(a)What is Garnishee Notice?[2]
Answer
A garnishee is a third party who owes a debt to the judgment debtor, or holds money for him, and a garnishee notice is the order by which the executing court prohibits that third party from paying the judgment debtor and requires him instead to pay the decree holder. Order XXI Rule 46 provides that the attachment of a debt not secured by a negotiable instrument shall be made by a written order prohibiting the creditor from recovering the debt and the debtor from making payment thereof until the further order of the court. Rule 46A empowers the court, upon the application of the attaching creditor, to issue a notice to the garnishee liable to pay such debt, calling upon him either to pay into court the debt due from him to the judgment debtor, or so much thereof as may be sufficient to satisfy the decree and costs, or to appear and show cause why he should not do so.
