(a)What is a letter of request?[2]
Answer
A letter of request is a formal request addressed by an Indian court to a court or judicial authority in a foreign country, asking it to examine a witness residing there and to transmit the evidence. Section 77 provides that in lieu of issuing a commission the court may issue a letter of request to examine a witness residing at any place not within India. Order XXVI Rule 5 supplies the occasion: where any court to which application is made for the issue of a commission for the examination of a person residing at any place not within India is satisfied that the evidence of such person is necessary, the court may issue such commission or a letter of request.
