The answers in this volume state the law as it stands today, not as it stood when each paper was set, and four changes alter answers throughout this folder. The Bharatiya Nagarik Suraksha Sanhita and the Bharatiya Sakshya Adhiniyam came into force on 1 July 2024: section 176(3) of the Sanhita requires a forensic expert to attend the scene of every offence punishable with seven years or more, but only from a date each State notifies within five years. The DNA Technology (Use and Application) Regulation Bill, 2019 was withdrawn from the Lok Sabha in July 2023, so India has no DNA statute and no body that accredits a forensic laboratory. Kattavellai v. State of Tamil Nadu, 15 July 2025, now requires every sample to reach the laboratory within forty eight hours and a chain of custody register signed by each handler. And Amlesh Kumar v. State of Bihar, 10 June 2025, holds that an accused has no right to demand a narco-analysis test and that its findings can never be the sole basis of a conviction.

For full marks, cover: two of the three, so each note carries about twelve and a half marks and needs a full page and a half. All three are written out below. Note A is the odd one in this folder: it is not a forensic technique at all but a problem of jurisdiction and coordination, and the marks are in the constitutional allocation and in the new offence provisions, not in a list of crimes that cross borders. Notes B and C are technical, and in both the discriminator is whether you name the tests or the physics rather than describing the field in general terms.

A) Inter-State crimes (about 12.5 marks)

What the expression covers. An inter-State crime is one whose commission, effects, proceeds or perpetrators extend across the boundary of more than one State of the Union. The recurring categories are inter-State gangs committing dacoity, highway robbery and burglary; vehicle theft, where the vehicle is stolen in one State and disposed of in another; trafficking in human beings, in narcotics, in arms and in wildlife; cattle smuggling; counterfeit currency; economic offences and cyber-crime, which are inter-State by default; and terrorism, which is usually both inter-State and international.

Why they are structurally difficult in India, which is the point of the note. Under the Seventh Schedule to the Constitution, public order and police are State subjects, being Entries 1 and 2 of List II, the State List. Criminal law and criminal procedure are in the Concurrent List, Entries 1 and 2 of List III. The consequence is that the substantive law is largely uniform across the country while the machinery that enforces it is fragmented into more than thirty separate police forces, none of which has authority in another's territory.

The Union has only limited entries to work with. Entry 8 of the Union List covers the Central Bureau of Intelligence and Investigation, and Entry 80 permits the extension of the powers and jurisdiction of the police of one State to another State, but only with the consent of that other State. That is the constitutional root of s.6 of the Delhi Special Police Establishment Act, 1946, under which the Central Bureau of Investigation cannot exercise powers in a State without that State's consent, and of the periodic withdrawal of general consent by States, which is the single largest practical obstacle to the investigation of inter-State offences.

How criminal procedure copes. The Bharatiya Nagarik Suraksha Sanhita, 2023 addresses the problem in three ways.

Registration. Section 173(1) provides that every information relating to the commission of a cognizable offence may be given, irrespective of the area where the offence is committed, orally or by electronic communication to an officer in charge of a police station, with electronic information taken on record on being signed within three days. That is the statutory zero first information report and the electronic first information report, and it means a victim need no longer be turned away for approaching the wrong police station, which used to defeat inter-State complaints at the first step.

Jurisdiction to try. Section 197 states the ordinary rule that an offence is tried where it was committed. Section 198 then provides that where it is uncertain in which of several local areas the offence was committed, or where it was committed partly in one area and partly in another, or where it is a continuing offence extending over more areas than one, or where it consists of several acts done in different local areas, it may be inquired into or tried by a court having jurisdiction over any of them.

Section 199 allows trial where the act was done or where the consequence ensued. Section 201 makes specific provision for the mobile offences: dacoity, and belonging to a gang of dacoits, may be tried where the offence was committed or where the accused is found; kidnapping or abduction may be tried where the person was kidnapped, conveyed, concealed or detained; and theft, extortion or robbery may be tried where the offence was committed or where the stolen property was possessed, received or delivered.

Substantive law. The Bharatiya Nyaya Sanhita, 2023 has created two new offences aimed squarely at this problem. Section 111 makes organised crime an offence: any continuing unlawful activity, including kidnapping, robbery, vehicle theft, extortion, land grabbing, contract killing, economic offences, cyber-crimes and trafficking in persons, drugs, weapons or illicit goods, committed by a person or a group acting in concert, singly or jointly, as a member of or on behalf of an organised crime syndicate, by violence, threat of violence, intimidation, coercion or other unlawful means, to obtain direct or indirect material benefit including financial benefit.

The Explanation defines an organised crime syndicate as a group of two or more persons indulging in continuing unlawful activity. Section 112 creates the offence of petty organised crime, committed by a member of a group or gang, covering theft including trick theft, theft from vehicles and dwellings, cargo theft, pickpocketing, card skimming, shoplifting and theft from automated teller machines, and also snatching, cheating, unauthorised selling of tickets, unauthorised betting or gambling and the selling of public examination question papers, punishable with one to seven years. Section 113 covers the terrorist act.

The forensic and informational dimension, which is why this note belongs in this paper. Inter-State offences are precisely the class in which a national record system matters more than local knowledge. The Crime and Criminal Tracking Network and Systems links police stations into a common records system, the Inter-operable Criminal Justice System connects the police to the courts, prosecution, prisons and forensic laboratories, and the National Automated Fingerprint Identification System, launched on 17 August 2022, makes a chance print lifted in one State searchable against records created in another, assigning each arrested person a ten-digit National Fingerprint Number. The collection power behind them is the Criminal Procedure (Identification) Act, 2022, in force from 4 August 2022, whose s.4(1) makes the National Crime Records Bureau the national custodian of measurements, with power to collect from States, store, process, share and disseminate.

Institutionally, the National Investigation Agency, constituted under the National Investigation Agency Act, 2008, investigates scheduled offences across State boundaries without needing State consent, which is the one genuine exception to the Entry 80 problem, and inter-State coordination otherwise runs through the Bureau of Police Research and Development, the Multi Agency Centre and inter-State coordination committees.

The unresolved difficulty. Nothing in the above solves the central problem, which is that a State police officer has no power to act in another State except through that State's force. Investigation across State lines therefore proceeds by request and by courtesy, and where relations between the two governments are poor the request is not answered. The withdrawal of general consent under s.6 of the 1946 Act by several States has made the position worse for central investigation, and no constitutional amendment has been attempted.

B) Forensic biology (about 12.5 marks)

The discipline and its logic. Forensic biology examines material of biological origin, human, animal or plant, to answer a legal question, and it proceeds through four questions in a fixed order: is the material biological at all; what kind of material is it; from what species does it come; and whose is it. The first three belong to serology and the fourth, since the late 1980s, to DNA profiling. Reciting that sequence is the fastest way to show that you understand the discipline rather than merely recall its contents.

Blood. Presumptive tests exploit the peroxidase-like activity of haemoglobin: the Kastle-Meyer test with phenolphthalein and hydrogen peroxide, which gives an immediate pink; leucomalachite green, which gives blue-green; and luminol, sprayed over a surface and viewed in darkness, which luminesces over blood diluted and washed far beyond visibility and is therefore the instrument for a scene that has been cleaned. All are presumptive, because plant peroxidases, rust and certain metal salts give false positives, so a negative excludes and a positive does not establish. Confirmation is by the microcrystal tests, Teichmann for haemin and Takayama for haemochromogen. Species is settled by the precipitin test, using antiserum raised against human protein and now performed as gel diffusion or crossover electrophoresis, which disposes of the standard defence that the blood was an animal's.

Semen. The presumptive test is acid phosphatase, present in seminal fluid at far higher concentration than in other fluids. Confirmation is by microscopic identification of spermatozoa, which is conclusive; by the Florence test for choline and the Barberio test for spermine; and by prostate specific antigen, which is the practically important one because it is detectable in the seminal fluid of a vasectomised or azoospermic man, in whom microscopy alone would falsely report a negative.

Saliva is identified by amylase and matters because it is deposited on cigarette ends, bite marks, bottle rims, envelope flaps and cloth used as a gag. Hair is examined microscopically for human or animal origin, region of the body, whether shed or pulled, and whether the root sheath is present, which determines whether nuclear or only mitochondrial DNA can be obtained.

Two applications worth naming. The diatom test distinguishes ante-mortem from post-mortem drowning: a person who drowns while alive inhales water containing these algae, which the circulation carries into the marrow of the femur and other distal bones, so their presence there supports drowning while their absence in a body recovered from water suggests it was placed there. Forensic entomology uses the succession of insect colonisation of a corpse to estimate the post-mortem interval where decomposition has defeated the medical estimates.

DNA in outline. Profiling counts short tandem repeats at an agreed set of loci, with the amelogenin locus indicating sex; the sample is extracted, quantified, amplified by the polymerase chain reaction, separated by capillary electrophoresis and reported as a random match probability. Y-STR profiling finds a male contributor in a female-dominated mixture but identifies a paternal lineage; mitochondrial DNA survives degradation but identifies a maternal lineage.

The law. The Serologist to the Government is a Government scientific expert under s.329(4)(f) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and the Director of a Central or State Forensic Science Laboratory under clause (e), so the report may be used as evidence and, by the second proviso to s.330, the expert is not called unless a party disputes it. The opinion is relevant under s.39(1) of the Bharatiya Sakshya Adhiniyam, 2023, and Pattu Rajan v. State of Tamil Nadu, (2019) 4 SCC 771 holds that DNA is itself opinion evidence by which the court is not bound. Samples are obtained under s.51 of the Sanhita, whose Explanation covers blood, blood stains, semen, swabs, sputum, sweat, hair and nail clippings by modern techniques including DNA profiling, and under ss.52 and 184. India has no DNA statute, the 2019 Bill having been withdrawn from the Lok Sabha in July 2023.

The weakness. Never the chemistry. In Rahul v. State of Delhi (NCT of Delhi), 2022 LiveLaw (SC) 926, samples lay in police custody about two months with nothing recorded and three death sentences were set aside; in Kattavellai @ Devakar v. State of Tamil Nadu, 2025 INSC 845, a forty-one day unexplained gap between the swab and the laboratory produced another acquittal and binding nationwide directions requiring documented packaging, delivery within forty-eight hours and a Chain of Custody Register signed by every handler.

C) Applications of ultraviolet and infrared rays in crime detection (about 12.5 marks)

The physics, which must come first. Visible light occupies about 400 to 700 nanometres. Ultraviolet lies below, from about 10 to 400 nanometres, divided into UVA from 315 to 400, UVB from 280 to 315 and UVC from 100 to 280. Infrared lies above, from about 700 nanometres upwards, the near infrared being the region used for documents and the far infrared being thermal radiation.

Two distinct effects are exploited and confusing them is the commonest error. Fluorescence: a substance absorbs short-wavelength radiation and re-emits at a longer wavelength, so something invisible in white light glows under ultraviolet. Differential absorption and reflection: two substances that reflect visible light identically may absorb or reflect infrared quite differently, so an infrared-sensitive camera sees a contrast the eye cannot.

Ultraviolet applications. Body fluids: semen, saliva and urine fluoresce, which locates them on bedding, clothing and upholstery where nothing is visible; the result is presumptive and directs sampling for acid phosphatase, prostate specific antigen and amylase. Injuries: bruises and bite marks that have faded from view remain detectable, because pigment residue absorbs differently from surrounding skin, and ultraviolet photography of a healing bite mark is standard in sexual offence and child abuse work. Fingerprints: most modern development reagents are chosen for their fluorescence, and reflected ultraviolet imaging can record an untreated mark on a difficult surface.

Documents: modern paper contains optical brighteners which fluoresce strongly, so a substituted page of different stock is immediately visible; chemical and mechanical erasures disturb the surface and appear as patches; and the security features of currency, stamps, passports and identity documents are engineered to respond at specified wavelengths, which is the basis of counterfeit detection. Trace material: bone and teeth fluoresce, assisting recovery of fragments, and certain drugs, adulterants and fibres are distinguishable by fluorescence when they are not by colour.

Infrared applications. Documents, the principal use: inks identical in white light frequently differ in the infrared, one absorbing and appearing black while the other is transparent and disappears, which reveals additions and alterations made later with a different pen and permits reading through an obliteration; infrared luminescence, illuminating with visible light and photographing in the infrared, separates inks that plain absorption cannot; and charred documents can sometimes be read, because carbonised ink and carbonised paper still differ in infrared reflectance.

Gunshot residue on dark or bloodstained clothing: soot and tattooing invisible on dark cloth are recorded clearly in the infrared, which matters because range determination depends on the residue pattern. Subcutaneous injury: near infrared penetrates the upper skin layers and reveals bruising not visible to the eye. Thermal imaging in the far infrared detects heat and is used for surveillance in darkness, for locating persons hiding or buried, for detecting recently disturbed ground and for identifying recently driven vehicles.

The instruments are the Wood's lamp and the alternate light source with matching viewing filters, the video spectral comparator, which applies both regions systematically to documents, and infrared and thermal cameras.

The law and the limits. Findings are given as expert opinion under s.39(1) of the Sakshya Adhiniyam, with the grounds relevant under s.45, and in document cases the court may itself compare under s.72, subject to the caution in State (Delhi Administration) v. Pali Ram, (1979) 2 SCC 158 that the prudent course is to obtain expert assistance. The limits are three. Fluorescence is not specific: detergents, lubricants and some foods fluoresce at the same wavelengths as semen, so the result is presumptive. Ultraviolet damages DNA, so prolonged short-wave exposure degrades the very material to be profiled, and UVC is hazardous to the examiner's eyes and skin. Infrared shows a difference and cannot date it: two inks may differ because a document was altered or because the writer changed pens.

Conclusion. Inter-State crime is a problem of machinery rather than of substantive law: police and public order are State subjects under Entries 1 and 2 of List II, Entry 80 of the Union List permits extension of police powers only with the receiving State's consent, and s.6 of the Delhi Special Police Establishment Act, 1946 reproduces that limit; the Sanhita answers it through the area-blind first information report in s.173(1) and the flexible venue provisions in ss.197 to 201, and the Nyaya Sanhita answers it substantively through the new offences of organised crime in s.111 and petty organised crime in s.112, with CCTNS, the Inter-operable Criminal Justice System, NAFIS and the National Crime Records Bureau supplying the informational layer.

Forensic biology proceeds through the fixed four questions, using presumptive tests that exclude and confirmatory tests that establish, and its Indian weakness is custody rather than chemistry, as Rahul and Kattavellai show. Ultraviolet and infrared examination exploits fluorescence and differential absorption to make visible a contrast the eye cannot see, in body fluids, injuries, fingerprints, documents and gunshot residue, and its universal limitation is that a contrast is not an identification.

For full marks, cover: the sub-parts are lettered D), E) and F) because this paper runs its lettering continuously from Q1; write them as the paper letters them. Two of the three are required, at about twelve and a half marks each, and all three are written out. This answer takes each note from the scientific end, what the thing is and how it works, because the same three notes are set again at Q9 of the second paper in this scan and that answer takes them from the courtroom end. Between the two you have each topic twice from two directions.

D) Forensic medicine (about 12.5 marks)

What it is. Forensic medicine is the branch of medicine that applies medical knowledge and technique to the questions the administration of justice must answer. It is distinguished, loosely in Indian usage, from medical jurisprudence, which runs the other way and concerns the legal duties, liabilities and privileges of the medical practitioner: consent, confidentiality, negligence and registration.

What it examines. The identification of the living and the dead; the cause, manner and time of death; the interpretation of injuries, mechanical, thermal, chemical and from firearms; asphyxial deaths by hanging, strangulation, drowning and smothering; the medico-legal aspects of sexual offences; the medical aspects of poisoning, overlapping with toxicology; the estimation of age; and questions of mental capacity including fitness to stand trial.

The medico-legal autopsy, and how it differs. A clinical autopsy asks what disease killed the patient. A medico-legal autopsy asks a legal question: was the death natural, accidental, suicidal or homicidal; what caused it; when did it occur; and are the marks on the body consistent with the account given of how they were inflicted. It is performed on the requisition of the investigating agency, without the family's consent, and it must be complete, all three body cavities being opened even where the cause appears obvious, because its purpose is to exclude alternatives.

The science of the estimates. The value of the note lies in the methods, so they should be given.

Time since death is estimated from a set of changes each with its own timetable and its own sources of error: algor mortis, the cooling of the body, which follows a broadly sigmoid curve modified by ambient temperature, clothing, body mass and air movement; rigor mortis, the stiffening produced by the depletion of adenosine triphosphate in muscle, which typically begins in the smaller muscles within a few hours, becomes generalised, and passes off as putrefaction begins, but is accelerated by heat and by prior exertion; livor mortis, the settling of blood under gravity, which begins as patches, becomes confluent and eventually becomes fixed, so that its distribution shows whether the body was moved and its fixation gives a rough interval; the state of stomach contents, which depends entirely on what and when the person last ate; and the sequence of putrefaction, greatly accelerated in Indian conditions.

Identification of the dead proceeds from the general to the particular: sex, age, stature and build; then scars, tattoos, deformities and occupational marks; then dental records and restorations, which are highly individual; then fingerprints where the skin survives; then DNA. Age of the living is estimated from dental eruption in the young and from epiphyseal fusion on radiographs through adolescence into the mid twenties, the estimate being a range that widens with age.

