The law in these answers is stated as at September 2026, and five changes date every textbook on this subject. Criminal law is stated under the Bharatiya Nyaya Sanhita and electronic evidence under the Bharatiya Sakshya Adhiniyam, both in force since 1 July 2024, with the old Penal Code and Evidence Act sections given alongside wherever a question or a decided case uses them. Section 66A was omitted with effect from 30 November 2023, the day on which sections 72 and 72A became civil penalties. The Cyber Appellate Tribunal ceased to exist on 26 May 2017, and questions on it are answered on the Telecom Disputes Settlement and Appellate Tribunal. Intermediaries are answered on the 2021 Rules as amended to 20 February 2026. And section 43A is treated as live law until the Digital Personal Data Protection Act, 2023 omits it on 13 May 2027.

For full marks, cover: three parts. (1) MEANING of information technology: a definition by function (capture, process, store, transmit, present) and the convergence of computing and telecommunication, noting that the Information Technology Act, 2000 does not define the expression but defines its building blocks. (2) BENEFITS, organised by who gains (citizen, State, business, courts, the economy), with a balancing line on the risks the Act exists to manage. (3) The two DEFINITIONS asked, computer network in section 2(1)(j) and computer system in section 2(1)(l): quote each, break it into elements, give examples, show how they differ from "computer" and "computer resource", and show where the Act uses them. Cite Syed Asifuddin, Anvar P.V., Swapnil Tripathi and Tata Consultancy Services.
Information technology is the use of computers and communication networks to capture, store, process, retrieve, transmit and present information. Its defining feature is digitisation: text, sound, images and numbers are all reduced to binary data that machines can process at high speed and send anywhere at almost no cost. Its second feature is convergence: computing, telecommunications and broadcasting now run on the same networks and devices, so a phone is at once a computer, a camera, a bank branch and a newspaper.
The components are four. Hardware (processors, memory, storage, input and output devices), software (operating systems and applications), data (the raw material), and networks (the links, from office local area networks to the internet). The Act defines each: "computer" (section 2(1)(i)), "computer system" (section 2(1)(l)), "computer network" (section 2(1)(j)), "computer resource" (section 2(1)(k)), "data" (section 2(1)(o)) and "information" (section 2(1)(v)). It never defines "information technology" itself, and it does not need to, because its provisions attach consequences to these components rather than to the field as a whole.
For the citizen. Services that required repeated visits to offices can be obtained online: certificates through DigiLocker, welfare through direct benefit transfer, payments through the Unified Payments Interface. Section 6 of the Act makes electronic filing, issue of licences and payment lawful, and section 4 gives electronic records the status of writing.
For the State. Electronic governance lowers costs, reduces discretion and leakage, and leaves an audit trail that makes corruption harder. Records can be retained electronically under section 7 and audited under section 7A, and rules can be published in the Electronic Gazette under section 8.
For business and the economy. Electronic commerce, electronic contracts (valid under section 10A), digital signatures and online markets reduce transaction costs and open national and international markets to small enterprises. India's software and services industry, a major source of exports and employment, rests on it; in Tata Consultancy Services v. State of Andhra Pradesh, (2005) 1 SCC 308, the Supreme Court held that canned software on a medium is "goods", which recognised software as a tradeable commodity in Indian commercial law.
For the justice system. Case information, electronic filing, virtual hearings and electronic evidence speed up litigation. In Swapnil Tripathi v. Supreme Court of India, (2018) 10 SCC 639, the Supreme Court accepted live-streaming of constitutionally important hearings as an extension of open justice, and in Anvar P.V. v. P.K. Basheer, (2014) 10 SCC 473, it settled how electronic records such as recorded speeches are proved, making digital evidence usable with safeguards.
For education, health and information. Online learning, telemedicine, access to research and news, and new forms of civic participation all depend on it.
The balance. The same technology enables fraud, identity theft, attacks on critical infrastructure and mass surveillance, and it can exclude those without devices, connectivity or skills. The Information Technology Act is as much about managing these risks (Chapters IX and XI, sections 69 to 70B, section 79) as about enabling the benefits.
