The Paper as Set

The questions in this volume are the questions asked at the Nov 2017 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

Instructions printed on the paper

  • N.B: (1) Answer all questions. (2) The Figures to the right indicate the marks.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)What is Voyage?[2]

Answer

Meaning. In marine insurance, a voyage is the passage of a ship from one place to another, or to several others. It follows the course the policy contemplates. A voyage policy insures the subject matter "at and from", or from one place to another (section 27(1) of the Marine Insurance Act, 1963).

The rules that bind a voyage.

  1. Commencement. An "at and from" adventure must begin within a reasonable time, or the insurer may avoid the contract (section 44).
  2. The right ports. The ship must sail from the named port to the named destination. If she sails for another, the risk does not attach (sections 45 and 46).
  3. Change of voyage. If the destination is voluntarily changed, the insurer is discharged from the time the decision is shown (section 47).
  4. Deviation. Leaving the designated or usual course without lawful excuse discharges the insurer (section 48).
  5. Delay. The voyage must be pursued with reasonable dispatch (section 50).
munotes.in 2

Excuses. Deviation or delay is excused for reasons such as the safety of the ship or saving human life (section 51).

Example. A ship insured "from Kandla to Jebel Ali" must sail from Kandla for Jebel Ali along the usual route, without unreasonable delay.

Conclusion. A voyage is the insured passage between named places. A voyage policy covers it only while the ship keeps to that voyage, its route and reasonable dispatch.
