munotes.in is an independent study resource for students of the University of Mumbai. It is not affiliated with the University of Mumbai, and is not endorsed by it.

The University does not publish an official answer key for this paper. The answers in this volume are model answers, written to show how a full-mark answer is built. They are a study aid, not an authority on what an examiner marked.

The question paper reproduced here is the paper as set by the University of Mumbai at the Nov 2024 - 60/40 examination.

The law under these papers has moved. The Indian Penal Code, the Code of Criminal Procedure and the Evidence Act were replaced by the BNS, BNSS and BSA on 1 July 2024; adultery (section 497) was struck down on 27 September 2018 and is not in the BNS. The Maternity Benefit Act, the Factories Act and the Equal Remuneration Act were repealed on 21 November 2025 by the Code on Social Security, the OSH Code and the Code on Wages. The Child Marriage Restraint Act, 1929 gave way to the 2006 Act on 1 November 2007, and the Juvenile Justice Act, 2000 to the 2015 Act on 15 January 2016. Each answer gives the law the paper asked about and the law that applies now.

The Paper as Set

The questions in this volume are the questions asked at the Nov 2024 - 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 60  ·  23 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)Define Dower/Meher.[2]

Answer

Dower (mahr or mehr) is money or property the wife is entitled to receive from the husband in consideration of the marriage. That is Mulla's definition (section 217). It is a right of the wife under Muslim law, and it belongs to her alone.

Its nature.

  1. It is an essential part of a Muslim marriage. Even if no dower is fixed, the wife is entitled to a proper dower (mahr-ul-misl). It is fixed by the dower of other women of her father's family.
  2. It is a debt on the husband, and after his death a debt on his estate.
  3. It is not dowry. The Dowry Prohibition Act, 1961 expressly excludes "dower or mahr" from dowry (section 2).

Kinds.

  1. Prompt dower (mu'ajjal) is payable on demand.
  2. Deferred dower (muwajjal) is payable on death or divorce.

Its protection. A wife may refuse to live with her husband until her prompt dower is paid. A widow whose dower is unpaid may hold her husband's property until it is paid. Section 5 of the Dissolution of Muslim Marriages Act, 1939 keeps her right to dower on dissolution.

Case. In Mohd. Ahmed Khan v. Shah Bano Begum, AIR 1985 SC 945, the Supreme Court held that paying mahr does not by itself end the husband's duty. He must still maintain a divorced wife who cannot maintain herself.

Conclusion. Dower is the wife's own property, payable by the husband because of the marriage. It may be prompt or deferred.