Wounds are described by site, size, shape, margins, depth and age, and are classified as abrasions, contusions, lacerations, incised wounds, stab wounds and firearm wounds, with the medico-legal classification into simple and grievous determining the offence charged. In firearm injury the entry wound is distinguished by inverted margins and an abrasion collar and the exit by everted margins and the absence of any collar, soot or tattooing.

The statutory framework. Section 194 of the Bharatiya Nagarik Suraksha Sanhita, 2023 triggers the inquest and, by sub-section (3), requires the body to be forwarded for post-mortem examination in five listed cases including any doubt as to the cause of death. Section 51 permits examination of an arrested person, with an Explanation extending "examination" to blood, blood stains, semen, swabs, sputum, sweat, hair and nail clippings by modern techniques including DNA profiling. Section 52 covers a person arrested for rape and s.53 every arrested person, with a copy of the report to the arrested person. Section 184 covers the victim of rape, within twenty-four hours, with consent recorded.

Weight. The medical witness is an expert under s.39(1) of the Bharatiya Sakshya Adhiniyam, 2023, and under Solanki Chimanbhai Ukabhai v. State of Gujarat, (1983) 2 SCC 174 his evidence is ordinarily corroborative, proving that the injuries could have been caused as alleged and nothing more, and displacing eyewitness testimony only where it rules the eyewitness account out altogether.

E) Portable bomb sniffer (about 12.5 marks)

What it is and how it works. A portable bomb sniffer is a hand-held or trolley-mounted instrument that detects the vapour or surface trace of an explosive. The dominant technology is ion mobility spectrometry. A swab is wiped over a suspect surface or air is drawn into the instrument; the sample is heated to vaporise it and then ionised, usually by a weak radioactive source or a corona discharge; the ions are released in a pulse into a drift tube and driven along it by an electric field against a counter-flow of clean drift gas; and the time each ion species takes to traverse the tube, which depends on its size, shape and charge, identifies the compound. The whole cycle takes seconds, which is why the instrument is deployed where throughput matters, at airports, at court and legislature entrances and around protected persons.

Other technologies exist and are worth naming: chemiluminescence, which pyrolyses the sample and detects the light emitted when nitric oxide reacts with ozone; amplifying fluorescent polymer sensors, in which a polymer's fluorescence is quenched by nitroaromatic vapour; surface acoustic wave devices; and simple colorimetric field kits, which are cheap and much less specific.

What it detects, and why that matters. The nitro-group military and commercial explosives, RDX, PETN, TNT and HMX and the nitrate esters, ionise readily and are detected well. Ammonium nitrate, the base of most improvised Indian devices, is detected but is also the base of agricultural fertiliser, so an alert on it means much less. The peroxide explosives TATP and HMTD, which can be made from retail chemicals and contain no nitrogen at all, are the hard class and require the instrument to be configured for them specifically.

How it is used at a scene. At a pre-blast scene the instrument screens persons, baggage, vehicles and packages. At a post-blast scene it screens debris, the suspect's hands and clothing, and vehicles, to direct the collection of samples for confirmatory analysis. Section 176(3) of the Sanhita is directly in point, because a post-blast scene is the paradigm case for the new duty requiring a forensic expert to attend the scene of any offence punishable with seven years or more, from a notified date, with videography of the collection: post-blast residue is microscopic, it degrades, and the rescue operation itself destroys it.

What it proves, which is the legal point. Nothing, by itself. It is a screening instrument, and its legal function is to generate the reasonable suspicion that justifies a search and a seizure. The exhibits seized then go to the explosives division of a Central Forensic Science Laboratory for confirmatory analysis by gas chromatography with mass spectrometry or high performance liquid chromatography, and it is the confirmatory result, spoken to by a witness who can be cross-examined, that reaches the court. The Chief Controller of Explosives is a Government scientific expert under s.329(4)(b) of the Sanhita.

Its limits. Nitrogenous fertilisers, some pharmaceuticals and nitroglycerine heart medication produce false alerts. Trace contamination transfers readily from hand to hand and surface to surface, so a positive swab is consistent with innocent contact. The radioactive ionisation source in older instruments carries its own regulatory burden. And the other portable method, the explosive detection dog, has weak Indian legal standing: in Abdul Rajak Murtaja Dafedar v. State of Maharashtra, AIR 1970 SC 283, a three-judge Bench expressly declined to express a concluded opinion or lay down a general rule on the admissibility or weight of tracker-dog evidence, and the practical position is that such evidence carries little weight and cannot stand alone, because the animal cannot be cross-examined and the court is being asked to accept the handler's account of what it did.

F) Lie detector test (about 12.5 marks)

What the instrument records. A polygraph records several physiological correlates of autonomic arousal simultaneously: respiration, through pneumograph tubes across the chest and abdomen, recording rate and depth; cardiovascular activity, through a blood pressure cuff, recording relative blood pressure and pulse; and electrodermal activity, the galvanic skin response, through electrodes on the fingers, which records the change in skin conductance produced by sweat gland activity. Some instruments add a plethysmograph recording peripheral blood volume.

How the test is structured. Three question formats are used. The relevant and irrelevant technique alternates questions about the offence with neutral ones. The control or comparison question test, the standard format, compares the response to relevant questions with the response to deliberately troubling but unrelated "control" questions, on the theory that a guilty subject reacts more to the relevant and an innocent subject more to the control. The guilty knowledge or concealed information test does not ask about guilt at all; it asks about details of the offence known only to the offender and to the investigators, and looks for a differential reaction to the correct detail among several plausible alternatives.

Why it does not work as advertised. The instrument measures arousal, not deception, and there is no physiological signature unique to lying. An innocent subject frightened of the machine, of the police, or of the consequences of an inconclusive result produces the pattern read as deception; a practised, indifferent or medicated subject produces the pattern read as truth. Countermeasures, physical and mental, are documented and effective. The guilty knowledge test is scientifically the most defensible format precisely because it avoids that inference, but it can only be used where the investigation has withheld a detail that has not leaked, which in an Indian case with an active press is rarely true.

The Indian legal position in one paragraph. Selvi v. State of Karnataka, (2010) 7 SCC 263 held that the compulsory administration of a polygraph examination, along with narco-analysis and the brain electrical activation profile, violates Article 20(3) and Article 21; that even where the subject consents the results are not admissible, because he does not exercise conscious control over the responses; and that only material subsequently discovered with the help of a voluntary test may be proved, under s.27 of the Evidence Act, now the proviso to s.23(2) of the Bharatiya Sakshya Adhiniyam, 2023.

The National Human Rights Commission's Guidelines for the Administration of Polygraph Test (Lie Detector Test) on an Accused, 2000 must be strictly followed, including that the accused be given the option rather than required to submit and that his consent be recorded before a Judicial Magistrate with access to a lawyer. Amlesh Kumar v. State of Bihar, 2025 INSC 810, decided on 10 June 2025, reaffirmed all of this and added that an accused has no indefeasible right to demand the test and that its findings can never be the sole basis of conviction.

Where the boundary lies. Compelled fingerprints, handwriting specimens and, since s.349 of the Sanhita, voice samples are lawful, because State of Bombay v. Kathi Kalu Oghad, AIR 1961 SC 1808 held that furnishing such material is a mechanical act supplying material for comparison and is not "to be a witness". The polygraph falls on the other side because it reaches for the contents of the mind.

Conclusion. Forensic medicine applies medical knowledge to legal questions, its central operation being the medico-legal autopsy triggered by s.194 of the Sanhita, and its characteristic output is an estimate with a range: time since death from algor, rigor and livor mortis and stomach contents, age from dental eruption and epiphyseal fusion, and the classification of wounds as simple or grievous, all received as expert opinion under s.39 of the Sakshya Adhiniyam and, under Solanki Chimanbhai, ordinarily corroborative.

The portable bomb sniffer detects explosive vapour and trace by ion mobility spectrometry in seconds, detects the nitro-group explosives well, ammonium nitrate ambiguously and the peroxide explosives with difficulty, and proves nothing by itself: it generates the suspicion that justifies a search, with the confirmatory laboratory analysis carrying the evidential weight. The lie detector records arousal and not deception, and after Selvi and Amlesh Kumar it cannot be compelled, its results are inadmissible even on consent, and the only thing that survives into a trial is a discovery made in consequence of a voluntary test under the proviso to s.23(2) of the Sakshya Adhiniyam.

3.Forensic Ballistics a useful technique for Detection. Elaborate.[25]

Answer

For full marks, cover: the stem is a proposition, but note carefully what it claims. It says ballistics is useful for detection, and detection is the investigative stage, not the trial. So the weight of this answer belongs on what the science finds and how it directs an investigation, and the case law, which belongs to the prosecution stage, is worth perhaps five marks at the end. The second paper in this scan sets the same topic at Q10 with the words "detecting and prosecuting", and there the balance reverses. Reading the stem is worth as much here as knowing the subject.

What ballistics is, briefly

Internal or interior ballistics covers the ignition of the primer, the burning of the propellant, the build-up of pressure and the engagement of the bullet with the rifling, up to the muzzle. External ballistics covers the flight: trajectory, velocity, spin, drift and drop. Terminal ballistics covers the impact, and its medical branch, wound ballistics, the injury. Forensic ballistics applies all three to legal questions and is, in method, a branch of tool-mark examination: a firearm is a machine that unavoidably marks what passes through it.

How ballistics assists detection: seven contributions

One: it establishes that a firearm was used, and what kind. From a recovered bullet the examiner reads the class characteristics of the barrel that fired it: calibre, the number of lands and grooves, their widths and the direction and rate of twist. Those figures identify a class of weapon and exclude with certainty every weapon outside it, which is the one thing in the discipline that can be done without judgment. From a cartridge case the calibre and, from the head-stamp, the manufacturer and often the production lot can be read. From the injury alone, where nothing else is recovered, the character of the wound distinguishes a rifled weapon from a smoothbore.

At the detection stage this is the most valuable contribution of all, because it tells the investigator what he is looking for before he has found it. An investigator told that the weapon was a .32 revolver with six right-hand grooves is looking for a different object, in different hands, than one told the weapon was a country-made single-shot smoothbore.

Two: it establishes how many weapons and how many firers. Grouping the recovered bullets and cartridge cases by their class and individual characteristics establishes the number of weapons discharged. That frequently determines how many assailants there were, which shapes the whole investigation and is later central to any case of common intention.

Three: it establishes where the firer stood. The trajectory is reconstructed from the entry point, any intermediate damage such as a perforated door, windscreen or wall, and the resting place of the projectile, using rods, string, laser kits or photogrammetry. Added to that is the distribution of ejected cases, because a self-loading weapon throws them in a characteristic direction and to a characteristic distance. Together these test, at the earliest stage, whether the account being given by a complainant or by a suspect is physically possible.

Four: it establishes the range. Range is read from the residue pattern at the entry wound and is estimated by test-firing the same weapon with the same ammunition at measured distances on similar material.

At the detection stage range is decisive between the three explanations an investigator must choose among: suicide, which is almost always contact or near contact; homicide, usually at a distance; and accident.

Five: it establishes the direction. Entry is distinguished from exit by the inverted margins and abrasion collar of the entry against the everted margins and absence of any collar at the exit, subject to the shored exit wound exception where the exiting skin is supported by a firm surface and abrades against it. In the skull the answer is unambiguous, because a bullet entry shows internal bevelling and an exit external bevelling. Direction plus range is what converts a body into a reconstruction.

Six: it may identify the firer. Gunshot residue from the primer, consisting of characteristic spheroidal particles containing lead, barium and antimony together, is collected from the hands, face and clothing on adhesive stubs and examined by scanning electron microscopy with energy dispersive X-ray analysis. The older dermal nitrate or paraffin test is discredited, because nitrates are ubiquitous in fertiliser, tobacco, cosmetics and urine. Residue is fragile: it is lost within hours by washing, wiping and ordinary activity, it transfers from vehicles, handcuffs and officers who have fired, and it settles on bystanders, so it establishes proximity to a discharge rather than the act of firing. At the detection stage that is still useful, because it directs attention; at the trial stage it is the weakest class of firearm evidence.

Seven: it links scenes and weapons. Because the same weapon leaves the same striations, exhibits from separate offences can be linked to one weapon, which is the basis for a national firearms exhibit collection and is how a single weapon circulating within a gang is identified.

The identification itself

Where a weapon is recovered, the question becomes whether this weapon fired this bullet. The answer lies in the individual characteristics: the microscopic longitudinal striations left by the imperfections in that particular barrel, and, on the cartridge case, the firing pin impression, the breech face marks, and the extractor and ejector marks. The weapon is test-fired into a water tank or cotton box so that the test specimen is undeformed, and test and exhibit are compared on a comparison microscope, two microscopes joined by an optical bridge so that both appear side by side in one eyepiece divided by a hairline.

The smoothbore exception must be given because it dominates Indian practice: a shotgun or a country-made smoothbore imparts no striations to the shot at all, so bullet comparison is impossible and the examiner is confined to the cartridge case and the wads.

The prosecution stage, briefly, since the stem asks about detection

The opinion is relevant under s.39(1) of the Bharatiya Sakshya Adhiniyam, 2023; the report reaches the court under s.329 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Director, Deputy Director or Assistant Director of a Central or State Forensic Science Laboratory being a Government scientific expert under sub-section (4)(e); and by the second proviso to s.330 the expert is not called unless a party disputes the report. Under the Arms Act, 1959 the examiner also supplies the proof that the article is a firearm in working order, which ss.25 and 27 require.

The Indian authorities are consistent. Mohinder Singh v. State, AIR 1953 SC 415 held that where death is due to injuries caused by a lethal weapon it is the duty of the prosecution to prove by expert evidence that it was likely, or at least possible, for the injuries to have been caused with the weapon alleged and in the manner alleged. Sukhwant Singh v. State of Punjab, (1995) 3 SCC 367 held that where both the weapon and the crime cartridge are recovered the ballistic opinion is of considerable importance and its non-production affects the creditworthiness of the prosecution case to a great extent. Pritinder Singh @ Lovely v. State of Punjab, 2023 INSC 614 acquitted where the expert had not been examined at all.

Evaluating the proposition

The proposition is true and is more strongly true of detection than of proof, which is exactly the distinction the stem invites.

At the detection stage the science is genuinely powerful, because most of what it produces at that stage is exclusionary or directional rather than identificatory: the class characteristics tell the investigator what weapon to look for and exclude the wrong ones with certainty; the range tells him whether he is investigating a suicide; the trajectory tells him whether the complainant's account is possible; and the count of cases tells him how many people to look for. None of that requires a judgment about striations, and none of it can be wrong in the way an identification can.

At the proof stage the science is weaker than it appears, because the identification of a particular weapon rests on a judgment of sufficient agreement with no measured error rate, made by an examiner who knows which weapon the investigation favours and checked by a colleague who knows his conclusion; because barrels change with use and corrosion; because a bullet from a body is often too deformed to compare; and because smoothbore and country-made weapons, which dominate Indian firearm crime, leave nothing on the projectile at all.

Conclusion. Forensic ballistics is a useful technique for detection, and usefully so in seven specific ways: it establishes that a firearm was used and of what class, excluding wrong weapons with certainty from the class characteristics of calibre, land and groove count and twist; it establishes how many weapons were discharged and therefore how many assailants; it reconstructs the position of the firer from trajectory and case distribution; it estimates range from muzzle imprint, soot, blackening and tattooing, which is what separates suicide from homicide; it establishes direction from the abrasion collar and inversion of the entry against the eversion of the exit and from internal and external bevelling in bone; it may connect a person to a discharge through primer residue of lead, barium and antimony read by scanning electron microscopy; and it links separate scenes through the striations of a common weapon.

Its value at the detection stage rests largely on exclusion and direction, which are its most reliable operations. At the proof stage the identification of a particular weapon is a judgment without a measured error rate, and Indian law has treated the discipline accordingly, from Mohinder Singh in 1950 through Sukhwant Singh to Pritinder Singh @ Lovely in 2023, holding not that ballistic evidence proves guilt but that failing to obtain it, where the weapon and the cartridge are both in hand, damages the prosecution case severely.

4.Explain The Use Of Different Modern Devices In Crime Control And Prevention.[25]

Answer

For full marks, cover: the command is "explain the use", which invites a survey organised by purpose rather than a list followed by three expositions, and the stem pairs "crime control" with "prevention", which are different things and should be separated. Cover a good spread of devices with their uses, then take three far enough to attach a statute and a case, and close on the constitutional cost. The three taken here are the alternate light source, the narcotic field test kit and the breath analyser; the second paper in this scan sets the identical stem at Q8 and takes three different ones.

Prevention and control are different, and devices serve them differently

Prevention operates on the offender's calculation before the offence, by increasing the effort, increasing the perceived risk and reducing the reward. Control operates afterwards, by detecting the offence, identifying the offender and producing proof. A device excellent at one is frequently useless at the other: a visible camera deters well and identifies badly, while a genetic analyser identifies superbly and deters nobody.

The devices of prevention

Visible surveillance. Closed circuit television raises the perceived risk of detection where the camera is seen, which is classical situational crime prevention and works best against planned acquisitive offences at fixed locations. Automatic number plate recognition extends the same logic to vehicles.

Physical screening. Door frame and hand-held metal detectors and baggage X-ray scanners prevent by exclusion, keeping a weapon out of a protected space rather than detecting an offence. Portable explosive trace detectors, working by ion mobility spectrometry, do the same for explosive residue.

