Instructions printed on the paper

  • N.B: 1. All Questions are compulsory. 2. Figures to the right indicate full marks.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

Q.1

Q.1: Answer any six of the following in two sentences only, any 6 of 10

12 Marks - 2 marks each

munotes.in 1

(a)"Our decision, therefore, cannot turn on merely a comparison of these tangible factors in the Negro and white schools involved in each of the cases. We must look instead to the effect of segregation itself on public education." Identify the speaker. Identify the case.[2]

Answer

The answer, in the two sentences the paper allows. The speaker is Chief Justice Earl Warren, delivering the unanimous opinion of the Supreme Court of the United States. The case is Brown v. Board of Education of Topeka, 347 U.S. 483, decided on 17 May 1954.

Where the line comes from. The cases came from Kansas, South Carolina, Virginia and Delaware. Black children had been refused places in white public schools under segregation laws. In the Kansas case the lower court had found the Black and white schools equal, or being made equal, in buildings, courses and teachers. Warren says that this comparison of "tangible factors" cannot decide the case.

Why the line matters. The sentence is the turning point of the opinion. Under Plessy v. Ferguson (1896), equal facilities were enough. Warren looks instead at what separation does to the child: it "generates a feeling of inferiority". So the Court holds that "Separate educational facilities are inherently unequal."
