About this subject
CPC in the ninth BLS LLB semester is two statutes examined in one paper, and the paper says so on its own header. The oldest paper in this folder, from 2018-19, carries Q.P. Code 08251 and the bare title Civil Procedure Code. From 2019-20 the header reads Paper Subject Code 68001, Civil Procedure Code and Limitation Act, and from 2024-25 code 68011 carries the same two names. The Limitation Act is the smaller half, about one question in eight across the folder, but it is never absent, and it turns up in the long answer section as often as it does in the short one.
One topic is in every paper here except the online one: the interpleader suit. Section 88 and Order XXXV are set in seven of the eight papers, twice in the 2019-20 scan because that scan holds two papers. Nothing else in the subject is that reliable. Behind it come the modes of execution of a decree and the ex parte decree, six papers each, and then a group of five: the caveat, the counterclaim, the indigent person, the temporary injunction, the modes of service of summons, suits by or against minors and persons of unsound mind, and review. Prepare those nine topics properly and you have met most of what this folder asks.
The situational section is where this subject gives most away, because the examiners reuse the problems and only change the names. The clearest case is the 2024-25 ATKT Set 2 paper, whose four situational questions all come from earlier papers in this same folder: the agricultural tenant who acquired ownership on tillers day and the prayer for a commission, taken from 2022-23 with Omprakash and Harivijay in place of Raghunath and Ram Puranik and the year moved from 1940 to 1942; the appellant who wishes to produce additional documentary evidence, from the same 2022-23 paper; the defendant who missed his hearing after an accident; and, word for word from 2018-19 apart from a surname, the decree passed against an adult person who had been sued as a minor in ignorance that he had become major.
That accident problem is the most reused thing in the subject. A defendant suffers a heart attack or is injured a day before his hearing, cannot reach his advocate, and an ex parte decree follows. It is Arnab in 2018-19, Mr D in 2019-20, X in the 2024-25 ATKT Set 2 paper and Mr Y in the 2025-26 ATKT paper, and the 2024-25 regular paper sets the same facts with the excuse deliberately removed, saying the defendant failed to appear without any valid reason. Learn Order IX Rule 13 with its two grounds and its thirty days under Article 123, and learn what happens on the other side under Order IX Rule 8 and Rule 9, and you can answer all five.
Two patterns run through the folder and the arithmetic differs, so check which one you are sitting. Codes 08251 and 68001 are 100 marks in three hours: ten short answers of 2 marks, short notes at 5, situational problems at 6, and four essays of 12. Code 68011, from 2024-25, is 60 marks in two hours: the same ten short answers at 2, but short notes and problems at 6 each and only two essays of 12. The first three sections of both come to 12 marks each on the 60 mark paper, so about a third of the paper is the same shape whichever you get. The 2021-22 sitting is the outlier, an online examination of twenty multiple choice questions and ten descriptive ones with no marks and no duration printed anywhere on it.
A word on what to do with the older papers, because the law under them has moved. Section 89, on settling a suit outside the court, was replaced outright by Schedule IV to the Mediation Act, 2023, so an answer written from a textbook printed before that will state a section that no longer exists. The Supreme Court excluded 15 March 2020 to 28 February 2022 from every limitation period, which is enough to reverse the answer to a problem in the 2024-25 paper about a loan acknowledged in December 2020. Adverse possession became a sword as well as a shield in 2019. And the United Arab Emirates was notified a reciprocating territory in January 2020, which matters to every question on Section 44A. The answers in this folder are written on the law as it stands, and say where it has changed.
