The Paper as Set

The questions in this volume are the questions asked at the May 2025 - 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  21 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1.What is meant by constitutionalism?[2]

Answer

Constitutionalism is the idea that the powers of government must be limited by a higher law. These limits must be real and enforceable in a court. It means a limited government, not just a written document.

A constitution and constitutionalism are different. A country may have a written constitution and still not have constitutionalism, if the rulers ignore its limits. Constitutionalism is present only when the limits actually work.

Its main elements.

  1. Government under law, so that every power must come from the Constitution or a valid law.
  2. Limited government, with fundamental rights that the State cannot take away.
  3. Separation of powers between the legislature, the executive and the judiciary.
  4. Judicial review by an independent judiciary to strike down unconstitutional acts.
munotes.in 2

In India. Part III gives fundamental rights, and article 13 makes laws inconsistent with them void. Articles 32 and 226 give remedies in the courts. Article 50 separates the judiciary from the executive.

Case law. In Indira Nehru Gandhi v. Raj Narain, AIR 1975 SC 2299, the Court struck down article 329A(4), which had validated an election by taking it outside all law. That is constitutionalism at work. The Emergency of 1975 to 1977 is the warning on the other side: the text remained, but its limits stopped working.
