The Paper as Set

The questions in this volume are the questions asked at the Nov 2017 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

Instructions printed on the paper

  • N.B: (1) All questions are compulsory. (2) Figures to the right indicate full marks.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

Q.1

Q.1: Answer in 2-3 sentences each

munotes.in 1

(a)Define "land" under the Land Acquisition Act.[2]

Answer

Section 3(a) of the Land Acquisition Act, 1894 defines the word: "the expression 'land' includes benefits to arise out of land, and things attached to the earth or permanently fastened to anything attached to the earth".

The 1894 Act was repealed from 1 January 2014. The repeal was made by section 114 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Section 3(p) of the 2013 Act repeats the same words.

What the definition takes in.

  1. The ground itself. The word "includes" widens the ordinary meaning of land. It does not replace it.
  2. Benefits to arise out of land. These are rights to what the land yields, such as rent, crops and other profits.
  3. Things attached to the earth. Buildings, walls, wells and trees are part of the land.
  4. Things permanently fastened to anything attached to the earth. A pump bolted to a well, or machinery fixed to a factory floor, goes with the land.

Why it matters. Whatever is "land" passes to the Government when the land is acquired, so the compensation must cover all of it. Section 23(1) of the 1894 Act counts the damage from taking standing crops and trees. Section 29 of the 2013 Act requires the Collector to value buildings, trees, plants, crops and other assets attached to the land, with expert help.

Example. The State acquires a farm with a mango orchard, a farmhouse and a pump fixed to a well. All of these are "land", and each is valued in the award.