Automated enforcement. Radar and laser speed guns and red light violation detection systems prevent at a scale discretionary policing cannot reach, because they remove the possibility of negotiation at the roadside.

Environmental measures. Lighting, alarms, access control and the design of the built environment are the cheapest devices of all, need no statute and no expert, and are routinely omitted from answers to this question.

The devices of control

At the scene, the alternate light source, luminol, fingerprint powders and cyanoacrylate kits, ground penetrating radar for clandestine graves, thermal imaging, drones, and total stations and laser scanners for recording geometry. Their use is now partly compulsory: s.176(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 requires a forensic expert to visit the scene of every offence punishable with seven years or more, from a date the State notifies within five years, with videography of the collection, and ss.105 and 185 require the search and seizure process to be recorded by audio-video electronic means.

In the laboratory, the gas chromatograph with mass spectrometer, the high performance liquid chromatograph, the thermal cycler and capillary genetic analyser, the comparison microscope, the video spectral comparator, the electrostatic detection apparatus and the scanning electron microscope with energy dispersive X-ray analysis.

For identification and tracing, the automated fingerprint identification terminal linked to the National Automated Fingerprint Identification System, launched on 17 August 2022; iris and retina scanners; facial recognition; call data record and cell site analysis; and global positioning system trackers.

For digital examination, write blockers, forensic disk imagers and mobile device extraction systems, whose output enters evidence only through the certificate required by s.63(4) of the Bharatiya Sakshya Adhiniyam, 2023, held mandatory in Arjun Panditrao Khotkar v. Kailash Kushanrao Gorantyal, (2020) 7 SCC 1.

Against the investigators, closed circuit cameras in police stations, directed in Paramvir Singh Saini v. Baljit Singh, (2021) 1 SCC 184, and body-worn cameras.

And two that control nothing: the polygraph and the brain electrical activation profile apparatus, whose results Selvi v. State of Karnataka, (2010) 7 SCC 263 held inadmissible even on consent.

1. The alternate light source

What it is. A high-intensity lamp with selectable output wavelengths, from ultraviolet through violet, blue, green and orange into the infrared, used with matching viewing filters or goggles that block the illuminating wavelength so that only the emitted fluorescence reaches the eye.

How it works and what it finds. Many substances of forensic interest absorb light at one wavelength and re-emit it at a longer one. Illuminated at the absorbing wavelength and viewed through a filter that removes it, such a substance glows against a dark background. In practice the instrument locates semen, saliva and urine on bedding, clothing and upholstery where nothing is visible; fibres against a contrasting background; bruising in the infrared before it is visible to the eye; and treated fingerprints, since most modern development reagents are chosen for their fluorescence. In document work it separates inks, reveals erasures and checks security features.

Its use in the process. It is a searching instrument, used at the earliest stage to decide what to sample. Everything it finds is presumptive: detergents, lubricants and some foods fluoresce at the same wavelengths as semen, so the result directs a swab and nothing more. Confirmation is by acid phosphatase and prostate specific antigen for semen and by amylase for saliva. An investigator who describes an alternate light source as having "found semen" has overstated the result, and that overstatement is a standard and effective line of cross-examination.

Its legal setting. It operates at the scene, which s.176(3) of the Sanhita now regulates, and whatever it reveals must be photographed as it appears, because the fluorescence exists only while the lamp is on. The findings enter evidence as expert opinion under s.39(1) of the Sakshya Adhiniyam, with the grounds relevant under s.45.

Its limits. Fluorescence is not specific; short-wave ultraviolet degrades the DNA in the very stain it reveals, so exposure is minimised; and UVC is hazardous to the examiner's eyes and skin.

2. The narcotic field test kit

What it is. A field test kit is a set of sealed ampoules of colour-forming reagents in a plastic pouch. A few grains of the suspect substance are introduced, the ampoules are crushed in sequence, and the colour produced indicates a class of drug. The classical reagents are Marquis, which gives purple to black with opiates and orange to brown with amphetamines; Mecke and Mandelin for opiates and related compounds; Scott's reagent, or cobalt thiocyanate, which gives a characteristic blue for cocaine; and the Duquenois-Levine test for cannabis.

What it is for. It converts an officer's suspicion at the roadside into a defensible basis for arrest and seizure, and it does so in under a minute at a cost of a few rupees. That is a real contribution to control, because the alternative is either to arrest on suspicion alone or to let the person go while the substance is sent away.

What it is not. It is presumptive only. It reports a colour reaction consistent with a class of substance; it does not identify the drug, does not measure purity and does not exclude adulterants that give the same colour. Confirmation is by gas chromatography with mass spectrometry at a Central or State Forensic Science Laboratory, which separates the mixture by retention time and identifies each component by its fragmentation pattern.

The legal setting, which is where the marks are. Under the Narcotic Drugs and Psychotropic Substances Act, 1985, punishment is graded by quantity, small, intermediate and commercial, and the difference between the bands is the difference between a year and twenty years. Two points must be given.

First, on what is weighed: E. Micheal Raj v. Intelligence Officer, Narcotic Control Bureau, (2008) 5 SCC 161 held that in a mixture of a narcotic drug with a neutral substance it is the actual content by weight of the offending drug that determines the band. That decision was overruled by a three-judge Bench in Hira Singh v. Union of India, (2020) 20 SCC 272, decided on 22 April 2020, which held that the total weight of the mixture, including the neutral substance, is what counts, reasoning that any other construction would let an offender escape the commercial band by diluting. Textbooks still state E. Micheal Raj as good law and it is not.

Second, on how the sample is taken: s.52A of the NDPS Act governs the inventory, sampling and disposal of seized drugs, and in Union of India v. Mohanlal, (2016) 3 SCC 379, decided on 28 January 2016, the Supreme Court directed that the application to the Magistrate be moved immediately after seizure, that the drawing of samples take place in the presence and under the supervision of the Magistrate, who must certify the entire exercise as correct, and that seized drugs be stored in safes and vaults under the personal supervision of a gazetted officer. Sampling in the presence of a gazetted officer alone is not compliance. Delay and non-compliance with s.52A have produced bail and acquittal repeatedly.

Its limits. False positives are common: Marquis reacts with a range of unrelated compounds, and Duquenois-Levine reacts with several plant materials. The reagents are corrosive and degrade with heat and age, which matters in Indian field conditions. And the kit consumes sample, so a small seizure can be diminished by testing it.

3. The breath analyser

What it is. A breath analyser measures ethanol in deep lung air and converts it to an estimate of blood alcohol concentration by a fixed partition ratio. The fuel cell type oxidises ethanol at an electrode and measures the current produced, which is specific to alcohol and is used in evidential instruments; the infrared absorption type measures absorption at wavelengths characteristic of ethanol; cheap semiconductor sensors are used in screening devices and are the least reliable.

The statutory framework. Section 185 of the Motor Vehicles Act, 1988 makes it an offence to drive or attempt to drive with alcohol exceeding thirty milligrams per hundred millilitres of blood, detected in a test by a breath analyser or in any other test including a laboratory test, or while under the influence of a drug to such an extent as to be incapable of exercising proper control.

The Motor Vehicles (Amendment) Act, 2019 fixed the penalty at imprisonment up to six months or a fine up to ten thousand rupees or both for a first offence, and up to two years or fifteen thousand rupees or both for a subsequent offence within three years. Sections 203 to 205 supply the procedure: a police officer in uniform may require a breath specimen where he has reasonable cause to suspect alcohol or after an accident; refusal without reasonable excuse permits arrest and a requirement to provide a specimen for laboratory test; and where a refusal is proved the court may presume that the person was under the influence.

What it changed. Before the device, intoxication was proved by the officer's impression of the driver's condition, which is contestable and unquantified. The breath analyser replaces that with a number and the statute fixes the threshold, so the issue at trial becomes whether the instrument was in order and the procedure followed, which is a far more tractable question and is why enforcement at scale became possible.

Its limits. The partition ratio between breath and blood varies between individuals and within the same individual, so the conversion is an approximation. Residual mouth alcohol, from a recent drink, from regurgitation or from a mouth spray, produces a falsely high reading, which is why a waiting period before the test is part of correct procedure. Some semiconductor sensors respond to acetone, which is elevated in uncontrolled diabetes. And the reading is a measurement at the time of the test, not at the time of driving, so absorption or elimination in the interval must be accounted for.

The cost

The identification and tracing devices together amount to a capacity for continuous identification of a population. Under s.4(2) of the Criminal Procedure (Identification) Act, 2022, records of measurements are retained for seventy-five years, with destruction available only to a person not previously convicted who is released without trial, discharged or acquitted after exhausting all remedies, and even then subject to the court directing otherwise. That has never been tested against the proportionality requirement in K.S. Puttaswamy v. Union of India, (2017) 10 SCC 1, and the Digital Personal Data Protection Act, 2023 exempts policing by s.17(1)(c) and notified State instrumentalities by s.17(2)(a).

Conclusion. Modern devices serve prevention through visible surveillance, physical screening, automated enforcement and environmental design, and serve control through scene devices whose use s.176(3) of the Sanhita now makes compulsory in serious cases, laboratory instruments whose reports enter evidence under ss.329 and 330, national identification systems built on the Criminal Procedure (Identification) Act, 2022, and digital tools whose output passes the certificate of s.63(4) of the Sakshya Adhiniyam.

Of the three examined, the alternate light source finds what the eye cannot and produces a strictly presumptive result requiring confirmation by acid phosphatase, prostate specific antigen or amylase; the narcotic field test kit converts suspicion into a lawful seizure and produces a colour reaction, not an identification, and delivers its exhibit into the s.52A regime enforced in Union of India v. Mohanlal and the quantity rule as changed by Hira Singh; and the breath analyser replaced an officer's impression with a statutory threshold of thirty milligrams per hundred millilitres under s.185 of the Motor Vehicles Act, 1988. In each case the instrument is worth what the procedure around it is worth, and the seventy-five year retention rule in the 2022 Act remains the largest untested constitutional question in the whole apparatus.

5.Forensic Science Laboratories plays vital role in modern ways of investigations Of Crimes.[25]

Answer

For full marks, cover: this is a proposition and the operative words are "modern ways of investigation". The examiner is not asking what a laboratory is; he is asking whether the way Indian crime is now investigated genuinely depends on laboratories. So the answer should identify what has actually changed about investigation, show where the laboratory sits in the new arrangement, and then test whether "vital" is accurate. The honest answer is a qualified yes with a sharp sting: the law has made the laboratory central and the system has not yet made it capable, and the recent Supreme Court decisions are about that gap.

What has changed about the way crimes are investigated

Three changes define the modern Indian investigation and each of them puts weight on the laboratory.

The collapse of oral evidence. Indian trials have long been undermined by witnesses who turn hostile, who cannot be traced, or whose evidence is disbelieved for delay and improvement. Scientific evidence does not turn hostile, has no relationship with either party and does not forget, and investigations have shifted towards it for that reason alone.

The statutory turn to forensics. Section 176(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 now requires that, on information of every offence punishable with seven years or more, the officer in charge of the police station shall, from such date as may be notified within a period of five years by the State Government, cause the forensic expert to visit the crime scene to collect forensic evidence and cause videography of the process; where the facility does not exist in the State, the State Government must notify the use of another State's facility. Section 51 brings DNA profiling expressly into the medical examination of an arrested person, s.349 allows a Magistrate to compel specimen signatures, finger impressions, handwriting and voice samples, and the Criminal Procedure (Identification) Act, 2022 allows the taking of iris and retina scans, biological samples and behavioural attributes.

The arrival of a national informational layer. The National Automated Fingerprint Identification System, launched on 17 August 2022, the Crime and Criminal Tracking Network and Systems, and the Inter-operable Criminal Justice System connect what a laboratory produces in one State to what is known in another.

Where the laboratory sits in that arrangement

The Indian network consists of seven Central Forensic Science Laboratories under the Directorate of Forensic Science Services of the Ministry of Home Affairs, at Kolkata, which is the oldest and a centre of excellence in the biological sciences, Hyderabad in the chemical sciences, Chandigarh in the physical sciences, New Delhi, which is under the administrative control of the Central Bureau of Investigation, and Guwahati, Bhopal and Pune, established as Central Forensic Institutes in 2011 and notified in 2013; three offices of the Government Examiner of Questioned Documents at Shimla, Kolkata and Hyderabad; the Central Finger Print Bureau under the National Crime Records Bureau; and a State Forensic Science Laboratory in every State with regional and district laboratories beneath it. Training and higher education were consolidated by the National Forensic Sciences University Act, 2020.

Its divisions answer the questions a modern investigation asks: biology and serology, DNA, chemistry and toxicology, narcotics, explosives, physics and ballistics, questioned documents, cyber and digital forensics, and photography and scene reconstruction.

Its output reaches a court through s.39 of the Bharatiya Sakshya Adhiniyam, 2023, which makes expert opinion relevant and, by the new sub-section (2), makes the Examiner of Electronic Evidence an expert; and through s.329 of the Sanhita, under which a report of a Government scientific expert, including the Director, Deputy Director or Assistant Director of a Central or State Forensic Science Laboratory under sub-section (4)(e), may be used as evidence, with the second proviso to s.330 relieving the expert of attendance unless a party disputes the report and s.336 allowing the successor in the post to depose where the analyst has moved on.

The case for the proposition

One: in a large class of modern cases the laboratory produces the only evidence there is. In a sexual offence with no witness, in a poisoning, in a narcotics prosecution, in a firearm death and in almost every cyber offence, the case exists only because a laboratory reported something. That is a stronger claim than "the laboratory assists"; it is a claim that without the laboratory the offence is unprovable.

Two: the statute has made the laboratory an actor in the investigation, not merely a service to it. Before s.176(3), the laboratory received what the police chose to send. After it, in every offence punishable with seven years or more, a forensic expert attends the scene and the collection is videographed. That is a change of role, and it addresses the failure that has actually destroyed Indian prosecutions.

Three: courts now measure investigations against forensic standards. Sukhwant Singh v. State of Punjab, (1995) 3 SCC 367 held that where injuries are caused by a firearm and both the weapon and the crime cartridge are recovered, the ballistic opinion is of considerable importance and its non-production affects the creditworthiness of the prosecution case to a great extent; Pritinder Singh @ Lovely v. State of Punjab, 2023 INSC 614 applied that to acquit, calling the failure to examine the ballistic expert a glaring defect. Not using the laboratory is now itself a defect in the investigation.

The case against, which is where the answer earns its marks

One: capacity. The duty in s.176(3) attaches to a very large fraction of the serious criminal docket, and the trained personnel available to discharge it are a fraction of what it implies. The five-year notification window and the express power to borrow another State's facility are the statute's own admission of the gap. Pendency of exhibits in State laboratories is measured in months and in some divisions in years.

Two: the laboratories are not regulated. There is no Indian statute prescribing accreditation, proficiency testing, method validation or error-rate reporting for forensic laboratories. The DNA Technology (Use and Application) Regulation Bill, 2019, which would have created a DNA Regulatory Board with power to accredit and to set standards, was withdrawn from the Lok Sabha in July 2023 and has not been reintroduced. So the institution the statute has made central is the one institution in the chain that answers to no standards body.

Three: what the laboratory produces is only opinion. Ramesh Chandra Agrawal v. Regency Hospital Ltd., (2009) 9 SCC 709 holds that opinion evidence is advisory and the court is not bound by it, and Pattu Rajan v. State of Tamil Nadu, (2019) 4 SCC 771 applies that even to DNA, treating it as opinion evidence like ballistics, fingerprints and handwriting. Solanki Chimanbhai Ukabhai v. State of Gujarat, (1983) 2 SCC 174 holds that medical evidence is ordinarily corroborative and displaces eyewitness testimony only where it excludes the eyewitness account altogether.

Four, and decisively: the modern failures have been failures at the laboratory's door. In Rahul v. State of Delhi (NCT of Delhi), 2022 LiveLaw (SC) 926, decided on 7 November 2022, the samples in the Chhawla case lay in police custody for about two months with nothing recorded about their preservation; the Supreme Court declined to act on the DNA reports and set aside three death sentences.

In Kattavellai @ Devakar v. State of Tamil Nadu, 2025 INSC 845, decided on 15 July 2025, samples taken on 19 May 2011 reached the laboratory only on 29 June 2011, a forty-one day gap the prosecution could not explain; the Court acquitted a man under sentence of death and issued binding nationwide directions requiring documented packaging with the FIR number and date, the section and statute, the investigating officer and police station details and a serial number, signatures of the medical professional and independent witnesses, delivery to the laboratory within forty-eight hours with written reasons for any delay, a Chain of Custody Register signed by every handler and forming part of the trial record, and no opening or resealing of a sealed package without the trial court's permission.

The verdict

The proposition is true, and the qualification is the interesting part.

Forensic science laboratories are vital to modern investigation in the strict sense that a large and growing class of offences cannot be proved without them, and the Sanhita has now made their attendance at the scene a statutory duty in every serious case. To that extent the word "vital" is accurate rather than rhetorical.

But the laboratory's centrality has run ahead of two things. It has run ahead of capacity, which is why the statute phases the duty over five years and permits States to borrow. And it has run ahead of regulation, which is why India has no accreditation statute after the withdrawal of the DNA Bill in July 2023, and why the Supreme Court had to supply in Kattavellai the packaging, transmission and chain of custody standards that legislation had not.

