positions and says which is which.

(a)What is the main objective of the Code on Social Security, 2020?[2]

Answer

The main object of the Code on Social Security, 2020 is to amend and consolidate the laws relating to social security. The goal is to extend social security to all employees and workers. That includes those in the organised sector, in the unorganised sector and in any other sector. The Code does this by merging nine central Acts into one law. It also brings unorganised workers, gig workers and platform workers into the system for the first time.

Those words are not invented. They are the Code's own long title. They are repeated in paragraph 5(i) of the Statement of Objects and Reasons attached to the Bill.

What "social security" means in the Code. Section 2(78) defines it as the measures of protection given to employees, unorganised workers, gig workers and platform workers. The protection has two aims: access to health care and income security. The section then names the risks the law is worried about. They are old age, unemployment, sickness, invalidity, work injury, maternity and loss of a breadwinner. So the object is not charity. It is income protection against named risks.

The nine Acts it replaced. Section 164(1) repeals the Employee's Compensation Act 1923, the ESI Act 1948 and the EPF Act 1952. It also repeals the Employment Exchanges Act 1959, the Maternity Benefit Act 1961 and the Payment of Gratuity Act 1972. Two more are the Cine-Workers Welfare Fund Act 1981 and the Building and Other Construction Workers' Welfare Cess Act 1996. The ninth is the Unorganised Workers' Social Security Act 2008. The Code came into force on 21 November 2025.

How courts read such a law. In Municipal Corporation of Delhi v. Female Workers (Muster Roll), (2000) 3 SCC 224, women on the daily wage muster roll were refused maternity leave. The reason given was that they were not regular employees. The Supreme Court held that the benefit follows the work, not the label on the appointment. A social security statute is read to widen cover, never to narrow it.
