The Paper as Set

The questions in this volume are the questions asked at the 2021-22 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1Renvoi is a French word which means ______ (a) Agreement between the parties (b) Jurisdiction of Court (c) Choice of Law (d) To send back or return

Answer

The answer is (d), "to send back or return".

Renvoi is the French word for "sending back". The problem arises when the forum's choice of law rule refers a question to a foreign law. That foreign law's own conflict rule may then refer it back to the forum, or on to a third country.

An example. A British subject dies domiciled in France. The English choice of law rule refers succession to his movables to French law, as the law of his domicile. But a French court would apply the law of his nationality, English law. French law thus "sends back" the question to English law.

The leading case. In In re Annesley, [1926] Ch 692, an Englishwoman died domiciled in France. The English court decided the succession as a French court would have decided it. French law referred the matter to English law, and French law accepted that reference back, so French internal law applied.

Why the others are wrong.

munotes.in 2
  1. (a) An agreement between the parties is a contract or a choice of law clause, not renvoi.
  2. (b) Jurisdiction asks which court may hear a case.
  3. (c) Choice of law is the wider process; renvoi is one problem inside it.
