International Financing and the Duty to Support

In one line

MU's 2026 Q4 asks how international financing policies align with States' obligations under international law, and the answer is four treaty obligations, five funds, and three ways the alignment fails.

In exam wording: the obligation to provide financial support is stated in article 9 of the Paris Agreement, under which developed country Parties shall provide financial resources to assist developing country Parties with both mitigation and adaptation in continuation of their existing obligations under the Convention, and in article 11 of the Framework Convention on Climate Change, which defines the financial mechanism and makes it accountable to the Conference of the Parties; articles 10 and 11 of the Paris Agreement provide correspondingly for technology development and transfer and for capacity building.

Article 9 of the Paris Agreement, clause by clause

Paragraph 1. Developed country Parties shall provide financial resources to assist developing country Parties with respect to both mitigation and adaptation in continuation of their existing obligations under the Convention.

Paragraph 2. Other Parties are encouraged to provide or continue to provide such support voluntarily.

Read the two together and the differentiation is exact: an obligation on one group, an encouragement to everyone else. That is how Paris kept differentiation without annexes.

Paragraph 3. As part of a global effort, developed country Parties should continue to take the lead in mobilising climate finance from a wide variety of sources, instruments and channels, noting the significant role of public funds, and such mobilisation should represent a progression beyond previous efforts.

Paragraph 4. The provision of scaled-up financial resources should aim to achieve a balance between adaptation and mitigation, taking into account country-driven strategies and the priorities and needs of developing country Parties, especially those particularly vulnerable, including the least developed countries and small island developing States, considering the need for public and grant-based resources for adaptation.

Paragraph 5. Developed country Parties shall biennially communicate indicative quantitative and qualitative information on projected levels of public financial resources to be provided.

Paragraph 6. The global stocktake shall take into account the relevant information provided.

Paragraph 7. Developed country Parties shall biennially provide transparent and consistent information on support for developing country Parties provided and mobilised through public interventions.

Paragraph 8. The financial mechanism of the Convention, including its operating entities, shall serve as the financial mechanism of the Agreement.

Notice what is binding and what is not. Providing resources, and reporting them, are obligations. Any particular amount is not.

Articles 10 and 11: technology and capacity

Article 10, paragraph 1: Parties share a long-term vision on the importance of fully realising technology development and transfer in order to improve resilience to climate change and to reduce greenhouse gas emissions.

Paragraph 2: Parties, noting the importance of technology for the implementation of mitigation and adaptation actions and recognising existing technology deployment and dissemination efforts, shall strengthen cooperative action on technology development and transfer.
