(1)Explain the term swear according to the General Clauses Act.[2]

Answer

Section 3(62) of the General Clauses Act, 1897 provides that "swear", with its grammatical variations and cognate expressions, shall include affirming and declaring in the case of persons by law allowed to affirm or declare instead of swearing.

The definition is inclusive. Swearing keeps its ordinary meaning of taking an oath, and affirmation and declaration are added to it for those whom the law permits to affirm.

The purpose is practical. A person whose conscience or religion forbids an oath may affirm instead, and the Act ensures that wherever a Central Act requires a person to swear, an affirmation by such a person satisfies the requirement.
