Section 3(1) of the Limitation Act, 1963 fixes its field: subject to the provisions contained in sections 4 to 24, every suit instituted, appeal preferred, and application made after the prescribed period shall be dismissed, although limitation has not been set up as a defence. The Act therefore applies to three kinds of proceeding, suits, appeals and applications, and to no others; it does not apply to a writ petition under Article 226 or Article 32, nor to a criminal proceeding, for which the periods are in section 468 of the Code of Criminal Procedure and now in the corresponding provision of the Bharatiya Nagarik Suraksha Sanhita, 2023.
