The Paper as Set

Duration 2 hours  ·  Total marks 60  ·  22 questions answered

Instructions printed on the paper

  • N.B: 1. Please check if you have received the correct Question Paper; 2. Answer all Questions as per the instructions given; 3. Do not reveal your identity or put any signs, markings, inscriptions anywhere on your answer sheets.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)What is Cargo and Hull insurance?[2]

Answer

Meaning. Hull insurance and cargo insurance are the two main branches of marine insurance. They insure two different interests in the same voyage.

Hull insurance. It insures the vessel itself, with her machinery and equipment.

  1. The shipowner takes it. A mortgagee may insure to the extent of his interest.
  2. It is usually a time policy, and section 27(2) of the Marine Insurance Act, 1963 limits a time policy to twelve months.
  3. A time policy carries no implied warranty of seaworthiness. But knowingly sending the ship to sea unseaworthy bars recovery for loss caused by it (section 41(5)).

Cargo insurance. It insures the goods carried on the ship.

  1. The owner of the goods takes it, or the buyer or seller who bears the risk of transit.
  2. It is usually a voyage policy or an open cover, running warehouse to warehouse.
munotes.in 2
  1. In a voyage policy on goods, the ship must be seaworthy and also fit to carry the goods (section 42(2)). There is no warranty that the goods themselves are seaworthy (section 42(1)).
  2. It is commonly written on the Institute Cargo Clauses (A), (B) or (C).

Conclusion. Hull insurance protects the shipowner's vessel, usually for a period. Cargo insurance protects the goods owner's goods, usually for a voyage.