The proper conclusion is therefore that the laboratory is vital to the modern method of investigation and is not yet reliable enough to bear the weight the method places on it, and that the gap is being closed by judicial direction rather than by statute.

Conclusion. Modern Indian investigation has moved from oral evidence to physical trace, and the law has moved with it: s.176(3) of the Sanhita now requires a forensic expert at the scene of every offence punishable with seven years or more, s.51 brings DNA profiling into the examination of an arrested person, s.349 permits compelled voice samples, and the Criminal Procedure (Identification) Act, 2022 permits iris and retina scans and biological samples.

In that arrangement the laboratory is vital, because in sexual offences, poisoning, narcotics, firearm deaths and cyber offences it produces the only evidence there is, and because Sukhwant Singh and Pritinder Singh @ Lovely make the failure to use it a defect in itself. The qualification is that its centrality exceeds both its capacity, which the five-year notification window in s.176(3) concedes, and its regulation, which does not exist at all after the DNA Bill was withdrawn in July 2023, and that the standards it works to were supplied not by Parliament but by the Supreme Court in Kattavellai on 15 July 2025.

For full marks, cover: read the stem carefully, because it is not the plain history question. It asks for a note on forensic science, with emphasis on the historical perspective and development. So the answer must define the subject, state its nature, scope, principles and objectives, and then carry the historical material as the explanation of how it came to have that shape. The second paper in this scan sets the plain history question at Q13 as a detailed account, and that answer is a chronology. Here, the history is the emphasis and not the whole.

What forensic science is

Forensic science is the application of scientific knowledge, principles and methods to questions arising in the administration of justice. The adjective comes from the Latin forensis, of or belonging to the forum, the place where legal disputes were argued at Rome, and the etymology carries the essential point: this is not a science defined by its subject matter but by its audience. Chemistry becomes forensic chemistry not because different chemistry is done but because the result is destined for a tribunal and will be attacked there.

Its nature, which the history explains

Five features define it, and each of them was acquired at an identifiable point in its history, which is why a historical treatment explains the subject better than a definitional one.

It is applied and not pure: it takes settled knowledge and asks it a question about a particular event.

It is comparative: almost every forensic question reduces to whether one thing came from the same source as another, this bullet and this barrel, this mark and this finger, this profile and this person. That is why the reference sample matters more than the instrument.

It is interdisciplinary: one case may need chemistry, biology, physics, medicine, engineering, computing and statistics.

It is probabilistic: a DNA profile is reported as a random match probability, a fibre comparison as consistency, and even a fingerprint identification is a judgment about sufficiency. Very little of it produces categorical certainty.

And it is adversarial in design: its documents are written to survive attack, which is why the sealing, the packaging, the register and the note of quantity consumed are part of the science and not administrative decoration.

The historical perspective: how the subject acquired its branches

Legal medicine came first, and by a long way. Kautilya's Arthashastra, of about the fourth century before the common era, treats the investigation of sudden death and the detection of poisoning. Song Ci's Xi Yuan Ji Lu, "The Washing Away of Wrongs", written in China in 1247, is the oldest systematic text anywhere, distinguishing drowning from strangulation and describing wounds inflicted before and after death. Ambroise Paré in the sixteenth century and Paolo Zacchia, whose Quaestiones Medico-Legales founded the European subject in the seventeenth, complete the antecedents.

Toxicology was the first branch to become a laboratory science, and the reason matters. Poisoning was the offence that could least be proved by witnesses, so it was the offence that most needed a chemist. Mathieu Orfila's Traité des poisons of 1814 studied poisons systematically and insisted that a detection method be validated before being used against a person, which is the ancestor of the modern reliability requirement. His evidence in the Marie Lafarge trial of 1840 demonstrated arsenic in exhumed tissue and showed publicly that a laboratory could prove a murder. India's earliest forensic institutions follow that pattern exactly: the Chemical Examiner's Laboratory at Madras in 1849, with Calcutta 1853, Agra 1864 and Bombay 1870, all toxicological, which is why the Chemical Examiner still stands first in the list of Government scientific experts in s.329(4)(a) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Identification was the second branch, and India led it. Alphonse Bertillon's anthropometry, introduced at Paris in 1879, reached India as the Anthropometric Bureau at Calcutta in 1892 and failed because its eleven measurements were not reproducible between operators, demonstrated conclusively in 1903 by the two unrelated prisoners named West at Leavenworth. Fingerprints replaced it: William Herschel at Jungipoor in Bengal from 1858 established permanence, Henry Faulds proposed criminal use in Nature in 1880, and Francis Galton established individuality statistically in 1892. Then, in 1897, the world's first Fingerprint Bureau was established at Writers' Building, Calcutta, and the classification named after Edward Richard Henry, used across the world for a century, was substantially the work of two Indian sub-inspectors, Azizul Haque and Hem Chandra Bose.

Criminalistics, meaning the systematic use of the scene itself, was the third. Hans Gross, an Austrian examining magistrate, published his Handbuch für Untersuchungsrichter in 1893, the first work to set out how an investigation should use scientific assistance. Edmond Locard opened the first police laboratory at Lyon in 1910 and formulated the exchange principle, which turned the scene from a place where objects are found into a place where traces are collected.

Serology followed immediately, with Karl Landsteiner's ABO groups and Paul Uhlenhuth's precipitin test, both in 1901, which for the first time allowed a stain to be shown to be human blood. India built a Serology Department at Calcutta in 1910, and a Government Examiner of Questioned Documents at Shimla in 1906, the first document unit in the country, followed by Kolkata in 1964 and Hyderabad in 1968.

Firearms examination was systematised by Calvin Goddard in the United States in the 1920s using the comparison microscope, and was established publicly by his examination of the cartridge cases from the St Valentine's Day massacre of 1929.

Molecular biology completed the set. Alec Jeffreys discovered in 1984 at Leicester that certain repetitive regions of DNA vary enough between individuals to identify them, and in the Enderby investigation of 1986 to 1988 the technique first exonerated a young man who had confessed and then convicted Colin Pitchfork, the first person in the world convicted on DNA evidence. India developed an indigenous probe at the Centre for Cellular and Molecular Biology, Hyderabad, in 1988 under Dr Lalji Singh, the third country in the world to do so, and the technique was accepted by an Indian court in Kunhiraman v. Manoj, II (1991) DMC 499.

The scope and objectives the history produced

The scope of the modern subject is the set of branches the history created: forensic medicine, toxicology, biology and serology, DNA, chemistry, narcotics, explosives, physics and ballistics, questioned documents, fingerprints and other impressions, anthropology and odontology, and, most recently and fastest growing, digital and cyber forensics.

Its objectives are conventionally five: identification, what a thing is; individualisation, whose it is; association, linking a person to a place, a victim or an object; reconstruction, establishing the sequence of events; and exoneration, eliminating the innocent, which the discipline does more reliably than it convicts and which its own history illustrates, since DNA's first criminal act was an exoneration.

Development in India since independence, and the present phase

The post-independence Indian development is institutional and then legislative. State Forensic Science Laboratories were built from the 1950s; the Central Bureau of Investigation was created in 1963 with its own laboratory; and the Directorate of Forensic Science Services under the Ministry of Home Affairs now controls seven Central Forensic Science Laboratories at Kolkata, Hyderabad, Chandigarh, New Delhi, Guwahati, Bhopal and Pune. The National Forensic Sciences University Act, 2020 merged the Gujarat Forensic Sciences University at Gandhinagar with the Lok Nayak Jayaprakash Narayan National Institute of Criminology and Forensic Science at Rohini into an Institution of National Importance.

The present phase is legislative. The Criminal Procedure (Identification) Act, 2022, in force from 4 August 2022, repealed the Identification of Prisoners Act, 1920 and widened "measurements" to include iris and retina scans, biological samples and behavioural attributes, retained for seventy-five years. The Bharatiya Nagarik Suraksha Sanhita, 2023 and the Bharatiya Sakshya Adhiniyam, 2023, in force from 1 July 2024, require a forensic expert at the scene of every offence punishable with seven years or more under s.176(3), bring DNA profiling into s.51, allow compelled voice samples under s.349, widen the expert provision by the words "or any other field" in s.39(1) and create the Examiner of Electronic Evidence in s.39(2).

Against that, the DNA Technology (Use and Application) Regulation Bill, 2019 was withdrawn from the Lok Sabha in July 2023, so India has no statute regulating the accreditation or standards of its forensic laboratories, and the Supreme Court supplied the missing standards itself in Kattavellai @ Devakar v. Forensic science is the application of scientific method to questions the law must answer, and it is applied, comparative, interdisciplinary, probabilistic and adversarial in design, resting on Locard's exchange principle and on the principles of individuality, comparison, analysis, progressive change and probability.

Its historical perspective explains that shape: legal medicine from Kautilya and Song Ci; toxicology as the first laboratory branch, founded by Orfila in 1814 and reflected in India by the Chemical Examiner's Laboratory at Madras in 1849; identification, where Bertillon's anthropometry failed on reproducibility and fingerprints succeeded, with the world's first bureau at Calcutta in 1897 and the Henry classification largely the work of Azizul Haque and Hem Chandra Bose; criminalistics from Gross in 1893 and Locard's Lyon laboratory in 1910; serology from Landsteiner and Uhlenhuth in 1901; firearms from Goddard in the 1920s; and DNA from Jeffreys in 1984, which exonerated before it convicted. For full marks, cover: the stem names functions first and role second, so lead with the functions, which are concrete, and treat the role, which is conceptual, as the frame. The second paper in this scan sets the near-identical stem at Q12, and that answer leads with the role and works outward into the transnational crime types; this one leads with the machinery. Whichever way round, the answer must open by disposing of the misconception that INTERPOL is a police force, and must close on India and on the criticism, because those are the two places a postgraduate examiner looks for something beyond a textbook summary.

The organisation in one paragraph

The International Criminal Police Organization has 196 member countries, its headquarters at Lyon in France, and no police powers whatever. It was founded at Vienna in 1923 as the International Criminal Police Commission, was captured and discredited during the Second World War, was reconstituted in 1946 and adopted its present name and Constitution in 1956. India joined on 15 October 1949 and was not a founding member. It cannot investigate, cannot arrest, has no territory and no jurisdiction, and cannot compel any member to do anything. What it runs is a network, a set of databases, a notice system, specialist operational units and a training programme.

The four functions

Function one: secure global police communications. The I-24/7 network is an encrypted system connecting the National Central Bureau of every member country to every other and to the General Secretariat, over which a request can be sent and answered in minutes, and to which, in many countries, front-line units and immigration posts have direct access. This is the foundational function: the databases and the notices are useless without a channel that works at police speed rather than at diplomatic speed.

Function two: operational data services. The organisation maintains databases on wanted persons; on stolen and lost travel documents, which by volume is the most consulted product it has and is queried at borders across the world; on stolen motor vehicles; on stolen works of art; on fingerprints and DNA profiles; on firearms and firearm traces; on child sexual abuse material; and on maritime piracy. The important qualification, which distinguishes a good answer, is that INTERPOL contributes nothing to these databases itself: every record was supplied by a member country, so coverage is as uneven as the willingness of members to share.

Function three: operational police support. Specialist units address counter-terrorism, organised and emerging crime, cybercrime, financial crime and corruption, fugitive investigation, trafficking in human beings and the smuggling of migrants, environmental and wildlife crime, and illicit and counterfeit goods. The organisation deploys an Incident Response Team at a member's request after a major crime or disaster, supplying investigative, analytical and forensic assistance on the ground. Its Disaster Victim Identification guide is the internationally accepted standard for mass fatality identification and rests on three primary identifiers, fingerprints, dental records and DNA, with secondary identifiers such as medical findings, tattoos and personal effects used in support. That standard is the point at which this question connects to the rest of the syllabus, because it is forensic practice mandated by an international body rather than by any national law.

Function four: police capability building and training. The organisation trains national investigators in transnational technique, which changes what those forces can do permanently rather than resolving a single case. It is the least visible and the most durable of the four.

The structure that delivers the functions

The General Assembly of all members meets annually, sets policy, approves the budget and elects the officers. The Executive Committee, headed by the President, supervises execution of its decisions between sessions. The General Secretariat at Lyon, under the Secretary General, is the permanent administration, with regional bureaus and a Global Complex for Innovation at Singapore for cybercrime and research. The National Central Bureau in each country is the single point of contact, staffed by that country's own officers under that country's own law, and in India it is the Central Bureau of Investigation. The Advisers act consultatively, and the Commission for the Control of Files independently supervises the processing of personal data and is the only body to which an individual may apply for correction or deletion of data held about him.

Article 2 of the Constitution defines the object as ensuring and promoting the widest possible mutual assistance between criminal police authorities within the limits of the laws existing in the different countries and in the spirit of the Universal Declaration of Human Rights. Article 3 forbids the Organization strictly from undertaking any intervention or activities of a political, military, religious or racial character.

The role, and its limit in India

The role follows from the structure: INTERPOL exists because criminal jurisdiction is territorial and criminals are not, and because a supranational police force is politically unavailable. Its role is to enable national forces, and it does nothing itself.

Indian law fixes that limit precisely. In Bhavesh Jayanti Lakhani v. State of Maharashtra, (2009) 9 SCC 551, the appellant was alleged to have removed a child in breach of foreign custody orders, warrants had issued abroad and a Red Corner Notice had been published, and the Maharashtra police proceeded as though the notice authorised them to act. The Supreme Court held that the mere issuance of a Red Corner Notice is not sufficient for the arrest of a person in India; that a person cannot be surrendered unless the procedure under the Extradition Act, 1962 is set in motion, the municipal law of a country reigning supreme in matters of extradition; and that where a citizen's fundamental right is infringed the High Court will not turn him away merely because a notice has been issued, the superior courts being entitled to enquire into how it came to be issued and whether the local police are threatening an arrest they have no power to make.

The practical Indian sequence is therefore: a Red Notice through NCB-New Delhi to locate; then extradition under the 1962 Act, which requires a treaty or arrangement and is slow, or deportation where the host State's immigration law permits; with the Fugitive Economic Offenders Act, 2018 applying domestic pressure by allowing a Special Court to declare a person a fugitive economic offender and confiscate his property.

The criticism

Article 3 cannot be enforced against a determined State, because the organisation must judge political motivation on the material the requesting State supplies. Notices and diffusions have been used against dissidents, journalists and refugees, and the reforms of the last decade, a task force reviewing requests before publication and a Commission for the Control of Files empowered to order deletion, reduce the abuse without curing its cause.

The consequences precede any adjudication. A person subject to a Red Notice may be detained at borders, refused visas and excluded from banking before any court examines the merits, and his only direct remedy is to an internal Commission.

Nothing works without members. The databases hold what States contribute; cooperation in any particular case is voluntary; and where a State declines, the organisation has no remedy at all.

The instrument the functions feed into: the Extradition Act, 1962

The four functions above all end at the same place, which is a national legal process, and in India that process is the Extradition Act, 1962. An answer that stops at the notice has stopped one step early, and two Supreme Court decisions supply the step.

Daya Singh Lahoria v. Union of India, (2001) 4 SCC 516, decided on 17 April 2001, settles the rule of specialty. The petitioner had been extradited to India from the United States, and the Indian courts sought to try him for offences not mentioned in the extradition decree. The Supreme Court held that a fugitive brought into a country under an extradition decree can be tried only for the offences mentioned in the decree and for no other offence, and that the criminal courts have no jurisdiction over anything else until he has been returned to the surrendering State or given the opportunity to return. The doctrine is embodied in s.21 of the Act.

Its practical importance for the topic is that it determines what the whole apparatus of notices and databases is ultimately worth. Locating a fugitive quickly is of no value if the request under which he is surrendered has been drawn too narrowly, because the trial cannot afterwards be widened. The speed of I-24/7 and the reach of the notice system therefore have to be matched by care in the paperwork of the requesting State, which is entirely outside INTERPOL's control.

Abu Salem Abdul Kayyum Ansari v. State of Maharashtra, 2022 INSC 671 supplies the second constraint. The appellant was extradited from Portugal in 2005 after the Government of India gave a solemn assurance to the Portuguese authorities that he would not be sentenced to death and would not be imprisoned beyond twenty-five years, Portuguese law forbidding surrender in the absence of such an assurance. When the question arose on his conviction in India, the Supreme Court held that the judiciary is bound to honour the sovereign assurance given by the executive, so his imprisonment could not exceed twenty-five years, and that the period of custody in Portugal was to be set off.

That decision illustrates a feature of transnational cooperation which the description of INTERPOL's functions conceals. Cooperation is not free. A State that wants a fugitive must accept the conditions of the State that holds him, and those conditions bind its own courts afterwards. The organisation's function is to make the request possible and fast; the terms of it belong to two sovereigns and to nobody else.

Conclusion. INTERPOL's functions are four: the secure I-24/7 communications network linking the National Central Bureaus of 196 members; the operational databases, of which the stolen and lost travel documents database is the most consulted and to which the organisation itself contributes nothing; operational police support through specialist units, Incident Response Teams and the Disaster Victim Identification standard resting on fingerprints, dental records and DNA; and capability building. They are exercised publicly through the system of eight notices.

