Answer
A SAFE kit is a "Sexual Assault Forensic Evidence" kit: a standard set of items for collecting and preserving evidence from a survivor of sexual assault. The Ministry of Health and Family Welfare's Guidelines and Protocols: Medico-legal care for survivors/victims of sexual violence (2014) provide for it, so that every examination follows "a uniform method of examination and evidence collection".
What it contains. The guidelines list:
- forms for documentation, and a large sheet of paper to undress over;
- paper bags for the clothes;
- sterile cotton swabs and swab guards for biological evidence;
- a comb, a nail cutter and a wooden stick for fingernail scrapings;
- a urine container, blood tubes, syringes and glass slides;
- envelopes or boxes and labels for each sample, and sealing wax;
- clean clothing for the survivor after the examination.
Why it matters. Evidence is collected only "with the consent of the survivor". The doctor examines her under section 184 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The kit keeps the samples sealed and labelled, which preserves "a clear and fool-proof chain of custody" for the trial. Consent is taken separately for the examination, the sample collection, the treatment and informing the police. Refusing the evidence collection never means refusing treatment. The samples may be kept in the hospital until the police can send them to the forensic laboratory. In State of Jharkhand v. Shailendra Kumar Rai, decided on 31 October 2022, the Supreme Court directed that these guidelines be circulated to all government and private hospitals.
