The Paper as Set

The questions in this volume are the questions asked at the Dec 2017 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

Instructions printed on the paper

  • N.B: 1. All questions are compulsory. 2. Figures to the right indicate full marks. 3. Cite relevant case laws wherever necessary.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

20 Marks - 2 marks each

munotes.in 1

(a)Name the Central Act for Disaster Management in India.[2]

Answer

The Central Act for disaster management in India is the Disaster Management Act, 2005 (53 of 2005). It is "an Act to provide for the effective management of disasters and for matters connected therewith or incidental thereto".

Its key facts.

  1. Enactment and commencement. It received assent on 23 December 2005. Its provisions were brought into force in stages, the first on 28 July 2006, when the National Disaster Management Authority sections began.
  2. Its structure. It sets up the National Disaster Management Authority under the Prime Minister (section 3). State Authorities work under the Chief Ministers (section 14), and District Authorities under the Collectors (section 25). Each prepares a disaster management plan (sections 11, 23, 31).
munotes.in 2
  1. Its reach. "Disaster" covers any catastrophe "arising from natural or man made causes, or by accident or negligence" that is "beyond the coping capacity of the community" (section 2(d)). In Gaurav Kumar Bansal v. Union of India, decided on 30 June 2021, the Supreme Court held that the COVID-19 pandemic "is a disaster within the meaning of Section 2(d)".
  2. Recent changes. The Disaster Management (Amendment) Act, 2025 came into force on 9 April 2025. It added the National Crisis Management Committee (section 8A) and Urban Disaster Management Authorities (section 41A). From 15 May 2026 the Jan Vishwas Act lowered the penalties in sections 51 to 53.
