The Paper as Set

The questions in this volume are the questions asked at the Oct 2024 - ATKT 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  21 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(1)Why are Human Rights essential for every individual?[2]

Answer

Human rights are essential because they give every person a minimum of dignity and freedom that no government, majority or private power may take away. They belong to a person simply because he is human.

Six reasons.

  1. Law alone is not enough. A law can be validly made and still be monstrous, like the Nuremberg Laws of 1935. Human rights give a standard by which such a law is judged unjust.
  2. The State is both the danger and the protector. It holds the police, the army and the prisons. Rights restrain it while still requiring it to protect people from private violence.
  3. Majorities can oppress minorities. Rights protect the individual and the minority against the majority. That is why Part III of our Constitution binds even the legislature.
  4. Dignity needs material conditions. A starving person is not truly free. So the Universal Declaration speaks of a standard of living "adequate for the health and well-being" of a person (Article 25).

  1. Peace depends on them. The UN Charter links respect for human rights with peaceful relations among nations (Article 55).
  2. The alternative is rebellion. The Universal Declaration's Preamble says rights must be protected by the rule of law, so that people are not driven to "rebellion against tyranny and oppression".
