The Paper as Set

The questions in this volume are the questions asked at the Dec 2018 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

munotes.in 1

1.What are the provisions relating to Citizenship under Indian Constitution ?[2]

Answer

The provisions on citizenship are in Part II of the Constitution, articles 5 to 11. They decided who was a citizen of India on 26 January 1950. They left the rest to Parliament.

  1. Article 5, citizenship by domicile. A person domiciled in India at the commencement was a citizen in three cases. He was born in India, or either parent was born here, or he had lived here for at least five years.
  2. Article 6, migrants from Pakistan. A person who migrated before 19 July 1948 became a citizen if he had lived here since. One who migrated later had to register.
  3. Article 7, migrants to Pakistan. A person who migrated to Pakistan after 1 March 1947 was not a citizen. The exception was one who returned under a permit for resettlement.
  4. Article 8, persons of Indian origin abroad. They could become citizens by registering with India's diplomatic representative.
  5. Article 9. A person who voluntarily acquired the citizenship of a foreign State was not a citizen.
munotes.in 2
  1. Article 10. Every citizen continues to be one, subject to any law made by Parliament.
  2. Article 11. Parliament has power to make any law on the acquisition and termination of citizenship.

The law made under article 11. The Citizenship Act, 1955. It provides for citizenship by birth, descent, registration, naturalisation and incorporation of territory.

Case law. In State of Arunachal Pradesh v. Khudiram Chakma, 1994 Supp (1) SCC 615, the Court held that Part II does not give a migrant who arrived after 1950 any right to citizenship. That is governed by the 1955 Act.