Its role is to enable national police forces across a world in which criminal jurisdiction is territorial and criminals are not, and it exercises no power of its own, a limit which in India is fixed by Bhavesh Jayanti Lakhani, holding that a Red Corner Notice is not sufficient for an arrest and that surrender depends on the Extradition Act, 1962. Its structural weaknesses, that Article 3 must be applied on the requesting State's own account and that a notice's consequences fall on an individual before any court reviews them, are the price of the design that made the organisation acceptable to States in 1923 and again in 1956.

For full marks, cover: the identical stem is set at Q4 of the first paper in this scan, where the survey is organised by prevention against control and the three devices explained are the alternate light source, the narcotic field test kit and the breath analyser. This answer organises the survey by what the device does to information, which is the other useful cut, and explains three different devices: the automated fingerprint identification terminal, the gas chromatograph with mass spectrometer and the closed circuit television camera. The survey: five things a device can do to information

It can create information that did not exist. A camera, a body-worn camera, a call data record, a global positioning system tracker and an automatic number plate recognition system all generate a record of an event that would otherwise have left none.

It can reveal information that existed but was invisible. Luminol, the alternate light source, ultraviolet and infrared examination, the video spectral comparator, the electrostatic detection apparatus and ground penetrating radar all make visible something already present.

It can identify what a thing is. The gas chromatograph with mass spectrometer, the high performance liquid chromatograph, the Fourier transform infrared spectrometer, the atomic absorption spectrophotometer and the narcotic field test kit all answer the question "what is this".

It can decide whether two things share a source. The comparison microscope, the capillary genetic analyser, the scanning electron microscope with energy dispersive X-ray analysis and every fingerprint comparison answer "did these come from the same place".

It can connect a thing to a record already held. The automated fingerprint identification terminal, iris and retina scanners, facial recognition systems and the databases behind them answer "have we seen this before".

Two devices do none of the five in any usable way: the polygraph and the brain electrical activation profile apparatus, whose results Selvi v. State of Karnataka, (2010) 7 SCC 263 held inadmissible even where the subject consents.

1. The automated fingerprint identification terminal

What it does. It captures a ten-print set or a chance mark, extracts the minutiae, ridge endings, bifurcations, dots, lakes, spurs, bridges and crossovers, together with their relative positions and orientations, encodes them, and searches the encoding against a database, returning a ranked candidate list.

The point that carries the marks. The system does not identify anybody. It returns candidates ordered by similarity, and the identification is made afterwards by a human examiner working on the images by the ACE-V method: analysis of the questioned mark for suitability, comparison with the known print, evaluation to a conclusion of identification, exclusion or inconclusiveness, and verification by a second examiner. A candidate who writes that the system identifies the offender has misdescribed it and has also lost the criticism, because the criticisms of fingerprint evidence all attach to the human stage.

The Indian system. The National Automated Fingerprint Identification System was launched by the National Crime Records Bureau on 17 August 2022. It assigns each arrested person a ten-digit National Fingerprint Number, is integrated with the Crime and Criminal Tracking Network and Systems, and makes a chance mark lifted in one State searchable against records created in another, which is what makes it useful against the inter-State offender who is a stranger everywhere he works.

The legal setting. Expert opinion on the identity of finger impressions is relevant under s.39(1) of the Bharatiya Sakshya Adhiniyam, 2023, which names finger impressions expressly, with the grounds relevant under s.45. The Director of the Finger Print Bureau is a Government scientific expert under s.329(4)(c) of the Bharatiya Nagarik Suraksha Sanhita, 2023, so the report may be used as evidence, and by the second proviso to s.330 the expert is not called unless a party disputes it.

Specimens are compellable: s.349 allows a Magistrate of the first class to order any person, including one not arrested, to give specimen finger impressions for reasons recorded in writing, and the Criminal Procedure (Identification) Act, 2022, in force from 4 August 2022, brings finger, palm and foot impressions within "measurements" in s.2(1)(b), permits their taking under s.3 and a Magistrate's direction under s.5, and requires retention by the National Crime Records Bureau for seventy-five years under s.4(2). The constitutional basis is State of Bombay v. Kathi Kalu Oghad, AIR 1961 SC 1808, where an eleven-judge Bench held that furnishing an impression is a mechanical act supplying material for comparison and is not "to be a witness" within Article 20(3).

Where it fails. There is no measured error rate for latent print comparison, because the examiner's conclusion is a judgment of sufficiency and not a measurement; contextual bias operates, since the examiner knows which candidate the investigation favours and the verifier knows the first examiner's conclusion; and chance marks are partial and distorted.

The standing illustration is Brandon Mayfield, matched by the Federal Bureau of Investigation to a mark from the Madrid train bombings of 11 March 2004 and confirmed by further examiners, until the Spanish National Police identified the mark as that of an Algerian national, Ouhnane Daoud; he was released after nineteen days with an apology and a settlement of two million dollars. The Indian warning is Mohd. Aman v. State of Rajasthan, (1997) 10 SCC 44, where a conviction on a chance print on a brass jug was set aside because the specimen prints had been taken three times without the Magistrate's order the law then required and the jug had been in police custody together with the accused.

2. The gas chromatograph with mass spectrometer

What it does. The instrument is two joined in series. The gas chromatograph vaporises the sample and carries it in an inert gas through a long capillary column coated with a stationary phase; different compounds interact with that phase to different extents and therefore emerge at different and characteristic retention times, so a mixture is separated into its components. Each component then enters the mass spectrometer, which ionises it, usually by electron impact, fragments it in a pattern characteristic of the molecule, and sorts the fragments by mass to charge ratio. The resulting spectrum functions as a molecular fingerprint and is matched against a reference library.

What it is used for. It is the confirmatory instrument of forensic chemistry: identification and quantification of narcotic drugs and psychotropic substances; identification of poisons and drugs in viscera, blood and urine; identification of accelerants such as petrol and kerosene in the debris of a suspected arson, where the residue is present in minute quantity in a heavily contaminated matrix; and identification of explosive residues at a post-blast scene.

The legal setting, which is where it bites. Under the Narcotic Drugs and Psychotropic Substances Act, 1985 punishment is graded by quantity, and the difference between the small and commercial bands is the difference between up to a year and ten to twenty years. Two authorities must be given. On what is weighed, E. Micheal Raj v. Intelligence Officer, Narcotic Control Bureau, (2008) 5 SCC 161 held that in a mixture of a narcotic drug with a neutral substance it is the actual content by weight of the drug that determines the band; that decision was overruled by Hira Singh v. Union of India, (2020) 20 SCC 272, decided on 22 April 2020, holding that the total weight of the mixture counts, because any other construction would let an offender escape the commercial band by dilution.

On how the sample reaches the instrument, s.52A of the NDPS Act governs inventory, sampling and disposal, and Union of India v. Mohanlal, (2016) 3 SCC 379, decided on 28 January 2016, directed that the application to the Magistrate be moved immediately after seizure, that sampling take place in the presence and under the supervision of the Magistrate who must certify the exercise, and that seized drugs be stored in safes and vaults under a gazetted officer's personal supervision.

The report reaches the court under s.329 of the Sanhita, the Chemical Examiner or Assistant Chemical Examiner to Government under sub-section (4)(a) and the Director of a Central or State Forensic Science Laboratory under clause (e) both being Government scientific experts, and the opinion is relevant under s.39(1) of the Sakshya Adhiniyam, whose first Illustration is literally the question whether a death was caused by poison.

Where it fails. Sampling: a non-homogeneous seizure sampled at one point produces a purity figure that does not represent the whole. Carry-over between runs contaminates the next sample. Library matching requires the compound to be in the library, which is a real difficulty with novel psychoactive substances designed to be structurally new. And quantification requires calibration standards that are themselves traceable, which not every laboratory maintains.

3. The closed circuit television camera

What it does. A network of fixed or steerable cameras feeds a digital or network video recorder writing to a disk that overwrites on a cycle. Forensically the significant characteristics are resolution, frame rate, whether the internal clock is accurate, the retention period, and whether the recorder writes in a proprietary format needing conversion.

Its three uses, which must be separated. It deters, where visible, by raising the perceived risk of detection. It detects in progress, where actively monitored, which is uncommon outside major control rooms. And it proves after the fact, which is what it is mostly used for and which needs entirely different qualities from the installation.

The investigative workflow, which is what an examiner is really testing. Identify the cameras covering the scene and the approach and escape routes, most of which are privately owned; act before the overwrite, since private retention cycles are commonly seven to thirty days; seize the original recorder or its hard disk rather than a copy re-recorded from a screen; compute a hash value at acquisition so that later alteration is demonstrable; and record the clock error against a reference clock, because the whole value of footage is usually its timing and recorder clocks are routinely wrong. The seizure itself must be recorded under s.105 of the Sanhita by audio-video electronic means, preferably a mobile phone, and forwarded to the Magistrate, and s.193(3)(i) now requires the police report to state "the sequence of custody in case of electronic device".

Admissibility. Footage is an electronic record and enters under s.63 of the Sakshya Adhiniyam, with sub-section (4) requiring a certificate identifying the record, describing the manner of its production and giving the particulars of the device, at each instance where the record is submitted for admission. Arjun Panditrao Khotkar v. Kailash Kushanrao Gorantyal, (2020) 7 SCC 1, decided on 14 July 2020 on the corresponding s.65B of the Evidence Act, held that certificate mandatory, affirmed Anvar P.V. v. P.K. Basheer, (2014) 10 SCC 473 and overruled Shafhi Mohammad v. State of Himachal Pradesh, while allowing that no certificate is needed where the original device is produced and its holder testifies, and that a party unable to obtain one may apply to the judge to compel its production.

The camera turned around. In Paramvir Singh Saini v. Baljit Singh, (2021) 1 SCC 184, decided on 2 December 2020, the Supreme Court, dealing with custodial violence, directed installation of cameras with night vision and audio and video at every entry and exit point, lock-up, corridor, lobby, reception, veranda, Inspector's room, station hall and compound of every police station, with footage preserved for eighteen months and never less than a year, malfunctions reported for immediate repair, and the same in the offices of central agencies that interrogate and hold accused persons, all grounded in Article 21.

Where it fails. Low-resolution footage supports unreliable identification, and facial recognition applied to it compounds the error. Clocks are wrong. Retention cycles overwrite before anyone asks. Coverage is patchy and privately controlled. And the certificate requirement renders inadmissible a great deal of footage nobody doubts.

The cost

The devices in the fifth category, those that connect a person to a record, constitute a capacity for continuous identification of a population. Under s.4(2) of the Criminal Procedure (Identification) Act, 2022, measurements are retained for seventy-five years, with destruction available only to a first-time arrestee released without trial, discharged or acquitted after exhausting all remedies, and even then subject to the court directing otherwise. That has not been tested against the proportionality standard in K.S. Puttaswamy v. Union of India, (2017) 10 SCC 1, and the Digital Personal Data Protection Act, 2023 exempts policing by s.17(1)(c) and notified State instrumentalities by s.17(2)(a).

Conclusion. Modern devices can be sorted by what they do to information: create it, reveal what was invisible, identify what a thing is, decide whether two things share a source, or connect a thing to a record already held. The automated fingerprint identification terminal, searching the National Automated Fingerprint Identification System launched on 17 August 2022, belongs to the last group and returns a candidate list rather than an identification, with the discipline's real weaknesses, no measured error rate and contextual bias, lying at the human stage that follows, as Mayfield and Mohd. Aman both show.

The gas chromatograph with mass spectrometer belongs to the third and is the confirmatory instrument of forensic chemistry, and its legal significance turns on Hira Singh having overruled E. Micheal Raj on what is weighed and on Union of India v. Mohanlal on how the sample must be drawn under s.52A of the NDPS Act. The closed circuit camera belongs to the first, and its footage reaches a court only through the mandatory certificate of s.63(4) of the Sakshya Adhiniyam as enforced in Arjun Panditrao, while Paramvir Singh Saini has turned the same device into an Article 21 control on the police themselves.

For full marks, cover: these are the same three notes set at Q2 of the first paper in this scan, and that answer takes each from the scientific end, what the thing is and how it works. This one takes each from the courtroom end, by asking of each: what can a court actually do with the result, and under what provision. That is the more valuable direction for a law examination, and a candidate who can answer both directions on the same three topics is fully prepared.

A) Forensic medicine (about 12.5 marks)

The question a court asks. A criminal court does not want a medical treatise; it wants an answer to one of four questions. How did this person die, and when. Were these injuries caused by that weapon, in that manner. Is the medical evidence consistent with what the eyewitness says. And how old is this person.

How the medical witness gets into the trial. The medical witness is an expert under s.39(1) of the Bharatiya Sakshya Adhiniyam, 2023, which makes relevant the opinion of a person specially skilled in science on a point of science the Court must form an opinion upon, and s.45 makes the grounds of that opinion relevant, which is why a post-mortem report that states conclusions without reasons is worth very little.

Where the doctor is a Government scientific expert of the class listed in s.329(4) of the Bharatiya Nagarik Suraksha Sanhita, 2023, his report may be used as evidence without his attending; the Court may summon him, and where he cannot attend he may depute a responsible officer conversant with the facts. By the second proviso to s.330, no expert is called at all unless a party disputes the report. And s.336 deals with the very common Indian problem of the surgeon who has since been transferred, retired or died, or whose attendance would delay the trial, by requiring the Court to secure the presence of the successor in the post, with deposition permitted through audio-video electronic means.

What triggers the examination in the first place. Section 194 requires the officer in charge of a police station, on information that a person has committed suicide, has been killed by another, by an animal, by machinery or by an accident, or has died in circumstances raising a reasonable suspicion of an offence, to inform the nearest Executive Magistrate empowered to hold inquests and to draw up a report of the apparent cause of death; s.194(3) requires the body to be forwarded for post-mortem examination in five cases, including any doubt as to the cause of death and the death of a woman within seven years of her marriage in the circumstances there specified.

For the living, s.51 permits examination of an arrested person with the Explanation extending it to blood, semen, swabs, sputum, sweat, hair and nail clippings by modern techniques including DNA profiling; s.52 covers a person arrested for rape; s.53 covers every arrested person and requires a copy of the report to be given to him, which is a safeguard against custodial violence; and s.184 covers the victim of rape, within twenty-four hours, with consent recorded specifically.

What weight the court gives it. The governing decision is Solanki Chimanbhai Ukabhai v. State of Gujarat, (1983) 2 SCC 174, where the defence attacked eyewitness accounts of an assault on the ground that the doctor's description of the injuries did not fit them. The Supreme Court held that the value of medical evidence is ordinarily only corroborative: it proves that the injuries could have been caused in the manner alleged and nothing more; the defence may use it affirmatively to show that they could not have been so caused, and thereby discredit the eyewitnesses; but unless it rules out all possibility whatsoever of the injuries occurring as the eyewitnesses describe, their testimony is not to be rejected. To that must be added Ramesh Chandra Agrawal v. Regency Hospital Ltd., (2009) 9 SCC 709: expert evidence is admissible only where the matter is outside the knowledge and experience of the lay person, and opinion evidence is advisory, the court not being bound by it.

Where a cross-examiner attacks. On the range of every estimate, since time since death from algor, rigor and livor mortis and stomach contents is affected by ambient temperature, body mass, clothing and the last meal; on age from ossification, which is unreliable above about twenty-five and which s.94 of the Juvenile Justice (Care and Protection of Children) Act, 2015 accordingly places last, after the matriculation certificate and the birth certificate, with Jarnail Singh v. State of Haryana, (2013) 7 SCC 263 extending that hierarchy to a child who is the victim; on the fact that the autopsy surgeon almost never visited the scene; and on the qualifications of a general duty medical officer performing a specialist examination.

B) Portable bomb sniffer (about 12.5 marks)

The question a court asks. What, if anything, can a court do with an alert from a hand-held instrument at an airport or a checkpoint. The answer is short: nothing directly, and the whole legal significance of the device lies in what it authorises rather than in what it proves.

What the device is. A hand-held or trolley-mounted detector of explosive vapour or surface trace, working in most deployed models by ion mobility spectrometry: a swab or air sample is vaporised, ionised, released into a drift tube and driven along it by an electric field against a counter-flow of drift gas, the time to traverse identifying the compound. It detects the nitro-group explosives, RDX, PETN, TNT and HMX, well; ammonium nitrate, which is also fertiliser, ambiguously; and the peroxide explosives TATP and HMTD, which contain no nitrogen, only if configured for them.

Its legal function. It generates reasonable suspicion, which is the basis on which a person or a bag may lawfully be searched and material seized. The seized exhibit then goes to the explosives division of a Central Forensic Science Laboratory for confirmatory analysis by gas chromatography with mass spectrometry or high performance liquid chromatography, and it is the confirmatory result, in a report by a witness who can be cross-examined, that becomes evidence. The Chief Controller of Explosives is a Government scientific expert under s.329(4)(b) of the Sanhita, so his report may be used as evidence subject to the second proviso to s.330.

The scene. A post-blast scene is the paradigm case for s.176(3) of the Sanhita, which requires a forensic expert to attend the scene of any offence punishable with seven years or more, from a date the State notifies within five years, and to have the collection videographed. Post-blast residue is microscopic, degrades quickly and is destroyed by the rescue operation itself, so the difference between a trained collector arriving and not arriving is the difference between a case and no case.

Where a cross-examiner attacks. On specificity, since nitrogenous fertilisers, some pharmaceuticals and nitroglycerine heart medication all produce alerts; on transfer, since trace contamination moves readily from hand to hand and surface to surface, so a positive swab on clothing is consistent with innocent contact; on calibration and maintenance records, since an uncalibrated instrument proves nothing; and on the chain of custody of the exhibit between the alert and the laboratory.

