SECTION III - Q.3: Solve any two problems out of three, 6 marks each (12 Marks)

1. Q17 The Paquette Habana Fishing boat and another fishing boat Lola flying the Spanish flag and belonging to Spanish subjects were captured by a United States Warship in the Blockade of the North Coast of Cuba. They were brought before the court for condemnation. (i) Whether, under Customary International Law, fishing boats were exempted from capture? Give reasons. (ii) What is the name of the care and which court has jurisdiction?
2. Q18 A head constable and a constable were suspended for being involved in the death of an accured who was in their custody in the same police station. The accured was found hanging in the toilet. (i) Is there violation of any Fundamental Human Right? Identify and explain. (ii) How can the NHRC help the family of the deceased to get compensation?
3. Q19 The Air-India authority makes a regulation and provides that, an Air-hostess would retire from the service attaining the age of 35 years or on marriage within 4 years of service or on first pregnancy, whichever occurred earlier. In this case a petitioner Air Hostess terminated from her job on the ground of her first pregnancy. Challenged the rules and regulations of Air India authority before the S.C. (i) Is it a violation of Human Rights? Explain your answer with the help of a case law. (ii) Explain in detail constitutional provisions for protection of Air Hostess rights.
