The Paper as Set

The questions in this volume are the questions asked at the 2025-26 - ATKT 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

Q.1

Q.1 Answer the following in not more than two sentences

munotes.in 1

(a)What's "Vis major"?[2]

Answer

The answer, in the two sentences the paper allows. Vis major (Latin for "a superior force") is an irresistible natural force, such as a flood, a storm or lightning, that no human care could prevent. In law, a loss caused by such a force is not charged to a blameless person; it works like the act of God.

Broom's example. Broom gives the case of land suddenly flooded by the sea "without any default of the tenant". That, he writes, is "the act of God, that vis major for which the tenant is not responsible". He adds that breaking a contract to carry a passenger, "if caused by vis major, would seem to be excusable".

Only a force of nature counts. In Ramalinga Nadar v. Narayana Reddiar, AIR 1971 Ker 197, decided on 10 December 1970, a mob in a food agitation looted goods from a lorry service. The Kerala High Court held the carrier liable. A mob is human agency, and an act of God is limited to "the elementary forces of nature unconnected with the agency of man".

In terms of cause. Where a superior natural force is the operative cause of a loss, the law does not name the blameless person as its cause.