The dog, for completeness. Explosive and narcotic detection dogs are the other portable method and have a weak legal standing in India. In Abdul Rajak Murtaja Dafedar v. State of Maharashtra, AIR 1970 SC 283, where the accused had been convicted of derailing a train and killing ten passengers, partly on his identification by a police tracker dog, a three-judge Bench expressly declined to express a concluded opinion or lay down any general rule about the admissibility or weight of tracker-dog evidence, deciding the case on other material. The practical position since is that such evidence may be admissible but carries little weight and cannot stand alone, because the animal cannot be cross-examined and the court is in truth being asked to accept the handler's account of what it did.

C) Lie detector test (about 12.5 marks)

The question a court asks, and the answer. What can a court do with a polygraph chart. Nothing. Not with a chart obtained by compulsion, and not with a chart obtained by consent. That is the whole of the modern Indian law and it should be stated in the first line of the note.

The instrument, briefly. A polygraph records respiration through pneumograph tubes, cardiovascular activity through a blood pressure cuff, and electrodermal activity through finger electrodes, in the relevant and irrelevant, control question or guilty knowledge formats. It measures arousal, not deception; there is no physiological signature unique to lying, so an innocent but frightened subject and a calm practised one both produce misleading records.

Selvi v. State of Karnataka, (2010) 7 SCC 263, in four propositions.

One. The compulsory administration of the polygraph, along with narco-analysis and the brain electrical activation profile, violates Article 20(3), because the results are testimonial in character and the subject is being made to furnish evidence against himself.

Two. It also violates Article 21, as an unjustified intrusion into mental privacy and a procedure that is not fair, just and reasonable. This limb matters because it protects witnesses and suspects who are not "accused of an offence" and therefore cannot invoke Article 20(3).

Three. Consent does not make the results admissible. Even a volunteer's chart is inadmissible, because the subject exercises no conscious control over the physiological responses recorded, so what is produced is not a voluntary statement.

Four. What survives is discovery. Material subsequently discovered with the help of a voluntarily administered test may be proved under s.27 of the Evidence Act, now the proviso to s.23(2) of the Bharatiya Sakshya Adhiniyam, 2023, under which so much of the information received from an accused in police custody as relates distinctly to a fact thereby discovered may be proved.

The safeguards. Selvi directed strict compliance with the National Human Rights Commission's Guidelines for the Administration of Polygraph Test (Lie Detector Test) on an Accused, 2000, which require that the accused be given the option and not required to submit; that he be told of the legal, physical and emotional implications with access to a lawyer; that his consent be recorded before a Judicial Magistrate, with the lawyer permitted to explain and the accused told the statement will have the status of a statement to the police and not of a confession before a Magistrate; that the Magistrate consider the length and nature of the detention; that the test be conducted in an independent agency such as a hospital in the presence of a lawyer; and that a full medical and factual narration be recorded.

The current statement. Amlesh Kumar v. State of Bihar, 2025 INSC 810, decided on 10 June 2025 by Karol and Varale JJ, set aside a Patna High Court order of 9 November 2023 permitting involuntary testing, reaffirmed Selvi, and added two things: an accused has no indefeasible right to undergo such a test, though he may apply to the court which must weigh the totality of the circumstances; and the findings of such a test cannot form the sole basis of a conviction.

The boundary, which is the note's best paragraph. Compelled fingerprints, handwriting specimens and, since s.349 of the Sanhita, voice samples are lawful, because State of Bombay v. Kathi Kalu Oghad, AIR 1961 SC 1808 held that furnishing such material is a mechanical act supplying material for comparison and is not "to be a witness" within Article 20(3). The polygraph falls on the other side of the line because it reaches for the contents of the mind, and no amount of consent moves it back across.

Conclusion. Answering the three notes from the courtroom end produces a clear ranking. Forensic medicine produces evidence a court acts on: it enters under s.39 of the Sakshya Adhiniyam and, where the doctor is a Government scientific expert, as a document under s.329 of the Sanhita without his attending unless a party disputes it, and its weight is fixed by Solanki Chimanbhai as ordinarily corroborative, displacing eyewitness testimony only where it excludes the eyewitness account altogether.

The portable bomb sniffer produces nothing a court receives at all: its legal function is to generate the reasonable suspicion that justifies a search, and the confirmatory laboratory analysis under s.329(4)(b) carries the evidential weight, with the parallel technique of dog detection left undecided by Abdul Rajak Murtaja Dafedar and carrying little weight in practice. The lie detector produces nothing at any stage: after Selvi and Amlesh Kumar it cannot be compelled, its results are inadmissible even on consent, and only a discovery made in consequence of a voluntary test survives, under the proviso to s.23(2) of the Sakshya Adhiniyam.

3.Forensic Ballistics Helps in Detecting and Prosecuting Fire Arm Related Crimes under Criminal Judicial System.[25]

For full marks, cover: this stem differs from the bare "discuss and elaborate" version at Q3 of the first paper in this scan in three words that change the whole answer: prosecuting, and criminal judicial system. It is asking what the science contributes once the case is in court, so the case law is not a closing flourish here, it is the centre of the answer. Give the science compactly, then work through the four things ballistics proves at trial, then the Indian authorities in date order, then the limits. There is a Supreme Court line running from 1950 to 2023 saying the same thing, and reproducing it is worth eight or nine marks.

The science, compactly

Forensic ballistics is the application of internal ballistics, which covers everything from the strike of the firing pin to the muzzle, external ballistics, which covers the flight, and terminal ballistics, which covers the impact and the wound, to legal questions. In method it is a branch of tool-mark examination: a firearm unavoidably marks what passes through it.

A rifled barrel impresses on the bullet its class characteristics, the calibre, the number and width of lands and grooves and the direction and rate of twist, which identify a class of weapon and exclude with certainty every weapon outside it; and its individual characteristics, the microscopic longitudinal striations left by the imperfections of that particular barrel. The cartridge case carries the firing pin impression, the breech face marks and, in a self-loading weapon, the extractor and ejector marks, and is often the better exhibit because it is not deformed on impact. Comparison is made on a comparison microscope against a test firing into a recovery tank. A smoothbore weapon imparts no striations to the shot at all, which matters greatly in India, where country-made and smoothbore weapons dominate.

What ballistics proves at trial: four contributions

One: it links the accused to the offence. Where the weapon recovered from the accused is shown by striation comparison to have fired the bullet or the cartridge case recovered from the scene or the body, the link is direct and is the strongest form of firearm evidence there is. Where the class characteristics exclude the recovered weapon, the link is broken conclusively and the defence has an answer that requires no judgment at all.

Two: it proves the elements of the statutory offences. Under the Arms Act, 1959 the prosecution must establish that the article is a firearm and, for the aggravated offences, that it was in working order and capable of being fired. Section 25 punishes possession without licence and s.27 punishes use, the gravest sub-section applying where such use causes death. Those are matters for the examiner, not the investigating officer, and a prosecution that produces a weapon without an examiner's report on its condition has a hole in it. The substantive charge will ordinarily be s.103(1) of the Bharatiya Nyaya Sanhita, 2023 for murder.

Three: it tests the oral evidence. Range and direction are read from the wound: a muzzle imprint, stellate splitting and internal sooting at hard contact; blackening, which wipes off, and singeing at close range; discrete tattooing, which does not wipe off, at intermediate range; and neither at a distance. Entry is distinguished from exit by the inverted margins and abrasion collar of the entry against the everted margins of the exit, subject to the shored exit exception, and by internal against external bevelling in the skull. A witness who says the deceased was shot from a foot away is contradicted absolutely if the wound shows neither soot nor tattooing.

The relationship between that evidence and the eyewitness is governed by Solanki Chimanbhai Ukabhai v. State of Gujarat, (1983) 2 SCC 174: medical evidence is ordinarily corroborative, proving that the injuries could have been caused as alleged and nothing more, and the defence may use it to show that they could not have been so caused, but it displaces eyewitness testimony only where it rules out the eyewitness account altogether. Firearm evidence is one of the few classes capable of doing exactly that.

Four: it establishes the number of participants. Grouping recovered bullets and cases by their marks establishes how many weapons were fired, which in a case of common intention or unlawful assembly is frequently the contested issue.

How the evidence gets in

The opinion is relevant under s.39(1) of the Bharatiya Sakshya Adhiniyam, 2023, with the grounds relevant under s.45. The report reaches the court under s.329 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Director, Deputy Director or Assistant Director of a Central or State Forensic Science Laboratory being a Government scientific expert under sub-section (4)(e), so the report may be used as evidence and the Court may summon the expert if it thinks fit. By the second proviso to s.330, no expert is called unless a party disputes the report, and s.336 requires the successor in the post to depose where the examiner has been transferred, retired or died.

The Indian authorities, in date order

Mohinder Singh v. State, AIR 1953 SC 415, decided on 17 October 1950. The deceased had died of injuries said to have been caused by the appellant's weapon, and there was a live question whether the wounds were caused by a gun or a rifle. The Supreme Court held that where death is due to injuries or wounds caused by a lethal weapon, it has always been considered the duty of the prosecution to prove by expert evidence that it was likely, or at least possible, for the injuries to have been caused with the weapon with which and in the manner in which they are alleged to have been caused; in firearm cases the prosecution must bring expert evidence connecting the injuries with the weapon and its alleged manner of use.

Sukhwant Singh v. State of Punjab, (1995) 3 SCC 367, decided on 28 March 1995. An empty cartridge case had been recovered from the scene of the shooting and a pistol with live cartridges had been seized from the appellant when he was arrested, and the prosecution sent neither to the ballistic expert, so no comparison was ever made. The Supreme Court held that in cases where injuries are caused by firearms, the opinion of the ballistic expert is of considerable importance where both the firearm and the crime cartridge are recovered during the investigation to connect an accused with the crime, because the comparison could have supplied the link between the crime and the accused, and that failure to produce the expert opinion before the trial court in such cases affects the creditworthiness of the prosecution case to a great extent.

Pritinder Singh @ Lovely v. State of Punjab, 2023 INSC 614, decided on 5 July 2023 by Gavai and Karol JJ. There was no evidence that the gun belonged to the accused, and the ballistic expert had not been examined to show that the wad and pellets recovered had been fired from the empty cartridges found. The Court described the failure to examine the ballistic expert as a glaring defect in the prosecution case which, taken with serious doubts about the extra-judicial confession and the last-seen evidence, left the prosecution short of proof beyond reasonable doubt, and acquitted.

What that line of authority actually establishes

The proposition to draw, and it is the point of the whole answer, is a negative one. The Indian courts have not held that ballistic evidence proves guilt. They have held that its absence, where the material for it existed, damages the prosecution. The reasoning is that where the weapon and the cartridge are both in the prosecution's hands and no comparison is made, the court is entitled to infer that the comparison would not have assisted.

That has two consequences for practice. For the prosecution, obtaining the ballistic report is not optional in any case where a weapon and a fired cartridge or bullet are both recovered; it is a step whose omission will be held against it. For the defence, the first question in any firearm case is whether the weapon and the crime exhibit were both recovered and whether they were compared, because if they were not, Sukhwant Singh and Pritinder Singh @ Lovely supply a complete argument without any need to attack the science.

The limits, which the answer must not omit

Striation comparison has no measured error rate. The conclusion is a judgment that agreement is sufficient, with no numerical threshold, made by an examiner who ordinarily knows which weapon the investigation favours and checked by a colleague who knows his conclusion, which is the classical condition for contextual bias.

Barrels change, with use, cleaning and corrosion, so striations are not perfectly stable, and a bullet recovered from a body is frequently too deformed to compare at all.

Most Indian firearm crime involves the worst material for the discipline. Smoothbore weapons, including country-made single-shot weapons, impart no rifling marks, so comparison is confined to the cartridge case where one exists, and improvised weapons change between firings.

Gunshot residue is the weakest link. Primer residue particles of lead, barium and antimony, identified by scanning electron microscopy with energy dispersive X-ray analysis, establish proximity to a discharge and not the act of firing; they are lost within hours by washing and ordinary activity, transfer from vehicles, handcuffs and officers who have fired, and settle on bystanders. The older dermal nitrate or paraffin test is discredited outright, nitrates being ubiquitous in fertiliser, tobacco, cosmetics and urine.

Conclusion. Forensic ballistics helps to detect firearm-related crime by identifying the class of weapon from the calibre, land and groove count and twist, which excludes wrong weapons with certainty, by establishing how many weapons were fired, by reconstructing the firer's position, by estimating range from the residue pattern and by connecting a person to a discharge through primer residue. It helps to prosecute by linking a recovered weapon to a recovered bullet or cartridge case through the individual striations read on a comparison microscope, by supplying the proof of working condition that ss.25 and 27 of the Arms Act, 1959 require, and by corroborating or contradicting eyewitness evidence within the rule in Solanki Chimanbhai.

Its greatest significance under the Indian criminal judicial system, however, is settled by a line running from Mohinder Singh in 1950 through Sukhwant Singh in 1995 to Pritinder Singh @ Lovely in 2023: where a firearm has been used and both the weapon and the crime cartridge are recovered, the failure to obtain and produce the ballistic expert's opinion is a defect that damages the prosecution case to a great extent and has repeatedly produced acquittals. Against that must be set the discipline's own limits, that striation comparison has no measured error rate, that smoothbore and country-made weapons leave nothing on the projectile, and that gunshot residue proves proximity rather than firing.

4.Discuss Role Of Forensic Science Laboratories In Investigations Of Crimes.[25]

For full marks, cover: this is the descriptive form of the laboratory question and it is anchored to investigation, not to trial. The first paper in this scan sets the propositional form at Q5, about "modern ways of investigation", and that answer argues; this one should describe, and should describe accurately: what the Indian network actually is, what its divisions do, what the laboratory now does at the scene as well as in the building, and what the practical constraints are. Institutions, sections and figures carry the marks here.

The laboratory's place in an investigation

An investigation produces three kinds of material: what people say, what documents record, and what physical objects carry. The laboratory works on the third, and its role in the investigation is to convert an object into an assertion the investigator can act upon and a court can eventually receive.

It intervenes at four points. It advises on what to look for and how to collect it. It collects, which is new. It analyses. And it reports in a form designed to be tested.

The Indian network, accurately

At the central level the laboratories sit under the Directorate of Forensic Science Services, an attached office of the Ministry of Home Affairs. There are seven Central Forensic Science Laboratories:

Questioned documents for the central agencies go to the three offices of the Government Examiner of Questioned Documents: Shimla, established in 1906 and the oldest document unit in the country, Kolkata from 1964 and Hyderabad from 1968. Fingerprint records are held by the Central Finger Print Bureau under the National Crime Records Bureau. Every State runs a State Forensic Science Laboratory with regional and district laboratories and mobile units beneath it, and Maharashtra's Directorate of Forensic Science Laboratories at Kalina, Mumbai, with regional laboratories at Pune, Nagpur, Nashik, Aurangabad and elsewhere, is the pattern. Training and higher education were consolidated by the National Forensic Sciences University Act, 2020, which merged the Gujarat Forensic Sciences University at Gandhinagar with the Lok Nayak Jayaprakash Narayan National Institute of Criminology and Forensic Science at Rohini into an Institution of National Importance.

The divisions and what each contributes to an investigation

Biology and serology answers whether a stain is blood, whether it is human and whether a stain is semen or saliva, using presumptive tests such as Kastle-Meyer, luminol and acid phosphatase, confirmatory microcrystal tests such as Teichmann and Takayama, the precipitin test for species, and prostate specific antigen and amylase.

DNA profiles short tandem repeat loci by the polymerase chain reaction and capillary electrophoresis and compares them with reference samples, reporting a random match probability.

Chemistry and toxicology examines viscera, blood and urine for poisons and drugs, screening by immunoassay or thin layer chromatography and confirming by gas chromatography with mass spectrometry.

Narcotics identifies and quantifies seizures under the Narcotic Drugs and Psychotropic Substances Act, 1985, where the quantity determines the sentencing band and where Hira Singh v. Union of India, (2020) 20 SCC 272 has overruled E. Micheal Raj v. Intelligence Officer, NCB, (2008) 5 SCC 161 to hold that the whole weight of the mixture counts.

Explosives examines pre-blast and post-blast material. Physics and ballistics compares firearms, cartridges, tool marks, glass, paint and soil. Questioned documents examines handwriting, signatures, ink and printing using the video spectral comparator and the electrostatic detection apparatus. Cyber and digital forensics images and examines computers, phones and storage. Photography and scene performs imaging, superimposition and reconstruction. A polygraph division exists in several laboratories and, after Selvi v. State of Karnataka, (2010) 7 SCC 263, produces nothing admissible.

The change of role: the laboratory at the scene

The most significant recent change to the laboratory's role in an investigation is s.176(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. On receipt of every information relating to an offence punishable with seven years or more, the officer in charge of the police station shall, from such date as may be notified within a period of five years by the State Government, cause the forensic expert to visit the crime scene to collect forensic evidence and cause videography of the process on a mobile phone or other electronic device; and where the facility is not available in the State, the State Government shall notify the utilisation of another State's facility until its own is developed.

This is a change of institutional role and not merely of procedure. Until now the laboratory received whatever the police chose to send, in whatever condition it arrived. Under s.176(3) a trained collector attends. That addresses the failure that has actually destroyed Indian prosecutions, which has always been what happened between the scene and the laboratory door rather than what happened inside the laboratory.

