How to use this volume
Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.
Q.1: Answer in a sentence or two, any six
12 Marks - 2 marks each
Answer
The ceiling area is the maximum area of agricultural land that a person or a family unit may hold. It is fixed under the Maharashtra Agricultural Lands (Ceiling on Holdings) Act, 1961. Land held above it is surplus land (section 3).
How it is fixed (section 5). The First Schedule fixes a separate ceiling for each class of land in each district or taluka. The better the irrigation, the smaller the ceiling.
A mixed holding is converted into dry crop land in the ratio of these ceilings (section 5(3)).
Who it applies to. It applies to a family unit as a whole. That unit is a person, the spouse and their minor sons and minor unmarried daughters (section 4). A unit of more than five members gets one-fifth more for each extra member, up to twice the ceiling (section 6). Exempted land does not count, and may be held to any extent (section 3(1), Explanation).
From when. The lowered ceilings apply from the commencement date, 2 October 1975 (section 2(6A)).
Validity. In Dattatraya Govind Mahajan v. State of Maharashtra (1977) 2 SCC 548 the 1975 amendments that lowered the ceiling and introduced the family unit were challenged. The Supreme Court upheld the family unit and its ceiling. It held that they did not offend the second proviso to Article 31A(1).
