The Paper as Set

The questions in this volume are the questions asked at the Oct 2024 - 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  21 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1.State various Equality Rights given under Indian Constitution.[2]

Answer

The right to equality is set out in articles 14 to 18 of the Constitution. They are often called the equality code.

  1. Article 14: equality before the law and equal protection of the laws. The State shall not deny to any person equality before the law or the equal protection of the laws within India. Equals must be treated equally. Reasonable classification is allowed.
  2. Article 15: prohibition of discrimination. The State shall not discriminate against any citizen on grounds only of religion, race, caste, sex or place of birth. Special provisions for women, children and backward classes are allowed by clauses (3) to (6).
  3. Article 16: equality of opportunity in public employment. All citizens have equal opportunity in appointment to offices under the State. Reservation for backward classes is allowed by clause (4).

  1. Article 17: abolition of untouchability. Untouchability is abolished and its practice in any form is forbidden and made an offence.
  2. Article 18: abolition of titles. The State shall not confer titles, except military or academic distinctions. Citizens cannot accept titles from a foreign State.

The core idea. Equality does not mean identical treatment of all. It means treating likes alike and allowing special help for those who are unequal.

Case law. In E.P. Royappa v. State of Tamil Nadu, AIR 1974 SC 555, the Court held that equality is opposed to arbitrariness. An arbitrary act is therefore unequal and violates article 14.