Two further provisions belong with it. Sections 105 and 185 require the search and seizure process, and the preparation of the list of seized articles, to be recorded by audio-video electronic means, preferably a mobile phone, and forwarded to the Magistrate. Section 193(3)(i) requires the police report to state "the sequence of custody in case of electronic device".

How the laboratory's product leaves the investigation and enters the case

Section 39(1) of the Bharatiya Sakshya Adhiniyam, 2023 makes the opinion of a person specially skilled in science, or in any other field, relevant, with s.39(2) adding the Examiner of Electronic Evidence and s.45 making the grounds relevant. Section 329 of the Sanhita allows the report of a Government scientific expert, including the Director, Deputy Director or Assistant Director of a Central or State Forensic Science Laboratory under sub-section (4)(e), the Chemical Examiner under clause (a), the Chief Controller of Explosives under clause (b), the Director of the Finger Print Bureau under clause (c) and the Serologist under clause (f), to be used as evidence, with clause (g) newly admitting any other scientific expert notified by the State or Central Government. The second proviso to s.330 relieves the expert of attendance unless a party disputes the report, and s.336 requires the successor in the post to depose where the analyst has moved on.

The chain of custody, which the Supreme Court has now specified

Because the laboratory's product is only as good as the sample, the custody rules are part of the laboratory's role and are now judicially fixed.

In Rahul v. State of Delhi (NCT of Delhi), 2022 LiveLaw (SC) 926, decided on 7 November 2022, the biological samples in the Chhawla case lay in police custody for about two months with nothing recorded about their preservation, and the Supreme Court declined to act on the DNA reports and set aside three death sentences.

In Kattavellai @ Devakar v. State of Tamil Nadu, 2025 INSC 845, decided on 15 July 2025, samples taken on 19 May 2011 reached the laboratory on 29 June 2011, an unexplained gap of forty-one days. The Court acquitted and issued binding nationwide directions: documented packaging bearing the FIR number and date, the section and statute, the investigating officer and police station details and a serial number; the signatures of the medical professional and independent witnesses; delivery to the forensic science laboratory within forty-eight hours, with any delay explained in writing; a Chain of Custody Register recording every transfer from collection to the close of the case, signed by each handler and forming part of the trial court record; and no opening, alteration or resealing of a sealed package without the trial court's express permission. The directions were circulated to every State Director General of Police.

Conversely, Sukhwant Singh v. State of Punjab, (1995) 3 SCC 367 and Pritinder Singh @ Lovely v. State of Punjab, 2023 INSC 614 establish that not using the laboratory, where the weapon and the crime cartridge are both recovered, is itself a defect that damages the prosecution case.

The constraints, stated honestly

Capacity. The duty in s.176(3) attaches to a very large fraction of the serious criminal docket, and trained forensic personnel are a fraction of what it implies. The five-year notification window and the express power to borrow another State's facility are the statute's own admission of the gap, and exhibit pendency in State laboratories runs into months and in some divisions years, which puts the Kattavellai forty-eight hour rule under immediate strain.

Regulation. There is no Indian statute prescribing accreditation, proficiency testing, method validation or error-rate reporting for forensic laboratories. The DNA Technology (Use and Application) Regulation Bill, 2019, which would have created a DNA Regulatory Board with power to accredit laboratories and lay down standards, was withdrawn from the Lok Sabha in July 2023.

Scrutiny. The second proviso to s.330 relieves the expert of attendance unless a party disputes the report, which places the burden of triggering scrutiny on a defence that has not seen the bench notes and frequently cannot know whether there is anything to dispute.

Conclusion. The role of a forensic science laboratory in an investigation is to convert physical objects into assertions an investigator can act on and a court can receive, and it now performs that role at four points: advising, collecting, analysing and reporting. In India the work is carried by seven Central Forensic Science Laboratories under the Directorate of Forensic Science Services, with the New Delhi laboratory under the Central Bureau of Investigation, three offices of the Government Examiner of Questioned Documents at Shimla, Kolkata and Hyderabad, the Central Finger Print Bureau, and a State laboratory in every State, organised into divisions for biology and serology, DNA, chemistry and toxicology, narcotics, explosives, physics and ballistics, questioned documents, cyber forensics and scene work.

The decisive change is s.176(3) of the Sanhita, which puts a forensic expert at the scene of every offence punishable with seven years or more, with videography, subject to a five-year phasing; and the decisive constraint is that neither capacity nor regulation has kept pace, so that the standards the laboratory works to were supplied by the Supreme Court in Kattavellai on 15 July 2025 rather than by any statute, the DNA Bill having been withdrawn in July 2023.

5.Discuss - 'Functions And Role Of Interpol.'[25]

Answer

For full marks, cover: the first paper in this scan sets the near-identical stem at Q7 and that answer leads with the machinery, the four functions and the eight notices. This one leads with the role, and the most useful way to demonstrate a role is to take the categories of transnational crime one at a time and say what INTERPOL actually does about each. That structure forces specificity and prevents the generic answer. Open by disposing of the misconception that INTERPOL is a police force, close on India and on the Article 3 problem.

The organisation, and what it is not

The International Criminal Police Organization has 196 member countries and its headquarters at Lyon in France. Founded at Vienna in 1923 as the International Criminal Police Commission, compromised during the Second World War, reconstituted in 1946 and given its present name and Constitution in 1956, it has no power to investigate, no power to arrest, no territory and no jurisdiction, and cannot compel any member to do anything. India joined on 15 October 1949 and was not a founding member. Its National Central Bureau in India is the Central Bureau of Investigation.

The role, stated generally

Criminal jurisdiction is territorial; criminals are not. The offence is committed in one State, the money moves through a second, the offender lives in a third, and each police force sees a fragment. A supranational police force would answer that and is politically unavailable, because criminal justice is among the last competences a State surrenders. INTERPOL is the compromise: an organisation with no powers of its own that lets national forces reach one another at police speed while every power stays where it was. Its role is to enable, and everything below is an application of that.

The role, crime type by crime type

Fugitives. This is the role the public knows and the one most often misunderstood. INTERPOL publishes a Red Notice at the request of a National Central Bureau to seek the location and arrest of a person wanted for prosecution or to serve a sentence, and circulates it to 196 forces at once. What it cannot do is arrest, and in India it cannot even authorise an arrest, as Bhavesh Jayanti Lakhani holds below. Its actual contribution is location: a fugitive who crosses a border is queried against the notice and the databases, and the requesting State is told where he is. What follows is extradition or deportation under national law.

Terrorism. A counter-terrorism unit maintains data on foreign terrorist fighters and on stolen and lost travel documents, the latter being by volume the organisation's most consulted product and precisely the mechanism by which such persons move. The INTERPOL-United Nations Security Council Special Notice informs members that an individual or entity is subject to Security Council sanctions, which is the one notice that carries an obligation grounded outside the organisation itself.

Organised crime, trafficking in persons and migrant smuggling. Specialist units coordinate multi-country operations, and the Green Notice warns members of a person who has committed criminal offences and is likely to repeat them in other countries, which is the notice designed for the mobile recidivist. The Purple Notice circulates modus operandi, objects, devices and concealment methods, which is how a concealment technique discovered in one country becomes searchable in the next.

Drug trafficking. Databases and operational support address routes, methods and syndicates, and coordinate controlled deliveries across borders, which by definition require two forces to act on the same consignment.

Financial crime, corruption and money laundering. These are inter-jurisdictional by nature, since the offence and the proceeds are rarely in the same country, and the organisation's role is asset tracing, coordination and rapid alerting. For India this connects to the Fugitive Economic Offenders Act, 2018, under which a Special Court may declare a person a fugitive economic offender and confiscate his property in India while the international process runs.

Cybercrime. The Global Complex for Innovation at Singapore is devoted to it, and the role is necessarily coordination rather than investigation, because the offender, the infrastructure, the victim and the money are typically in four different jurisdictions and no single force can see the whole.

Environmental and wildlife crime, and cultural property. Databases on stolen works of art and coordination on wildlife trafficking, both of which are markets rather than incidents and so cannot be addressed within one country.

Missing and unidentified persons, and mass fatalities. The Yellow Notice helps locate a missing person or identify one who cannot identify himself, and the Black Notice seeks information on unidentified bodies. Beyond the notices, the organisation's Disaster Victim Identification guide is the internationally accepted standard for mass fatality identification, resting on three primary identifiers, fingerprints, dental records and DNA, with secondary identifiers such as medical findings, tattoos and personal effects in support. Its Incident Response Teams deploy to member countries on request after a major crime or disaster.

The functions that make the role possible

Four, and they should be given briefly because the role is the emphasis here.

I-24/7, an encrypted network connecting the National Central Bureaus of all members to each other and to Lyon, over which a request is answered in minutes.

The databases: wanted persons, stolen and lost travel documents, stolen vehicles, stolen works of art, fingerprints and DNA profiles, firearms, child sexual abuse material and maritime piracy. INTERPOL contributes nothing to them itself; every record is a member's.

Operational support: the specialist units named above, the Incident Response Teams, and the Disaster Victim Identification standard.

Capability building and training, which changes what national forces can do rather than resolving one case.

The organs that deliver them are the General Assembly of all members, meeting annually and setting policy; the Executive Committee under the President, supervising between sessions; the General Secretariat at Lyon under the Secretary General; the National Central Bureau in each country, staffed by its own officers under its own law; the Advisers, consultative; and the Commission for the Control of Files, an independent body supervising the processing of personal data and the only body to which an individual may apply for correction or deletion.

Article 2 of the Constitution defines the object as the widest possible mutual assistance between criminal police authorities within the limits of the laws existing in the different countries. Article 3 strictly forbids any intervention or activity of a political, military, religious or racial character.

India: the role and its legal ceiling

Bhavesh Jayanti Lakhani v. State of Maharashtra, (2009) 9 SCC 551 is the decision that fixes the ceiling. The appellant was alleged to have removed a child in breach of foreign custody orders; warrants had issued abroad and a Red Corner Notice had been published; and the Maharashtra police proceeded as though the notice authorised them to act against him.

The Supreme Court held that the mere issuance of a Red Corner Notice is not sufficient for the arrest of a person in India; that a person cannot be surrendered unless the procedure under the Extradition Act, 1962 is set in motion, because the municipal law of a country reigns supreme in matters of extradition; and that where a citizen's fundamental right is infringed the High Court will not turn him away merely because a Red Corner Notice has been issued, the superior courts being entitled to enquire into the manner in which the notice was issued and into whether the local police are threatening a citizen with an arrest they have no power to make.

The Indian sequence is therefore: locate by Red Notice through NCB-New Delhi; then extradite under the 1962 Act, which requires a treaty or arrangement, a request through the Ministry of External Affairs and a magisterial enquiry in the requested State, and which takes years; or deport, where the host State's immigration law permits, which is faster. Indian High Courts have also held that a Red Notice is not by itself a sufficient ground to deny a citizen passport services.

The criticism

Article 3 cannot be applied against a State determined to evade it, because the organisation must judge political motivation on the material the requesting State supplies. Red Notices and diffusions have been used against dissidents, journalists and refugees, and the reforms of the last decade, a task force reviewing requests before publication and a Commission for the Control of Files empowered to order deletion, reduce the abuse without curing its cause. A diffusion, circulated by one National Central Bureau directly to others rather than published by the Secretariat, receives less scrutiny still.

The consequences precede any adjudication. A person subject to a Red Notice may be detained at borders, refused visas and closed out of the banking system before any court has examined the merits, and his only direct remedy is to an internal Commission rather than to a court.

Everything depends on the members. The databases contain what States contribute; cooperation in a given case is voluntary; and where a State declines to act, the organisation has no remedy at all, which is precisely why extradition and not the notice remains the operative legal mechanism.

What India can do with a person the organisation helps it find

The role described above ends at location, and the value of that role can only be judged by seeing what Indian law then permits. Two decisions define it, and they should be read alongside Bhavesh Jayanti Lakhani v. State of Maharashtra, (2009) 9 SCC 551, which holds that a Red Corner Notice authorises no arrest at all.

Daya Singh Lahoria v. Union of India, (2001) 4 SCC 516, decided on 17 April 2001, is the first. The petitioner had been extradited to India from the United States, and Indian courts sought to try him for offences that the extradition decree did not name. The Supreme Court held that a fugitive brought into a country under an extradition decree can be tried only for the offences mentioned in the decree and for no other offence, and that the criminal courts have no jurisdiction to try him for anything else until he has been returned to the surrendering State or given the chance to return. That is the rule of specialty, embodied in s.21 of the Extradition Act, 1962.

Abu Salem Abdul Kayyum Ansari v. State of Maharashtra, 2022 INSC 671 is the second and the more instructive. The appellant was extradited from Portugal in 2005 only after the Government of India assured the Portuguese authorities that he would not be sentenced to death and would not be imprisoned for more than twenty-five years, an assurance Portuguese law required. After his conviction in India the question was whether the courts were bound by that promise. The Supreme Court held that the judiciary is bound to honour the sovereign assurance given by the executive, so his sentence could not run beyond twenty-five years, and that the custody undergone in Portugal was to be set off against it.

Read against the crime-type analysis above, the two decisions sharpen the assessment of INTERPOL's role considerably. Its contribution is at the front of the process and is unsubstitutable: no other mechanism tells 196 police forces at once that a particular person is wanted. But the value of that contribution is capped at the far end by machinery INTERPOL has no part in, because the offences triable are fixed by a decree drafted before the fugitive was found, and the sentence available may be fixed by the domestic law of a country with no interest in the Indian case at all.

Conclusion. INTERPOL's role is to enable 196 national police forces to act on one another's information across a world in which criminal jurisdiction is territorial and criminals are not, and it exercises no power of its own. Taken crime type by crime type, it locates fugitives through the Red Notice, tracks foreign terrorist fighters and sanctioned persons through its databases and the United Nations Security Council Special Notice, warns of mobile recidivists through the Green Notice and of methods through the Purple Notice, coordinates against organised crime, trafficking, drugs, financial crime and cybercrime, and supplies the internationally accepted Disaster Victim Identification standard resting on fingerprints, dental records and DNA.

Those roles rest on four functions: the I-24/7 network, the member-supplied databases, operational support including Incident Response Teams, and training. In India, whose National Central Bureau is the Central Bureau of Investigation and which joined on 15 October 1949, the legal ceiling is fixed by Bhavesh Jayanti Lakhani: a Red Corner Notice is not a warrant and authorises no arrest, and surrender depends on the Extradition Act, 1962. Its two structural weaknesses, the unenforceability of Article 3 against a determined State and the fact that a notice's consequences precede any judicial scrutiny, are the price of the design that made the organisation acceptable to States in the first place.

Part one: the history, meaning the sequence of discoveries

The antecedents, to about 1800. Kautilya's Arthashastra, of about the fourth century before the common era, treats the investigation of sudden death and the detection of poisoning. Song Ci's Xi Yuan Ji Lu, "The Washing Away of Wrongs", written in China in 1247, is the oldest systematic text anywhere, distinguishing drowning from strangulation, describing wounds inflicted before and after death, and recording the case solved when flies settled on the invisible blood traces on a reaper's sickle. In Europe Ambroise Paré described the effects of violent death in the sixteenth century and Paolo Zacchia's Quaestiones Medico-Legales founded legal medicine in the seventeenth.

Toxicology, 1814 to 1840. Mathieu Orfila's Traité des poisons of 1814 studied poisons systematically and insisted that a detection method be validated before being used against a person, which is the origin of the modern reliability requirement. His evidence in the Marie Lafarge trial of 1840, demonstrating arsenic in exhumed tissue by the Marsh test, showed publicly that a laboratory could prove a murder.

Identification, 1858 to 1903. William Herschel, a magistrate at Jungipoor in Bengal, began taking finger impressions on contracts in 1858 and established permanence over decades. Alphonse Bertillon introduced anthropometry, eleven body measurements, at Paris in 1879. Henry Faulds proposed the criminal use of fingerprints in Nature in 1880, building on the descriptive work of Nehemiah Grew in 1684 and Johann Purkinje, who classified nine patterns in 1823. Francis Galton established individuality and persistence statistically in Finger Prints in 1892. Anthropometry collapsed in 1903, when two unrelated prisoners at Leavenworth, both named West, were found to have effectively identical measurements, because the measurements were not reproducible between operators.

Criminalistics and serology, 1893 to 1910. Hans Gross published his Handbuch für Untersuchungsrichter in 1893, the first work on how an investigation should use scientific assistance. Karl Landsteiner described the ABO blood groups and Paul Uhlenhuth developed the precipitin test for species, both in 1901, so that a stain could for the first time be shown to be human blood. Edmond Locard opened the first police laboratory at Lyon in 1910 and formulated the exchange principle: every contact leaves a trace.

Firearms, the 1920s. Calvin Goddard systematised firearm identification using the comparison microscope, established publicly by his examination of the cartridge cases from the St Valentine's Day massacre of 1929.

Molecular biology, 1984 to 1988. Alec Jeffreys at Leicester discovered in 1984 that certain repetitive regions of DNA vary enough between individuals to identify them. In the Enderby investigation between 1986 and 1988 the technique first exonerated a young man who had confessed and then convicted Colin Pitchfork, the first person in the world convicted on DNA evidence.

