The Paper as Set

The questions in this volume are the questions asked at the Jan 2018 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

Instructions printed on the paper

  • N.B: Attempt all questions.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

SECTION I

Answer in not more than two sentences, all 10 20 Marks

munotes.in 1

1.Write any two important features of the Govt. of India Act, 1935.[2]

Answer

The Government of India Act, 1935 was the longest Act the British Parliament passed for India. About two thirds of our Constitution's text descends from it. Any two of these features answer the question.

  1. An All-India Federation. It provided for a federation of the British Indian Provinces and the princely States that chose to join by an Instrument of Accession. This federation never came into being, because enough princely States did not accede.
  2. Provincial autonomy. Dyarchy was abolished in the Provinces. The Provinces became units in their own right, governed by ministers responsible to elected legislatures. This part came into force in 1937.
  3. Three Lists. Legislative power was divided by a Federal List, a Provincial List and a Concurrent List. The residuary power was left to the Governor-General. This is the ancestor of our Seventh Schedule.
  4. A Federal Court at Delhi, the forerunner of the Supreme Court.

  1. Dyarchy at the centre, with defence and foreign affairs reserved. It never worked, because the federation was never formed.
  2. Safeguards for the Governor-General and the Governors, such as discretionary powers and special responsibilities. The emergency power in section 93 is the ancestor of article 356.

Its weakness. It had no bill of rights and no promise of self-government. Nehru called it a machine with strong brakes and no engine.
