The Paper as Set

The questions in this volume are the questions asked at the Jun 2023 - 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 60  ·  22 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)How does adjudication of stamps take place?[2]

Answer

Adjudication is the procedure by which the Collector decides, on a party's application, how much stamp duty an instrument bears. It is governed by sections 31 and 32 of the Maharashtra Stamp Act, 1958.

The steps.

  1. Application. One of the parties brings the instrument, executed or not, to the Collector (section 31(1)). He asks for the Collector's opinion on the duty and the Article of Schedule I.
  2. Fee. A fee of Rs. 1,000 is paid where duty is not ad valorem. For ad valorem duty it is one rupee per Rs. 1,000, between Rs. 5 and Rs. 25.
  3. Deposit. Since Mah. XX of 2025, an executed instrument is adjudicated only after the applicant deposits the duty he himself admits is short.
  4. Evidence. The Collector may call for a true copy and affidavits (section 31(2)). He may fix the true market value under the 1995 Rules (section 31(3)).

  1. Decision and payment. He determines the duty. If the instrument was brought within one month of execution, the duty is payable within sixty days of the demand without penalty (section 31(4)).
  2. Certificate (section 32). He endorses that full duty has been paid, or that none is chargeable. The instrument is then deemed duly stamped, and may be registered and received in evidence.

Case law. In Bano Saiyed Parwaz v. Chief Controlling Revenue Authority 2024 INSC 443, duty of about Rs. 25.34 lakh was paid on an adjudicated conveyance of a Kurla property that was never registered. The Supreme Court ordered a refund, holding that the State should not rely on technicalities against a bona fide citizen.