Two features of the Indian growth deserve comment. The first is that it began with chemistry, because poisoning was the offence colonial administrators found hardest to prove, which is why the Chemical Examiner still stands first in the list of Government scientific experts in s.329(4)(a) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The second is that in identification India was ahead of the world rather than behind it: the Calcutta bureau of 1897 was the first anywhere, and the Henry classification, used across the world for a century, was substantially the work of two Indian sub-inspectors, Azizul Haque and Hem Chandra Bose.

The present central structure is the Directorate of Forensic Science Services under the Ministry of Home Affairs, controlling seven Central Forensic Science Laboratories at Kolkata, which is the oldest and a centre of excellence in the biological sciences, Hyderabad in the chemical sciences, Chandigarh in the physical sciences, New Delhi, which is under the Central Bureau of Investigation, and Guwahati, Bhopal and Pune.

India's DNA growth was unusually early: the Centre for Cellular and Molecular Biology at Hyderabad, under Dr Lalji Singh, developed an indigenous probe in 1988, making India the third country in the world to do so, and the technique was accepted by an Indian court in Kunhiraman v. Manoj, II (1991) DMC 499, a Kerala maintenance claim begun in 1988, where the High Court held DNA admissible as expert opinion in the same way as ballistic and fingerprint opinion.

Part three: the development, meaning what the subject became

It became probabilistic. The nineteenth century sought certainty and believed it had found it in anthropometry, then in fingerprints. The twentieth century learned to report likelihood: a random match probability, a consistency, a judgment of sufficiency. Modern forensic reporting is an exercise in stating a strength, and where it fails to state one honestly it misleads.

It became instrumental. Wet chemistry gave way after the Second World War to chromatography, spectroscopy and mass spectrometry, and the examiner's judgment migrated from the bench to the interpretation of an instrument's output.

It became legally regulated, in India very recently. The Criminal Procedure (Identification) Act, 2022, in force from 4 August 2022, repealed the Identification of Prisoners Act, 1920 and widened "measurements" in s.2(1)(b) to include palm and foot impressions, photographs, iris and retina scans, physical and biological samples and their analysis, and behavioural attributes, with retention by the National Crime Records Bureau for seventy-five years under s.4(2).

The Bharatiya Nagarik Suraksha Sanhita, 2023 and the Bharatiya Sakshya Adhiniyam, 2023, in force from 1 July 2024, require a forensic expert at the scene of every offence punishable with seven years or more under s.176(3), from a date the State notifies within five years, with videography; bring DNA profiling into the medical examination of an arrested person under s.51; permit compelled voice samples under s.349; and widen the expert provision by the words "or any other field" in s.39(1), adding the Examiner of Electronic Evidence in s.39(2).

It did not become regulated as a profession. The DNA Technology (Use and Application) Regulation Bill, 2019, which would have created a DNA Regulatory Board with power to accredit laboratories and set standards, was withdrawn from the Lok Sabha in July 2023, so India has no statute governing the accreditation, proficiency testing or method validation of its forensic laboratories.

The consequence is that the Supreme Court has had to supply the standards: in Kattavellai @ Devakar v. State of Tamil Nadu, 2025 INSC 845, decided on 15 July 2025, samples taken on 19 May 2011 had reached the laboratory only on 29 June 2011, and the Court, acquitting a man under sentence of death, directed for the whole country documented packaging with the FIR number and date, the section and statute, the investigating officer and police station details and a serial number, delivery to the laboratory within forty-eight hours with written reasons for any delay, and a Chain of Custody Register signed by every handler and forming part of the trial record. That followed Rahul v. State of Delhi (NCT of Delhi), 2022 LiveLaw (SC) 926, where samples had lain in police custody for about two months and three death sentences were set aside.

Conclusion. The history of forensic science runs from the medico-legal antecedents of Kautilya and Song Ci, through Orfila's validated toxicology of 1814 demonstrated in the Lafarge trial of 1840, the identification contest between Bertillon's anthropometry from 1879 and the fingerprint work of Herschel, Faulds and Galton culminating in 1892, the systematisation by Gross in 1893 and Locard at Lyon in 1910, the serology of Landsteiner and Uhlenhuth in 1901, Goddard's firearm identification in the 1920s, and Jeffreys' discovery of DNA profiling in 1984, whose first criminal application exonerated before it convicted.

Its growth in India began earlier than is generally supposed and in one strand led the world: the Chemical Examiner's Laboratory at Madras in 1849, the Anthropometric Bureau at Calcutta in 1892, the world's first Fingerprint Bureau at Calcutta in 1897 with the Henry classification substantially the work of Azizul Haque and Hem Chandra Bose, the Government Examiner of Questioned Documents at Shimla in 1906 and the Serology Department at Calcutta in 1910, followed by the post-independence network now under the Directorate of Forensic Science Services. Its development has been towards the probabilistic and the instrumental, and in India, since 2022, towards statutory compulsion, with the significant defect that the withdrawal of the DNA Bill in July 2023 left the laboratories unregulated and obliged the Supreme Court to supply the standards itself in Kattavellai in July 2025.

Note C is printed with an opening quotation mark and no closing one; that is how the paper prints it. Note B is the one worth choosing if you know it, because it has a definite structure, a governing statutory hierarchy and a leading case, and because most candidates answer it as a list of bones. Note A should be built on the sequence from the autopsy table to the opinion, because the marks in toxicology are in the sample and its preservation rather than in a catalogue of poisons.

A) Forensic toxicology (about 12.5 marks)

What it is. Forensic toxicology detects poisons, drugs and their metabolites in biological material and interprets what a measured concentration means. It divides into post-mortem toxicology, asking whether a poison caused or contributed to death; human performance toxicology, asking whether a person was impaired, as in drink-driving; and forensic drug testing, asking whether a seized substance is a controlled drug.

Classification of poisons by their action: corrosives, the strong acids and alkalis, which destroy tissue on contact; irritants, including arsenic and mercury and the plant irritants; systemic or neurotic poisons acting on the nervous system, including alcohol, opioids, barbiturates and strychnine; cardiac poisons such as oleander and aconite; and asphyxiants such as carbon monoxide and cyanide.

The Indian pattern, which differs from the western textbook and is worth giving because it shows you have read Indian material. Indian medico-legal practice is dominated by organophosphate and carbamate pesticides, whose mechanism is the inhibition of acetylcholinesterase and whose diagnosis rests on plasma and red cell cholinesterase estimation; aluminium phosphide, the grain fumigant tablet, which liberates phosphine on contact with moisture and for which there is no antidote; plant poisons, particularly yellow oleander seed, which acts on the heart; snake venom; alcohol; and increasingly opioids and sedatives.

The sequence from autopsy to opinion, which is where the marks are. Section 194(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 requires the body to be forwarded for post-mortem examination where there is any doubt regarding the cause of death. At autopsy the viscera are collected: the stomach with contents, a length of small intestine with contents, a portion of liver, one kidney, and separately blood and urine. The preservative is saturated saline; rectified spirit is the alternative and must not be used where alcohol is in question, because it would destroy the very analysis required, which is the classic examination point in this topic. Each container is separately sealed and labelled and despatched with a specimen of the seal.

Analysis runs in two stages, the same structure as serology and for the same reason: a broad screen by immunoassay or thin layer chromatography, which is sensitive but not specific, then confirmation and quantification by gas chromatography with mass spectrometry or liquid chromatography with tandem mass spectrometry, in which the chromatograph separates the mixture by retention time and the mass spectrometer identifies each component by its fragmentation pattern.

Interpretation is the hard part. A concentration is not a conclusion. Post-mortem redistribution means drug levels in blood drawn from the heart may greatly exceed those in peripheral blood, so the sampling site must be recorded. Tolerance means a level fatal to one person is therapeutic in a habitual user. Decomposition generates ethanol, so an apparent blood alcohol reading in a decomposed body may be entirely artefactual. And therapeutic, toxic and lethal ranges commonly overlap.

The legal framework. The Chemical Examiner or Assistant Chemical Examiner to Government is a Government scientific expert under s.329(4)(a) of the Sanhita, so the report may be used as evidence, and by the second proviso to s.330 the expert is not called unless a party disputes it. Section 39(1) of the Bharatiya Sakshya Adhiniyam, 2023 makes expert opinion relevant, and its first Illustration is literally the question whether the death of a person was caused by poison. Substantively, s.123 of the Bharatiya Nyaya Sanhita, 2023 punishes causing hurt by means of poison or any stupefying, intoxicating or unwholesome drug with intent to cause hurt or to facilitate an offence, and s.103(1) punishes murder.

Section 185 of the Motor Vehicles Act, 1988 fixes the drink-driving threshold at thirty milligrams per hundred millilitres of blood. Under the Narcotic Drugs and Psychotropic Substances Act, 1985, punishment is graded by quantity, and Hira Singh v. Union of India, (2020) 20 SCC 272, decided on 22 April 2020, overruled E. Micheal Raj v. Intelligence Officer, NCB, (2008) 5 SCC 161, holding that the whole weight of the mixture, including any neutral substance, determines the band; while Union of India v. Mohanlal, (2016) 3 SCC 379 requires the s.52A sampling to be done in the presence and under the supervision of a Magistrate who certifies the exercise.

B) Use of forensic science in ascertaining the age of a person (about 12.5 marks)

Why age matters legally, which must come first. Age is not a curiosity; it changes the legal character of everything around it. Under the Bharatiya Nyaya Sanhita, 2023, s.20 provides that nothing is an offence which is done by a child under seven years of age, and s.21 that nothing is an offence done by a child above seven and under twelve who has not attained sufficient maturity of understanding to judge of the nature and consequences of his conduct on that occasion. Under the Juvenile Justice (Care and Protection of Children) Act, 2015 a person under eighteen is a child, which determines whether he is tried by a court or dealt with by a Board. Under the law of sexual offences, age determines whether consent is capable of being given at all, and it determines the application of the Protection of Children from Sexual Offences Act, 2012. Age also governs marriage, employment, and, in the civil sphere, capacity to contract and questions of inheritance and pension.

The statutory hierarchy, which is the heart of the note. Section 94 of the Juvenile Justice (Care and Protection of Children) Act, 2015 does not leave the question to medicine. It establishes an order of proof: first, the date of birth certificate from the school, or the matriculation or equivalent certificate from the concerned examination board, if available; failing that, the birth certificate given by a corporation, a municipal authority or a panchayat; and only in the absence of both, the age is to be determined by an ossification test or any other latest medical age determination test conducted on the orders of the Committee or the Board. The medical test is therefore the last resort and not the first, and an order for one where a school certificate exists is bad.

In Jarnail Singh v. State of Haryana, (2013) 7 SCC 263 the Supreme Court held that this juvenile justice procedure applies equally to determining the age of a child who is the victim of an offence, and not only of a child in conflict with law. That is how the hierarchy reaches prosecutions under the Protection of Children from Sexual Offences Act, and it is the single most useful case to cite on this note.

The medical methods, in the order of the life stages they serve.

Dentition is the most reliable indicator in childhood. The deciduous teeth erupt on a known timetable in the first two to three years, and the permanent teeth on another through childhood and adolescence, the third molar erupting between about seventeen and twenty-five with wide variation. Dental age is assessed radiographically as well as by inspection.

Epiphyseal fusion is the principal method through adolescence into the mid twenties. The growing ends of the long bones are separated from the shafts by cartilaginous plates which ossify and fuse in a known order: the elbow relatively early, the wrist and hip in the later teens, the medial end of the clavicle latest of all, at about twenty-two to twenty-five. Radiographs of the wrist, elbow, shoulder, hip and knee are compared against standard atlases and against Indian population data, and the estimate is a range.

Degenerative and secondary markers take over afterwards, and are progressively less precise: the changing morphology of the pubic symphyseal face, the sternal ends of the ribs, the closure of the cranial sutures, and general osteoarthritic and dental attrition changes. Beyond about twenty-five, medical age determination becomes an estimate within a band of years rather than a determination at all.

Other methods: sexual maturation and secondary sexual characteristics in the living; height and weight, which are heavily affected by nutrition and are of very limited value in Indian conditions; and, where only skeletal remains exist, the anthropological methods described in the notes on forensic anthropology elsewhere in this folder.

The limits, which carry the last marks. Every method is an estimate with a range, and the range is at its widest precisely where the law most needs precision, around the eighteenth year. Nutrition, endemic disease, endocrine disorder and socio-economic condition all shift skeletal maturation, and the standard atlases were built on populations unlike the Indian one. The examiner who reports "about eighteen years" instead of "between sixteen and twenty years" has overstated his evidence, and the courts have repeatedly said that where the medical estimate carries a margin, the benefit of the margin goes to the person claiming juvenility. The statutory hierarchy in s.94 exists precisely because the medical estimate is the weakest of the three available proofs.

C) Narco-analysis (about 12.5 marks)

What it is. Narco-analysis is the interrogation of a subject brought by a slow intravenous infusion of a barbiturate, usually sodium pentothal, into the hypnotic stage between consciousness and surgical anaesthesia, in which the cortical functions governing deliberate control of speech are depressed before those governing speech itself. The popular name "truth serum" is a misnomer and the misnomer is the whole scientific objection: no drug compels truth. The procedure requires an anaesthetist monitoring vital signs with resuscitation equipment available, a psychologist conducting the interview and a forensic expert recording, with the session on audio and video.

Why it is unreliable. Four separate reasons. Suggestibility: the induced state amplifies susceptibility to the suggestion carried in a question, and the questioner works to a police case theory. Confabulation: the subject fills gaps in recollection with plausible material and reports it with the confidence of genuine memory, so the video shows a man speaking without any indicator of deception. Indistinguishability: nothing in the output separates experience from fear, imagination or what the subject was told. Absence of validation: no published error rate, no controlled study of the ratio of true to false statements, and no accepted method of scoring, so the technique fails the reliability requirement for expert evidence laid down in Ramesh Chandra Agrawal v. Regency Hospital Ltd., (2009) 9 SCC 709 before any constitutional question arises. The consequence usually missed is that it cannot reliably exonerate either.

The Indian law before 2010. The technique was permitted, and in this State the leading decision was Ramchandra Ram Reddy v. State of Maharashtra, decided by the Bombay High Court on 5 March 2004, upholding orders of the Special Court at Pune permitting brain mapping, polygraph and narco-analysis of the accused in the counterfeit stamp paper investigation in which Abdul Karim Telgi was the principal accused. The High Court held that Article 20(3) protects against compulsory testimony, that the P-300 and polygraph tests extract none, and that the challenge to narco-analysis was premature because whether a statement was incriminating could be judged only after the test.

Selvi v. State of Karnataka, (2010) 7 SCC 263, decided on 5 May 2010, reversed that in four propositions. One, compulsory administration violates Article 20(3), because narco-analysis produces a testimonial act: the subject is made to speak, and speech in a drug-induced state is not to be treated differently from answers in an ordinary interrogation, so it falls within "to be a witness" as construed in State of Bombay v. Kathi Kalu Oghad, AIR 1961 SC 1808, which protects personal testimony but not material such as a fingerprint or handwriting specimen.

Two, it violates Article 21 independently, as an intrusion into mental privacy and an unfair procedure, which matters because it protects witnesses and suspects who cannot invoke Article 20(3). Three, consent does not make the results evidence, because the subject exercises no conscious control over the responses. Four, what survives is discovery: material subsequently discovered with the help of a voluntary test may be proved under s.27 of the Evidence Act, now the proviso to s.23(2) of the Bharatiya Sakshya Adhiniyam, 2023.

The safeguards. Selvi directed strict compliance with the National Human Rights Commission's Guidelines for the Administration of Polygraph Test (Lie Detector Test) on an Accused, 2000, extended to narco-analysis and the brain electrical activation profile: the accused must be given the option rather than required to submit; he must be informed of the legal, physical and emotional implications with access to a lawyer; his consent must be recorded before a Judicial Magistrate, with the lawyer permitted to explain and the accused told that the statement will have the status of a statement to the police and not of a confession; the Magistrate must consider the length and nature of the detention; the test must be conducted in an independent agency such as a hospital in the presence of a lawyer; and a full medical and factual narration must be recorded.

The position today. Amlesh Kumar v. State of Bihar, 2025 INSC 810, decided on 10 June 2025 by Karol and Varale JJ, set aside a Patna High Court order of 9 November 2023 permitting involuntary narco-analysis in a dowry matter, reaffirmed Selvi, and settled that an accused has no indefeasible right to undergo the test, though he may apply to the court which must weigh the totality of the circumstances, and that its findings cannot form the sole basis of a conviction. Internationally the position is the same: Townsend v. Sain, 372 U.S. 293 (1963) applied the voluntariness standards for confessions to a drug-induced statement.

Conclusion. Forensic toxicology detects and interprets poisons, and in Indian practice is dominated by organophosphate pesticides and aluminium phosphide; its decisive stage is the collection and preservation of viscera under s.194(3) of the Sanhita, with saturated saline as preservative and rectified spirit excluded where alcohol is in issue, followed by screening and confirmatory analysis whose interpretation must allow for post-mortem redistribution, tolerance and decompositional ethanol.

Narco-analysis is interrogation under a barbiturate infusion, unreliable because suggestibility and confabulation are properties of the state it induces, and after Selvi and Amlesh Kumar it cannot be compelled, its results are inadmissible even on consent, and only a discovery made in consequence of a voluntary test survives under the proviso to s.23(2) of the Sakshya Adhiniyam.
