The Paper as Set

The questions in this volume are the questions asked at the May 2025 - 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2 hours  ·  Total marks 60  ·  22 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)Define "Cess" under the Maharashtra Housing and Area Development Act, 1976.[2]

Answer

Section 2(9) of the Maharashtra Housing and Area Development Act, 1976 (MHADA) defines "cess" as "a tax on lands and buildings levied or leviable under Chapter VIII of this Act".

The cess in practice.

  1. Name and levy. Section 82 levies the "Mumbai Building Repairs and Reconstruction Cess" on land and buildings in Brihan Mumbai. It is charged at a percentage of the building's rateable value, fixed in the Second Schedule.
  2. Collection. The Mumbai Municipal Corporation collects it along with property tax and passes it to the State (sections 82(2) and 85).
  3. Who bears it. The owner's share is 10 per cent of the rateable value. He may recover the rest from occupiers by a proportionate increase in rent (section 82(4)).

  1. Use. The money goes into the Mumbai Building Repairs and Reconstruction Fund (section 86). The Repairs Board uses it to repair and rebuild old buildings.
  2. Exemptions. Government buildings, buildings occupied only by their owner, and buildings used only for non-residential purposes are among those exempt (section 83).

Buildings that pay it are called "cessed buildings", grouped in Categories A, B and C by their date of construction (section 84).

Validity. The scheme of Chapter VIII-A, which acquires Category A cessed buildings for their occupiers, was the subject of Property Owners Association v. State of Maharashtra 2024 INSC 835. Nine judges held that not every private resource is a "material resource of the community" under Article 39(b), and sent the challenge back to a regular bench.