Liability under the Act depends on which kind of machine is involved. Section 43 (compensation for unauthorised access, downloading, viruses, damage and disruption) protects "a computer, computer system or computer network"; section 75 extends the Act to conduct abroad only if it involves "a computer, computer system or computer network located in India"; section 66F and sections 69 to 70 speak of the wider "computer resource". So the definitions of computer network and computer system decide whether a provision applies at all.
The definition, as substituted by the Information Technology (Amendment) Act, 2008: "computer network" means the inter-connection of one or more computers or computer systems or communication device through (i) the use of satellite, microwave, terrestrial line, wire, wireless or other communication media; and (ii) terminals or a complex consisting of two or more interconnected computers or communication device whether or not the inter-connection is continuously maintained.
Its elements.
Examples. The internet; a bank's network linking branches, ATMs and the data centre; an office local area network; a home Wi-Fi joining phones, laptops and a smart television; the network of card terminals connected to a payment processor.
The definition: "computer system" means a device or collection of devices, including input and output support devices and excluding calculators which are not programmable and capable of being used in conjunction with external files, which contain computer programmes, electronic instructions, input data and output data, that performs logic, arithmetic, data storage and retrieval, communication control and other functions.
Its elements.
Examples. A bank's core banking installation; an ATM with its software and card reader; a hospital's patient records server with its terminals; a point-of-sale terminal; the engine control system of a vehicle; the control system of a power plant.

The courts read these definitions by function. In Syed Asifuddin v. State of Andhra Pradesh, 2005 CriLJ 4314, employees of a mobile operator reprogrammed handsets locked to a competitor's network by altering their electronic serial numbers. The Andhra Pradesh High Court held that a cell phone is a computer under section 2(1)(i), because it performs the functions the definition describes, and that the handset's identifying numbers are computer source code under section 65. It follows that a handset connected to an operator's network is equally part of a computer network under section 2(1)(j). The approach shows that the definitions are not tied to desktop machines but to what a device does.
1. A card skimmer fitted to an ATM. The ATM, with its card reader, keypad, screen and programmed software, is a computer system; the bank's link from the ATM to its switch and data centre is a computer network. A criminal who fits a skimmer and copies card data has downloaded data from a computer system without permission under section 43(b), which becomes the offence in section 66 when done dishonestly, and his later use of the stolen card details is identity theft under section 66C.
2. An attack from abroad on a server in Mumbai. A hacker in another country breaks into a company's server located in Mumbai. The server is a computer and part of the company's computer network, both located in India, so section 75 extends the Act to him irrespective of nationality. Had the stolen data been held only on servers abroad, with no computer, computer system or computer network in India involved, section 75 would not apply, because it does not use the wider term "computer resource".
3. Smart devices recruited into a botnet. Malware infects thousands of home cameras and routers, which connect intermittently to the internet, and uses them to flood a bank's website. The cameras are computers and communication devices, their links form a computer network "whether or not the inter-connection is continuously maintained", and the attack is introduction of a contaminant, disruption and denial of access under section 43(c), (e) and (f).
A critical note. The definitions were drafted in 2000 and patched in 2008, and they overlap heavily: almost every modern device is at once a computer, part of a computer system and part of a computer network. That overlap is harmless for most provisions, which name all three together, but it matters where a provision names only some of them, as section 75 does, and courts have therefore read the definitions by what a device does rather than by what it is called.
Conclusion. Information technology is the use of computers and networks to capture, process, store and transmit information in digital form, a field the Information Technology Act, 2000 regulates through definitions of its components rather than of the field itself. Its benefits reach citizens (online services and payments), the State (efficient, transparent governance), business (electronic commerce and contracts, and an export industry whose software Tata Consultancy Services treated as goods) and the courts (electronic filing and evidence, as Anvar P.V. and Swapnil Tripathi show), alongside risks the Act exists to manage. A computer network under section 2(1)(j) is the inter-connection of computers, computer systems or communication devices by any medium, whether or not continuously maintained; a computer system under section 2(1)(l) is a programmed device or collection of devices, with its input and output support devices, containing programmes and data and performing logic, storage, retrieval and communication control, but excluding non-programmable calculators. Read functionally, as Syed Asifuddin reads them, the two definitions bring phones, ATMs, servers and the internet itself within sections 43, 66 and 75 of the Act.
