The Paper as Set

The questions in this volume are the questions asked at the May 2016 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1.Which Act established the Federal Court in British India?[2]

Answer

The Government of India Act, 1935 established the Federal Court of British India. The Court began functioning at Delhi in 1937.

Why it was needed. The Act of 1935 planned an All-India Federation of the Provinces and the princely States. A federation divides power between two levels of government. So a court was needed to decide disputes between the units and to interpret the Act itself.

Its composition. It had a Chief Justice and not more than six judges, though in practice it worked with fewer. Sir Maurice Gwyer was its first Chief Justice.

Its jurisdiction was of three kinds:

  1. Original, in disputes between the Federation and its units.
  2. Appellate, from High Courts on a substantial question of law about the interpretation of the Act.
  3. Advisory, on references made by the Governor-General.

Its limit. It was not a final court. Appeals lay from it to the Privy Council in England until the Abolition of Privy Council Jurisdiction Act, 1949.

What became of it. It was replaced by the Supreme Court of India on 26 January 1950. Under article 374(1) its judges became judges of the Supreme Court. So the Federal Court is the direct ancestor of our Supreme Court.
