The Paper as Set

The questions in this volume are the questions asked at the May 2017 examination, in the order the University of Mumbai set them. This paper survives only in Marathi, and its questions are shown in our English rendering. The answers are ours. See the original question paper.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

munotes.in 1

(a)What do you mean by Conflict of Laws?[2]

Answer

Conflict of laws means two things.

  1. The situation. A case is connected with two or more legal systems, and each seems to claim it. Their rules give different answers.
  2. The body of law. It is the set of rules, in the forum's own law, that resolves that situation. The forum is the court hearing the case. The same subject is also called private international law.

What the rules decide. Which court may hear the case (jurisdiction), which country's law applies (choice of law), and whether a foreign judgment binds (recognition).

An example. A Mumbai firm agrees in Mumbai to sell machines to a German company, for delivery in Dubai. Indian, German and United Arab Emirates law each have a link with the contract. The Indian court's conflict rules tell it which of them governs.

Why the name misleads. The laws do not actually fight. The court picks one law for each issue, and the others simply do not apply to it. And the subject also covers jurisdiction and foreign judgments, which are not conflicts of law at all.

Conclusion. Conflict of laws is the part of a country's own law that decides cases connected with more than one legal system.
