About this subject

This paper is two Codes examined together, and it is worth knowing which half a question belongs to before you start writing. The Code on Social Security, 2020 carries provident fund, employees' state insurance, gratuity, maternity benefit, employees' compensation, the building workers' cess and the new cover for gig and platform workers. The Occupational Safety, Health and Working Conditions Code, 2020 carries the duties of employers and employees, safety and health, hours and leave, the employment of women, contract labour, inter-State migrant workers, plantations, beedi and cigar work and the penalties. Of the sixty five questions in this folder, twenty five name the Code on Social Security, twenty four name the OSH Code, and sixteen name neither, which are mostly the two-mark definitions and the problems.

The shape is the same in all three papers and it never varies: seventy five marks in two and a half hours, split twelve, twelve, twelve and thirty nine. Section I is two-mark questions, eight of them in November 2024 and December 2025 and ten in April 2026, of which any six are to be answered. Section II is short notes, any two of four at six marks. Section III is problems, any two of four at six marks, and every one of them has two numbered sub-parts. Section IV is essays, any three of five at thirteen marks. Twenty six of the sixty five questions are two-mark questions, twenty four are six-mark and fifteen are thirteen-mark. Only the December 2025 and April 2026 papers print the marks; the November 2024 paper prints none at all, and the split used in these answers is taken from the other two papers of the same code.

Eight topics are set in every one of the three papers, and between them they cover most of the paper. They are the employment of women, employees' compensation, gratuity, maternity benefit, gig and platform work, disablement, the building and construction workers' cess and contract labour. The employment of women under the OSH Code is the most reliable question in the subject: it is a thirteen-mark essay in all three papers, and the three stems differ only in the direction to explain it, to examine it or to analyse it critically. Employees' compensation is a thirteen-mark essay in December 2025 and April 2026 and a thirteen-mark question on the procedure for determining and distributing it in November 2024. Gratuity is asked five times across the three papers, at two marks, at six, at thirteen and twice as a problem.

The two-mark section rewards one thing above all: reading section 2 of both Codes. Every one of the eight questions in Section I of the December 2025 paper is a bare definition, and each names the Code it comes from, which is the examiner telling you where to look. The commonest trap in the subject lives here. "Factory" is defined in both Codes and the numbers are not the same: section 2(32) of the Code on Social Security counts ten employees with power and twenty without, while section 2(1)(w) of the OSH Code counts twenty workers with power and forty without. The Social Security Code excludes a mine from the word and the OSH Code does not, because it regulates mines itself. A candidate who learns one pair of numbers and uses it throughout will answer half the paper wrongly.

The problems in Section III are short, factual and set in the same handful of shapes: a worker claiming gratuity, a woman claiming maternity benefit, an injury at work, a gig worker hurt on the road, a plantation worker and a construction site employing migrants. Three of the twelve are worth reading before the examination because the obvious answer is the wrong one. The contractor's fee question in April 2026 asks for the maximum a contractor may charge a worker, and the answer is that section 49 of the OSH Code allows none at all. The cashew plantation question asks about a creche at thirty five employees, and every creche provision in the two Codes begins at fifty, quite apart from the fact that cashew is not one of the five crops the OSH Code names. And the compensation problem in December 2025 puts the accident on 1 June 2025, five months before the Code it names came into force.

Finally, the dates, because this is a subject where the law moved under the candidates. Both Codes were passed in 2020 and sat un-commenced for five years. They came into force on 21 November 2025. The November 2024 paper was therefore sat a year before the Codes were law, and the December 2025 paper nineteen days after. The answers here are written on the Codes as they now stand, and they say where the position was different when the paper was set. The three papers are LL.B. three-year prints, and they are the same three papers on the B.L.S. five-year page: students of the current B.L.S. scheme reach the ninth semester in 2026-27, so no B.L.S. print of this subject exists yet.
