SECTION III - Q.3: Answer Any Two of the following (2 X 6) 12 Marks

1. Q15 Anjeeta, a young fearless news anchor works for the WYZ News Channel. Once, while doing a live coverage of a war, a bomb drops near her and damages her ears thereby spoiling her hearing capacity considerably. This also meant that she could no longer work as a news reporter which also would render her wage earning capacity to a great extent. (i) Anjeeta is what category of worker and what other types of professions are included in the category that Anjeeta belongs to? (ii) What specific details need to be mentioned in the agreement that is made for the employment of persons who belong to the category of workers that Anjeeta belongs to?
2. Q16 As per the provisions of the Code on Social Security, 2020, an Employees' State Insurance Corporation has to be constituted. (i) Who has the power to constitute the Employees' State Insurance Corporation and on what date can the Corporation start its functioning? (ii) Who shall be the chief of the Employees' State Insurance Corporation and how many representative of each State of India can be appointed to the Corporation?
3. Q17 Alvida works in a cashew plantation farm. She has a 3 year old daughter named Alpita. (i) Is the owner of the plantation statutorily supposed to provide creche facility if the plantation farm employs thirty five employees? Give reasons for your answer. (ii) What measures are provided for handling of hazardous chemicals, pesticides, insecticides etc. in a plantation farm as per the provisions of the Occupational Safety, Health and Working Conditions Code, 2020?
4. Q18 M/s. Underground Construction Limited has a building site in Puri, Odisha where many migrant workers from within the State of Odisha and other States of India are working as construction workers. (i) What are the various formalities that M/s. Underground Construction Limited has to undertake in order to employ construction workers from within the State and from outside the State respectively? (ii) Clearly specify as to what kind of persons are statutorily prohibited to work as Building and Construction Workers as per the Occupational Safety, Health and Working Conditions Code, 2020?
