How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

Q1)Differentiate between Legal Language and General English. Discuss the significance of distinguishing the two in the context of legal communication.[15]

Answer

For full marks, cover: the definition of legal language; its features (precision, technical terms, Latin and French words, formality, long sentences, fixed formulas); the differences between Legal English and General English, in a table with examples; the significance of distinguishing the two in legal communication (precision and certainty, interpretation, drafting, advocacy, communication with clients, access to justice, plain language); and a conclusion.

Definition

Legal language is the language used in law: in statutes, judgments, pleadings, contracts, deeds, notices and legal opinions. It is the specialised form of a language that lawyers use to create, state and apply legal rights and duties. David Mellinkoff, in The Language of the Law (1963), showed how English legal language grew from Old English, Latin and Law French.

Features of legal language

munotes.in 2
  1. Precision. Every word may decide rights and liabilities, so terms are used in exact, settled senses.
  2. Technical terms (terms of art), such as "consideration", "easement", "decree" and "cognizable".
  3. Latin and French words, such as res judicata, mens rea, bona fide, "plaintiff" and "lien".
  4. Formal and impersonal tone.
  5. Long, complex sentences with many conditions and exceptions.
  6. Fixed formulas, such as "Whereas", "Now this deed witnesses" and "In witness whereof".
  7. Doublets, such as "null and void" and "terms and conditions".

Examples.

  1. In General English, "issue" means a topic. In law, it may mean a point in dispute, or children ("dies without issue").
  2. "Party" in General English is a celebration. In law, it is a person bound by a contract or involved in a case.

Significance of distinguishing the two in legal communication

  1. Precision and certainty. A lawyer must know when a word carries a special legal meaning. Reading "consideration" or "issue" in its everyday sense can change the meaning of a contract or a will.
  2. Interpretation. Courts interpret statutes and documents by legal rules, not by common usage alone. A lawyer who knows the difference can argue for the correct reading.
  3. Drafting. Deeds, contracts and pleadings must use settled terms of art, so that they produce the intended legal effect and avoid disputes.
  4. Advocacy. Arguments before a court must use precise legal terms, but should be clear enough to persuade.
  5. Communication with clients. Clients understand General English. A lawyer must translate legal language into plain words, so that clients understand their rights, risks and choices.
munotes.in 5
  1. Access to justice. When legal language is needlessly obscure, ordinary people cannot understand the law that governs them. Knowing the difference helps lawyers write plainly where precision allows.
  2. Avoiding ambiguity. Mixing loose everyday words into legal documents creates vagueness, which leads to litigation.

The plain language movement

Modern drafting tries to keep precision while dropping needless legalese. Short sentences, active voice and defined terms make legal documents easier to understand without losing accuracy.

Conclusion. Legal language is the precise, technical and formal language of the law. It differs from General English in purpose, vocabulary, the special meaning of words, sentence structure, tone and audience. Distinguishing the two helps lawyers draft precisely, interpret correctly, argue persuasively and explain the law plainly to clients. Lawyers must master legal language, but should also write as plainly as accuracy allows.
